A RESOLUTION AMENDING RESOLUTION NO. 08-060
PROVIDING FOR A FEE DEPOSIT INTO AN ESCROW
ACCOUNT TO COVER THE COST OF EXPERTS HIRED TO
REVIEW TRAFFIC STUDIES AND REPORTS FOR CERTAIN
DEVELOPMENT APPLICATIONS, AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made
• the following determinations:
WHEREAS, Section 163.3201, Florida Statutes, .provides for the adoption and
enforcement of regulations on development activities based upon the Comprehensive Plan for St.
Lucie County.
WHEREAS, on August 1, 1990, this Board enacted the St. Lucie County Land
Development Code to further implement the Comprehensive Plan for St. Lucie County which calls
for the regulation of land development activities.
WHEREAS, Section 125.01, Florida Statutes, and the St. Lucie County Land
Development Code authorize this Board to establish a schedule of fees in order to cover the costs
of technical and administrative activities required pursuant to the St. Lucie County Land
Development Code.
WHEREAS, Section 11.12.00 of the St. Lucie County Land Development Code calls for
the establishment of a schedule of fees by the Board of County Commissioners by resolution.
WHEREAS, the Board of County Commissioners last amended the schedule of fees for
technical and administrative activities under the Land Development Code in 2022 pursuant to
Resolution No. 2022-191.
WHEREAS, the Board of County Commissioners on September 20, 2022, adopted
Ordinance 2022-27 deleting the Class A Mobile Home Permit process.
WHEREAS, the Board of County Commissioners on October 18, 2022, adopted
Ordinance No. 2022-191 creating an Administrative Variance process for single family home
variance requests of up to thirty-five percent (35%) of the minimum front, rear and side yard
setback requirements is proposed.
WHEREAS,the discussion related to the proposed new application fee providing for a fee
deposit into an escrow account to cover the cost of experts hired to review of transportation impact

studies/traffic reports resulted from discussions with the members of the Chamber of Commerce
Development Review Task Force.
WHEREAS, it is appropriate to modify the County' s fee to properly reflect the cost of
providing certain County services.
THEREFORE, BE IT RESOLVED, by the Board of County Commissioners for St.
Lucie County, Florida:
1. The Schedule of Fees attached hereto and incorporated herein as Exhibit " A" is hereby
adopted.
2. Except as amended herein, the remaining terms and conditions of Resolution No. 22-
191, 18-072 and 08-060 shall remain in full force and effect.
3. This Resolution shall take effect upon adoption.

Applications that are required to provide transportation studies to review their development impacts
shall be required to deposit a fee of $3,000 into an escrow account to cover the cost of experts hired by
the Planning and Development Services Department to review the transportation level of service,
roadways, intersections, parking and other related traffic studies submitted by the applicant as part of
the development review process or a map or text amendment submitted by a private applicant. Any
unused funds deposited by the applicant will be returned upon the final decision for the subject
application, petition, permit and/or amendment (final decision may be approval, denial, or withdrawal
of the application).
In the event, the cost for the review on behalf of County is higher than the $3,000, the applicant shall
remit the additional estimated amount or $1,000, whichever is greater, for the application review to
continue. Any unused funds deposited b, t�pplicant will be returned upon the final decision for the
subject application, petition, permit and/or amendment (final decision may be approval, denial, or
withdrawal of the application).
