LUCIE COUNTY TRANSPORTATION PLANNING ORGANIZATION; AND
AMENDING THE PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING FOR
FILING WITH THE DEPARTMENT OF STATE; PROVIDING AN EFFECTIVE
DATE; PROVIDING FOR ADOPTION; AND PROVIDING FOR CODIFICATION.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, (Board) based on
the testimony and evidence, including but not limited to the staff report, has made the following
determinations:
1. Pursuant to Article 8 of the Florida Constitution and Section 125.66, Florida Statutes, St. Lucie
County possesses the police powers to enact ordinances in order to protect the health, safety,
and welfare of the County's citizens.
2. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted
the St. Lucie County Land Development Code.
3. This Board is authorized by Section 163.3180(5), Florida Statutes, to establish, coordinate
and enforce transportation concurrency standards as necessary for the protection of the public;
and,
4. This Board is authorized by Section 163.3180(5)(c), Florida Statutes, to use professionally
accepted techniques for measuring levels of service when evaluating potential impacts of a
proposed development.
5. The Board is required by Land Development Code Section 7.05.03(B) to update the St. Lucie
County Thoroughfare Network Right-of-Way Protection Plan at least once every two (2) years.
6. On September 28, 2023, the St. Lucie County Planning and Zoning Commission, acting as
the Local Planning Agency, held a public hearing, of which due notice was published in the St.
Lucie News Tribune, and recommended approval of the proposed amendment to the Board of

County Commissioners.
7. On November 7th, 2023, the Board of County Commissioners of St. Lucie County, Florida,
held the first of two required public hearings, of which due notice was placed in the St. Lucie News
Tribune.
8. On April 2nd, 2024, this Board held its second public hearing on the proposed ordinance, after
publishing due notice in the St. Lucie News Tribune.
9. The proposed amendments to the St. Lucie County Land Development Code are consistent
with the general purpose, goals, objectives and standards of the St. Lucie County Comprehensive
Plan, are internally consistent with the remainder of the Land Development Code and are in the
best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie
County, Florida:
PART A. THE SPECIFIC AMENDMENTS TO THE ST. LUCIE COUNTY LAND DEVELOPMENT
CODE ARE AS FOLLOWS:

7.05.03 RIGHTS OF WAY DETERMINATION AND DEDICATIONS, IMPROVEMENTS

An update to the Thoroughfare Network Right-of-Way Protection Plan Map contained
in Section 7.05.03, more specifically shown as `Attachment A.'

D. Determination of Right-of-Way Alignment.
1. The Thoroughfare Network Right-of-Way Protection Plan is intended to indicate
transportation corridors, not precise alignments, and is to be based upon the Right-of-Way
Protection Map of the Transportation Element of the St. Lucie County Comprehensive Plan.
Precise alignments will be determined at the time of development review and/or as a result
of detailed alignment studies and surveys.
2. The County Engineer shall conduct, on a continuing basis, alignment studies and
surveys required to establish the precise alignment of rights-of-way shown on the
Thoroughfare Network Right-of-Way Protection Plan that are not previously established.
The centerline of the precise alignment shall be within one thousand
three hundred twenty (1,320)feet of the approximate location shown on the Thoroughfare
Network Right-of-Way Protection Plan, except where it can be demonstrated that an
alternative centerline alignment is less potentially harmful to the environment, or displaces
fewer residences, business or other development, or is more feasible technically or
financially.

7.05.10. — INTERNAL TRIP CAPTURE STANDARDS.
(Reserved). Shall follow the latest version of the "STANDARDIZED
TRANSPORTATION IMPACT STUDIES METHODOLOGY AND PROCEDURES,"
as adopted by the St. Lucie County Transportation Planning Organization.
7.06.02. — PERFORMANCE STANDARDS
A. Number of Off-Street Parking and Loading Spaces Required.
1. Off-Street Parking per Use. The most recently published edition of the Institute of
Transportation Engineers Parking Generation is adopted by reference as the use-specific
requirements for off-street parking. The most recently publishcd standards will be available

11.02.09. — SUBMITTALS FOR MINOR AND MAJOR SITE PLANS
A. Minor and Major Site Plan Requirements. Site Plan submittals shall include the

be provided for any
project not categorized as having a de minimis impact, or any proposed
development on North or South Hutchinson Island, or any other development equal to
or in excess of the thresholds identified below.

2. Project with de minimis impact: In order for a project to be classified as de minimis,
the Planning and Development Services Director must determine whether the trips
generated would not affect more than one percent (1%) of the adopted level of service
capacity. No impact will be de minimis if the sum of existing roadway volumes and the
trips generated from the project would exceed 110 percent(110%) of the adopted level
of service capacity of the affected road facility. A Traffic Statement, prepared with
published and acceptable transportation impact data shall be provided, with appropriate
distribution assumptions to provide for a de minimis impact determination. For-any-use
not specifically mentioned above, the threshold shall be the same as that for the use
that is most similar to the unmentioned use. Such determination shall be made by the
requirement of a transportation impact study if it finds, after receiving the
recommendation of the Development Review Committee and based on conditions
not needed to determine the roadway, traffic control, and acce:s improvements that
development.

b. Study Area. The base transportation impact study ar a shall include all major roadways
(collectors, minor arterials, and major arterials)within two(2)miles of the site. The study
affect levels of service at the intersection. On North and South Hutchinson Island, the
study area shall be expanded to include island to mainland bridges in each travel
direction from the development. The study area shall be verified with the Development
Review Committee before the preparation of the transportation impact report. The
Development Review Committee shall require extension of the study area to

levels of service of such roadways and intersections and existing or projected levels of
service if such roadways are Level of Service C or below.

PART C. SEVERABILITY.
If any portion of this Ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this
ordinance or any provision thereof shall be held to be inapplicable to any person, property, or
circumstance, such holding shall not affect its applicability to any other person, property, or
circumstance.
PART D. APPLICABILITY OF ORDINANCE.
This ordinance shall be applicable in the unincorporated area of St. Lucie County.
PART E. FILING WITH THE DEPARTMENT OF STATE.
The Clerk is hereby directed forthwith to send a certified copy of this ordinance to the Bureau of
Administrative Code and Laws, Department of State, The Capitol, Tallahassee, Florida 32304.
PART F. EFFECTIVE DATE.
This ordinance shall take effect upon filing with the Department of State.
