LUCIE COUNTY, FLORIDA, REPEALING RESOLUTION NO. 21-368 AND ESTABLISHING A FEE SCHEDULE FOR APPLICATIONS FOR ISSUANCE AND RENEWAL OF CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY; ESTABLISHING A FEE SCHEDULE FOR ISSUANCE OF TEMPORARY CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE WHEREAS,the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On February 20, 1996, the Board adopted Ordinance No. 96-04 which created Chapter 1-12.5 ("Life Support Services")of the St. Lucie County Code of Ordinances and Compiled Laws, to provide for the issuance of Certificates of Public Convenience and Necessity ("COPCN") for the operation of ambulance, air ambulance and wheelchair transport services in St. Lucie County. 2. On February 20, 1996, the Board adopted Resolution No. 96-48 which established the fee schedule for issuance and renewal of COPCNs pursuant to Section 1-12.4-5 and 1-12.5-16. 3. On August 12, 2014, the Board adopted Ordinance No. 14-20 which recodifies Chapter 1-12.5 as Chapter 18, Article Ill. 4. On August 17, 2021, the Board adopted Ordinance No. 21- 032 which amended the provisions of Chapter 18, Article Ill to update the procedures for the initial and renewal of COPCNs and the reporting and inspections requirements for COPCNs. 5. On October 19, 2021, the Board adopted Resolution No. 21-368, repealing Resolution No. 96-048, establishing a fee schedule that reflects the current cost of processing applications for the initial renewal of COPCNs. 6. The Board has determined that it is appropriate to repeal Resolution No. 21-368 to establish a fee for issuance and renewal of COPCNS and a fee for issuance of temporary COPCNs. NOW, THEREFORE, be it resolved by the Board of County Commissioners of St. Lucie County, Florida: 1 1. Ratification of Recitals.The foregoing recitals are hereby ratified and confirmed as true and correct and are hereby made a part of this Resolution. This Board hereby establishes the following application fees for issuance and renewal of Certificates of Public Convenience and Necessity and issuance of Temporary Certificates of Public Convenience and Necessity issued pursuant to Chapter 18, Article Ill, St. Lucie County Code of Ordinances: a. Application Fee (Class A, B, C, D, E) $500.00 b. Application Fee (Class F) $250.00 c. Renewal Application Fee (Class A, B, C, D, E) $250.00 d. Renewal Fee (Class F) $150.00 e. Temporary Certificate Application Fee $500.00 (Class A, B, C, D, E) f. Temporary Certificate Application Fee $250.00 (Class F) 2. The Application Fee(s) shall be inclusive of the review of records or inspection of the currently rostered vehicles of record being utilized. Any request for an additional vehicle as approved by the Emergency Medical Services Advisory Council and further approved by the Board of County Commissioners will require an additional inspection fee of $25.00 per approved additional vehicle. 3. The Application Fee shall be submitted along with the application or renewal application. The Application Fees set forth herein shall be nonrefundable. 4. Conflict; repeal. If any resolutions, or parts of resolutions, are in conflict herewith, this Resolution shall control to the extent of the conflicting provisions. This Resolution repeals Resolution 21-368. 5. Severability. The provisions of this Resolution are intended to be severable. If any part of this Resolution is determined to be void or is declared illegal, invalid, unconstitutional by a Court of competent jurisdiction, the remainder of this Resolution shall remain in full force and effect. 6. Effective Date. This resolution shall become effective on adoption.
