LUCIE COUNTY, FLORIDA FOR A MAJOR ADJUSTMENT TO THE WAWA MIDWAY & SELVITZ PLANNED NON-RESIDENTIAL DEVELOPMENT(PNRD)TO INCLUDE SELF-STORAGE FACILITIES, NOT TO EXCEED 45 FEET IN HEIGHT, AS AN ELIGIBLE CONDITIONAL USE FOR PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, and has made the following determinations: 1. Land America, LLC presented a petition for a Major Adjustment to the existing Planned Non- Residential Development (PNRD),to include self-storage facilities with a height allowance. not to exceed 45-feet as an eligible Conditional Use within the Wawa Midway & Selvitz PNRD, located on the northwest corner of Midway Road and Selvitz Road, as described in Section B and depicted on Exhibit A. 2. On December 7, 2021,the Board of County Commissioners approved Resolution No.2021- 415 to amend the Official Zoning Atlas from the CN (Commercial, Neighborhood) Zoning District to the PNRD (Planned Non-Residential Development) Zoning District and a Preliminary/Final PNRD site plan to be known as Wawa at Midway Road and Selvitz Road on the subject 6.00-acre site. 3. On November 23, 2022, the Planning & Development Services Director approved PDS Order 2022-048 to construct a 5,280 sq. ft. Wawa convenience store. 4. On October 3, 2023,the Wawa Midway-Selvitz Plat was recorded in Plat Book 121, Page 1. 5. On May 7, 2024,this Board held a public hearing on the petition for which public notice was published in the St. Lucie News Tribune, a sign was erected on the property, and a notice was mailed to all property owners within 500 feet at least 10 days prior to the hearing. 6. The Amendment to include self-storage facilities as a Conditional Use, with a height allowance not to exceed 45 feet,within the Wawa Midway&Selvitz PNRD is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.06.03 of the St Lucie County Land Development Code. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services Department memorandum titled MajorAdjustment to Wawa Midway & Selvitz Planned Non -Residential Development (PNRD), dated April 19, 2024. 8. The proposed MajorAdjustment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 9. A Concurrency Certificate shall be evaluated and required with each future site plan proposed within the Wawa Midway & Selvitz PNRD. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 (13)(7) of the St. Lucie County Land Development Code, the proposed Major Adjustment is in substantial conformity with the Wawa Midway & Selvitz PNRD to include self -storage facilities as a Conditional Use and with a height allowance not to exceed 45 feet is hereby approved, for the property described in Paragraph B, subject to the following conditions: 1. Prior to final site plan approval, a landscape plan shall be reviewed and approved by ERD. 2. Prior to final site plan approval, a tree mitigation plan shall be reviewed and approved by ERD. 3. Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., if applicable, the applicant shall pay any required fee -in -lieu of tree mitigation per LDC 6.00.05.D. to the county's tree mitigation fund. 4. Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 5. Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a 100% gopher tortoise survey conducted by a state certified gopher tortoise agent will be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol. These surveys are only valid for 90 days. 6. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. B. The property on which this Major Adjustment to the Planned Non -Residential Development (PNRD) is being granted is described as follows: Resolution No. 2024-096 Page 2 File No.: PD-2311-000033 LEGAL DESCRIPTION: LOT 15, LESS THE NORTH 750 FEET AND LESS MIDWAY ROAD RIGHT OF WAY; LOT 16, LESS THE NORTH 750 FEET AND LESS MIDWAY ROAD AND SELVITZ ROAD RIGHT OF WAYS; AND LESS THAT PORTION OF LOT 16 CONVEYED TO ST. LUCIE COUNTY BY WARRANTY DEED RECORDED IN OFFICIAL RECORDS BOOK 3589, PAGE 913; IN THE NE1/4 OF SECTION 6, TOWNSHIP 36 SOUTH, RANGE 40 EAST, OF MODEL LAND COMPANY'S SUBDIVISION, AS RECORDED IN PLAT BOOK 4, PAGE 34, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. CONTAINING 6.00 ACRES, MORE OR LESS. Location: Northwest corner of Midway Road and Selvitz Road. Parcel ID Numbers: 3406-504-0002-000-6 (Amendment not including Wawa, Parcel 1 Parcel ID: 3406-504-0001-000-9) C. The revision to the list of eligible permitted and conditional uses for the Wawa Midway & Selvitz PNRD is attached to this Resolution as Exhibit "B". D. The Certificate of Capacity, authorized through Resolution 2021-415, shall remain for Parcel 1, subject to the conditions and restrictions set forth in Resolution 2021-415. Future development within the Wawa Midway & Selvitz PNRD shall require a Certificate of Capacity, where required. E. A copy of this Resolution shall be mailed to the owner and agent of record as identified on the application. F. This Resolution shall be recorded in the Public Records of St. Lucie County. G.
