AN ORDER GRANTING ADMINISTRATIVE RELIEF
FOR AN EIGHTEEN (18) MONTH DEFERMENT OF
THE INSTALLATION OF A DRAINAGE SYSTEM,
DETENTION AREA, REMOVAL OF ASPHALT
MILLINGS AND CONSTRUCTION OF PAVED
SURFACE PARKING AREAS TO SERVE A SMALL
BUSINESS ON PROPERTY LOCATED AT 1313 W.
MIDWAY RD, FORT PIERCE, FL.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request to defer the construction of a stormwater system and transition parking areas from asphalt
millings to a paved surface in accordance with the provisions for relief set forth in St. Lucie County
Ordinance 12-003 and Land Development Code Section 7.06.03(A) for the property located at
1313 W. Midway Road, Fort Pierce, FL and has made the following determinations:
1. Steven Dobbs, P.E., representing Arrants, LLC, has requested administrative relief to allow
an eighteen (18) month deferment to construct a drainage system, detention area, remove
asphalt millings and construct hard surface parking areas. In accordance with the
provisions of Section 7.06.02 — all required off-street parking spaces, access aisles,
vehicular use, and off-street loading areas constructed,expanded,or altered after March 1,
1999, shall be constructed with an all-weather surface, meeting requirements of the St.
Lucie County Public Works Department. The +/-1.41-acre parcel is within the CO
(Commercial Office)and RS-3(Residential, Single Family-3du/ac,with an RU(Residential
Urban) future land use designation. All proposed commercial activities are limited to CO
zoned land.
2. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida,
adopted the St. Lucie County Land Development Code and has adopted amendments to
the Land Development Code through certain ordinances.
3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida,
adopted Ordinance 12-003 granting the Planning and Development Services Director the
authority to allow, after a full analysis of all potential impacts, certain on-site improvements
to be deferred to a future date.
4. The site is developed with a 2,267 square foot building constructed in 1949 as a home and
later used as an office, with recent improvements to support ADA access and Florida
Building Code Compliance.
5. The applicant, or tenant thereof, is seeking to establish a day spa with an accessory coffee
bar. The requirement for paving, landscaping and stormwater improvements correlates with
the increased commercial intensity for site. The WDA will assist Southern Salt&Coffee Co.
(tenant) in securing a Zoning Compliance, supporting small business operations while

advancing a time-specific schedule for these site improvements, while requiring Florida
Building Code compliance for the structure prior to occupancy.
6. This request for Administrative Relief has met the provisions for relief set forth in LDC
Section 7.06.03(A). Staff has provided a written analysis that demonstrates the proposed
relief is based upon conditions that are unique and peculiar to the site conditions.
7. The Development Review Committee reviewed the request and Planning Staff performed
an analysis of the request for deferral of the construction for the drainage system,detention
area, removal of asphalt millings and construction of hard surface parking areas. The
analysis is found in the Planning and Development Services Department memorandum
entitled "Waivers, Deferrals and Alternatives(WDA)—Southern Salt&Coffee Co. Request
for Administrative Relief(WDA-2404-000022)"dated May 20, 2024.
8. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting public health, safety, and general welfare.
9. The deferral period will be eighteen (18) months, with the possibility of one (1) ninety(90)-
day extension, if requested and notable progress has been made after inspection of site
improvements following the time-specific schedule below:
Phase 1
(1) Within the first six (6) months of recording WDA
(a) Secure Site Development Permit.
(b) Obtain Zoning Compliance Certificate.
(c) Complete landscaping requirements.
Phase 2
(2) Within eighteen (18) months of recording WDA
(a) Construct a drainage system and detention area.
(b) Remove existing asphalt millings and construct hard surface parking areas.
NOW,THEREFORE, BE IT ORDERED: BY THE PLANNING AND DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY, FLORIDA:
A. Pursuant to Ordinance 12-003 and the St. Lucie County Land Development Code, the
request from Steven Dobbs, P.E., on behalf of Southern Salt & Coffee Co., for
administrative relief to defer the construction of the drainage system, detention area,
removal of asphalt millings and construction of hard surface parking areas as generally
depicted herein by Exhibits A and B is hereby approved,subject to the following conditions:
1. Within thirty (30) days of approval of PDS Order 2024-032, the applicant shall submit a
landscape plan consistent with LDC Section 7.09.00. The applicant may utilize any of the
existing onsite native vegetation to meet these requirements.
2. A Site Development Permit (SDP) is required for the onsite paving and stormwater
improvements.

3. The easement for the proposed shared parking shall be executed within 90 days of WDA
approval.
4. Within three (3) months of the Waivers, Deferrals, and Alternatives application approval,
the applicant shall have installed the landscaping along the road right-of-way/entrance and
vehicular use area (VUA) to the eastern portion of the property.
5. Within six (6) months of the Waivers, Deferrals, and Alternatives application approval, the
applicant shall have installed the remaining landscape requirements, including screening
interior VUA from adjacent properties to the south.
6. Within eighteen (18) months of this approval, parking shall be installed with an all-weather
surface material approved by the County Engineer with required stormwater, and certified.
7. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant species
shall be eradicated from the site.
8. After the first six (6) months, and at twelve (12) months, the applicant shall schedule an
Erosion and Sedimentation Control inspection of barriers or other sediment trapping
structures, intended to function as stabilization or prevention measures for erosion and
sedimentation control.
9. This waiver shall allow six(6)months for the first phase of improvements and an additional
twelve (12) months for the second phase. If the applicant fails to fulfill the requirements of
each phase within the specified timeline, the Planning and Development Services Director
or designee may void PDS Order 2024-032 within 30 days with a written notice if no
extension has been requested or approved. The applicant may be granted a one-time
ninety(90)day extension if requested, with notable progress made on-site improvements.
10. Within eighteen (18) months of the date of approval of PDS Order 2024-032, the applicant
shall complete all site paving, drainage requirements and landscaping improvements,
unless a one-time ninety (90) day extension is granted. After the approved deferment
period, the property shall comply with the minimum code standards of all applicable
sections of the Land Development Code. If the property does not meet all applicable
standards, it may be subject to a Code compliance violation.

C. The approvals and authorizations granted by this Order are provided to the applicant for
the purpose of obtaining construction permits or a Zoning Compliance Certificate from St.
Lucie County, where other applicable standards and obligations of the Order are met.
D. The developer is advised as part of this approval for Arrants LLC. in favor of Southern Salts
Therapies Inc., a tenant of the property, including any successors in interest,the developer
shall obtain all applicable development permits and construction authorizations from the
appropriate State and Federal and local regulatory agencies including, but not limited to,
the United States Army Corps of Engineers, Florida Department of Environmental
Protection, South Florida Water Management District, and St. Lucie County's
Environmental Resources and Building Departments prior to the commencement of any
development activities on the property described in Part B. Issuance of this approval by
the County does not in any way create any rights on the part of the developer to obtain a
permit from a State or Federal agency and does not create any liability on the part of the
County for issuance of this approval if the developer fails to obtain requisite approvals or
fulfill the obligations imposed by a State or Federal agency or undertake actions that may
result in a violation of State or Federal law.
E. The conditions set forth in Part A are an integral non-severable part of the Administrative
Relief approval as granted by this Order. If any condition set forth in Part A is determined to
be invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the Administrative Relief approval granted by this order shall become
null and void.
F. A copy of this Order shall be placed on file with the Planning and Development Services
Director and mailed to the developer or agent of record as identified on the written request
for administrative relief.
G. This Order shall be recorded in the Public Records of St. Lucie County.
