LUCIE COUNTY, FLORIDA GRANTING APPROVAL FOR A MAJOR ADJUSTMENT TO THE PLANNED UNIT DEVELOPMENT (PUD) KNOWN AS CREEKSIDE, FOR PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: Lucido & Associates, on behalf of D.R. Horton, Inc., and the Creekside Community Development District presented a petition for a Major Adjustment to the Creekside Planned Unit Development (PUD). The site plan modifications propose to 1) Adjust the Project Phasing Plan, 2) Provide building layouts for the multi -family (townhomes) parcels E & F, 3) Reconfigure pedestrian walkways and trails along and adjacent to Ten Mile Creek including removal of two pedestrian bridges and relocation of the remaining bridge, 4) Remove the planned Native American Heritage Village, 5) Relocate and reconfigure the Parcel E Open Space Park, 6) Clarify the approved South Florida Water Management District (SFWMD) bridge location, 7) Relocate the Transit/School Bus Stop locations for Parcels C & E, 8) Affirm minimum landscape buffer widths, entry sign features, and miscellaneous layout modifications associated with the stated adjustments. The subject property is located on the south side of Okeechobee Road (SR 70), 'h mile west of the Florida Turnpike, as more particularly described in Part "B" below and depicted in Exhibit „A„ 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet the standards of review as set forth in Section 11.02.07 of the St. Lucie County Land Development Code, and found it to meet technical requirements and to be consistent with the general purpose, goals, and objectives, of the St. Lucie County Comprehensive Plan. 3. On November 15, 2004, the Board of County Commissioners granted approval for Preliminary Planned Development (PUD) for Creekside Subdivision (Resolution 04-129). 4. On October 4, 2005, the Board of County Commissioners granted Final Planned Unit Development which consists of 800-unit residential subdivision (443 single-family units, 337 townhouse units), a 5.5-acre commercial/residential area and a 5.1-public park (Resolution 05-154). 5. On February 6, 2006, the Planning and Development Services Director approved Minor Adjustment #1, a transfer of 4 units from Parcel F to Parcel A (Letter). 6. On July 31, 2006, the Planning and Development Services Director approved Minor Adjustment#3, to allow the location of entry walls, towner amenity and corner walls (Letter). 8. On November 15, 2006, Creekside Plat No. 1 was recorded in public records. 9. On February 13, 2007, the Board of County Commissioners approved Creekside Plat No. 2 Final Plat. 10. On April 15, 2014, the Board of County Commissioners approved the replat of Creekside Plat No. 2 to be known as Creekside Plat No. 3. 11. On March 31, 2017, the Planning and Development Services Director approved Adjustment #4, amending Parcel A landscape plan and entry/perimeter wall (PDS Order 17-013). 12. On June 4, 2019, the Board of County Commissioners granted approval for the replat of Creekside Plat No. 5 consisting of 129 single-family lots. 13. On December 1, 2020, the Planning and Development Services Director approved PDS Order 2020-080, a Minor Adjustment to construct a temporary community sales center with a model home located on Lots 62 and 63 of Parcel B (Plat No. 4). 14. On May 22, 2023, the Planning and Development Services Director approved PDS Order 2023-021, authorizing a Minor Adjustment for the Creekside Amenity Center. 15. On February 6, 2024, the Board of County Commissioners approved the Creekside PUD Tracts Plat for Tracts C through F to accommodate a public roadway and future residential development. 16. On April 26, 2024, this Board held a public hearing on the petition, for which public notice was published in the St. Lucie News Tribune, two (2) signs were erected on the property, and a notice was mailed to all property owners within 500 feet at least 10 days prior to the hearing. 17. Planning staff performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services Department memorandum titled Creekside PUD Major Adjustment (MJSP-2312-000113), dated April 24, 2024. 18. The proposed Adjustment will not have an undue adverse effect on adjacent properties, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. 19. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through tower design, site design, landscaping, and screening. Page 2 Resolution No. 2024-099 File No.: MNSP-2312-000113 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 (B)(7) of the St. Lucie County Land Development Code, the proposed Major Adjustment is in substantial conformity with the Creekside PUD is hereby approved, as depicted on the site drawings for the project prepared by Lucido&Associates dated March 19, 2024, and April 22, 2024 (Pedestrian Plan), date received by the St. Lucie County Planning & Development Services Department on December 14, 2023, for the property described in Part B below subject to the following conditions: 1. A future sidewalk or multiuse path to connect residents to the future commercial shall be addressed with a future commercial development plan within the subject Tract (Outlined in PDS Order 2023-021). 2. {excluding a master tract plat), tThe development will be required to shall abide by the terms and conditions of the Adjusted PUD, including but not limited to restoration and planting requirements associated with the flow way marsh/oxbow restoration and pedestrian connections, subject to the following thresholds below: • Plat/ Unit Development for Parcel E • Building Foundation for primary amenity prior to Townhome permit issuance. • Amenity Center Certificate of Occupancy (CO) prior to CO for Townhomes. • Prior to CO of 66th unit, 100% of the oxbow reconnection and excavation of the unencumbered portions of the Filter Marsh (areas not affected by SFWMD ROW) shall occur. • Plats for C, D and F are allowed to be issued (recorded*), but the construction is limited to the below: • Prior to Commencement of Unit Construction of Parcels C, D and F (with the exception of what is allowed bythe Tracts Plat Approvals) thefollowing p pp ) shall be completed: • 50% of the South Florida Water Management District (SFWMD) access road • Portions of the pedestrian paths where adjacent construction is occurring. • Prior to COs for up to 20% of the remaining(non-Parcel E)residential units(+/-81 units), 80% completion of the above items shall be required. • Prior to COs for any remaining units (324), 100% Completion shall be required. • A surety or bond shall be required for the outstanding improvements(at 50%/80%, one-time reduction). (As modified from PDS Order 2023-021) 3. The property owners/applicants shall include seven (7) park benches and two (2) gazebos along the pedestrian walkways and trails. The relocated park in parcel E shall include playground amenities equipment in the playground area. 4. Prior to plat approvals for parcels C, D, E, & F, finalized landscape plans consistent with LDC 7.09.00 for each corresponding parcel shall be provided. Prior to plat approvals for parcels C, D, E, & F, finalized tree mitigation plans consistent with LDC 6.00.05.D for each corresponding parcel shall be provided. 6. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, the developer shall provide the executed amended Conservation Easement over the onsite preserve areas, along with the approved Preserve Area Monitoring and Management Plan (PAMMP), with an attached affidavit and cashier's check (payable to the Clerk of the Court for recording fees) to the County Attorney. The applicant shall also provide a georeferenced GIS shapefile or CAD file of the conservation easement boundaries to St. Lucie County. 7. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, listed species surveys shall be updated as necessary per individual species-specific requirements or written correspondence stating any potential impacts have been resolved from the appropriate state and federal agency. If any listed species impacts are found to be present as a result of these updated surveys, appropriate mitigative measures per state and federal agency requirements shall be provided prior to initiation of any clearing activities. 8. Prior to commencement of development of the filter marsh, including, but not limited to I rin c ea g, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, an Environmental Resource Permit (ERP) from South Florida Water Management District (SFWMD) shall be provided. 9. Prior to the issuance of a Certificate of Occupancy of the 66th unit within Parcel E, one hundred percent (100%) of the oxbow reconnection and excavation of the unencumbered portions of the filter marsh (areas not affected by South Florida Management District's (SFWMD) right-of-way) shall be completed. 10. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. 11. A Site Development Permit is required prior to the commencement of work on any of the proposed phases. B.
