LUCIE COUNTY, FLORIDA, FOR A MAJOR SITE PLAN FOR A PROJECT TO BE KNOWN AS BHASIN INDUSTRIAL ON APPROXIMATELY 18.23 ACRES OF PROPERTY LOCATED ON THE SOUTH SIDE OF ST. LUCIE BOULEVARD, BETWEEN NORTH KINGS HIGHWAY AND TAYLOR DAIRY ROAD, IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based upon acceptable evidence, including but not limited to the staff report, has made the following determinations: 1) Leslie Olson, AICP, on behalf of Bhasin Properties, submitted a petition for a Major Site Plan encompassing three single-story buildings, totaling 177,000 square feet, with 167,000 square feet of warehouse use and 10,000 square feet of office use, 281 parking spaces, a wet stormwater retention area, and landscape buffers for the property depicted in the attached map as Exhibit "A" and legally described in Paragraph "B" below. 2) On February 20, 2024, the Board of County Commissioners held a public meeting, with the agenda including this petition. 3) The St. Lucie County Development Review Committee has reviewed the Major Site Plan and found it to meet the technical requirements and to be consistent with the St. Lucie County Comprehensive Plan. 4) The Major Site Plan, with the conditions therein, is consistent with the Goals, Objectives and Policies of the St. Lucie County Comprehensive Plan and satisfies the Standards of Review of Section 11.02.07 of the St. Lucie County Land Development Code. 5) The use will not have an undue adverse effect on adjacent property, the character of the neighborhood, and other matters affecting the public health, safety, and general welfare. 6) The use is arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with the applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, the Major Site Plan for Bhasin Properties to develop a warehouse MICHELLE R.MILLER.CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE# 5343699 05/30/2024 10:40:18 AM Resolution No. 2024-42 OR BOOK 5156 PAGE 1265-1272 Doc Type RESO RECORDING $69.50 File No.: MJSP 2302 000061 complex with accessory offices as depicted in the attached Site Plan, Exhibit B, prepared by Abraham Chabab, Inc., final revision date June 28, 2023 and associated Landscape Plan, prepared by Integrated Perspectives, final revision date October 5, 2023, enclosed in Exhibit "C", applicable to the described in Paragraph "B", below, in the IL (Industrial, Light) zoning district, is hereby approved subject to the following conditions: 1) The Certificate of Capacity, as found in Exhibit "D" is granted based upon the project's assumed trip generation rates under the Institute of Traffic Engineers' (ITE) Trip Generation (11th Edition) classification for Warehouse (ITE Land Use 150). Should a change in the facilities use be proposed, an amendment to the Traffic Impact Analysis and Site Plan (Concurrency Certificate) may be required. 2) Prior to the issuance of a Certificate of Occupancy, the property owner(s), the developer, his successors, or assigns, shall convey to St. Lucie County in a manner or form acceptable to the St. Lucie County Attorney, a forty (40) foot strip of land for right-of-way along St. Lucie Boulevard. The required sketch and legal description shall be prepared by a Florida licensed surveyor and mapper. 3) The proposed Fee-in-Lieu of sidewalk is required to be submitted and completed prior to issuance of the Site Development Permit. If the Board of County Commissioners does not approve the Fee-in-Lieu of sidewalk request, a six-foot wide sidewalk will be required to be constructed along the St. Lucie Boulevard frontage. 4) A Site Development Permit is required prior to performing site improvement activities. 5) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, listed species surveys shall be updated as necessary per individual species-specific requirements. If any listed species impacts are found to be present as a result of these surveys, appropriate mitigative measures per state and federal agency requirements shall be provided prior to initiation of any clearing activities. 6) Prior to commencement of development, including but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a vegetation removal permit or exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 7) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant species shall be eradicated from the site. The subject property is described as follows: Legal Description: THE WEST 1 /2 OF THE FOLLOWING DESCRIBED PARCEL: THE NORTHEAST 1/4 OF THE NORTHWEST 1/4 OF SECTION 36, TOWNSHIP 34 SOUTH, RANGE 39 EAST, LESS RIGHT-OF-WAY FOR ST. LUCIE BOULEVARD (S.R. #608) OVER THE NORTH 50 FEET THEREOF, ST. LUCIE COUNTY, FLORIDA. (18.23 ACRES + /-) THE ABOVE DESCRIBED REAL PROPERTY BEING MORE PARTICULARLY DESCRIBED AS: THE WEST 618 FEET OF THE EAST 1331 OF THE NORTHEAST 1/4 OF THE NORTHWEST 1/4 OF SECTION 36, TOWNSHIP 34 SOUTH, RANGE 39 EAST LESS THE NORTH 50 FEET FOR ROAD RIGHT-OF-WAY ST. LUCIE COUNTY, FLORIDA. (18.23 ACRES+/-) SITUATE IN THE COUNTY OF SAINT LUCIE, STATE OF FLORIDA. Parcel ID Number: 1336-212-0000-000-6 C. The Major Site Plan approval granted by this Resolution shall become null and void unless a Building Permit is obtained within twenty-four (24) months, or an extension is granted in accordance with Section 11.02.06(A) of the St. Lucie County Land Development Code. D. The conditions set forth in Paragraph "A" are an integral non-severable part of the approval granted by this Resolution. If any condition set forth in Paragraph "A" is determined to be invalid or unenforceable for any reason and the applicant or property owner declines to comply voluntarily with that condition, Major Site Plan approval granted by this Resolution shall become null and void. E. The Certificate of Capacity for this Permit, signed by the Planning & Development Services Director on February 20, 2024, is attached as Exhibit E. The Certificate of Capacity shall remain valid for the term of this resolution unless revoked by the Board of County Commissioners. F. The St. Lucie County Planning and Development Services Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. G. A copy of this Resolution shall be mailed to the owner of record as identified on the application. A copy shall be attached to the Site Plan drawings as described in Paragraph A and placed on file with the Planning and Development Services Department. H. This Resolution shall be recorded in the Public Records. I.
