HomeMy WebLinkAbout24-046 PDS Order 2024-046 MNSP-2311-000090 AN ORDER GRANTING A THIRD MAJOR ADJUSTMENT TO A MINOR SITE PLAN FOR A PROJECT KNOWN AS AEREX INDUSTRIES (FKA TOM DONNICK) WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Aerex Industries, and representative, Brad Currie, AICP, applied for a third Major Adjustment to the Minor Site Plan, known as Aerex Industries, to modify the approved expansion plan for the existing 27,064 sq. ft. manufacturing facility. The modified plan refines the planned addition to a 13,175 sq. ft. building, introduces an additional 17,500 sq. ft. building, adjusts the storage area to offset, and relocates the new driveway to serve the expansion, affirming the planned storage areas, reconfigured stomiwater, and enhanced landscape screening. The collective expansion pursues a 57,739 sq.ft. build- out for the facility located at 3504 Industrial 27th Street, in the IL (Industrial, Light) Zoning District, and described in Part B below and identified in Exhibit A. 2. On March 22, 1988, the Board of County Commissioners approved Resolution 88-63 granting site plan approval for a project known as Tom Donnick Fabricated Metal Product Inc. located at the intersection of Industrial 25th Street and Industrial 27th Street. 3. On April 26, 1994, the Board of County Commissioners approved Resolution 94-074 granting a Major Adjustment to the Tom Donnick Fabricated Metal Products, Inc. site plan for a 16,750 sq. ft. addition to an existing 9,228 sq. ft. site plan project. 4. On January 25, 2016, the Planning & Development Services Director approved PDS Order 16-007 granting a Major Adjustment to the Tom Donnick Fabricated Metal Products, Inc. site plan to rename the project to Aerex Industries, add an 8,500 sq. ft. building, and expand outside storage areas for the existing 27,064 sq. ft. manufacturing facility. 5. On December 20, 2019, the Planning & Development Services Director approved PDS Order 19-053 granting a second Major Adjustment to the Minor Site Plan for a 13,515 PDS Order 2024-04 TAINT NICHELLELUCIE R.COUNTY MILLER.CLERK OF THE CIRCUIT COURT MNSP-2311-000090 FILE# 53155634 06/2 101214 11:4106 AM Page 1 of 7 DR BOOK 5170 PAGE 1112-1119 Doc Type:ORD RECORDING: $69.50 sq. ft. addition, entry porch, expanded outside storage areas, reconfigured stormwater, and enhanced landscape screening. 6. In 2020, the Planning & Development Services Director approved a Deferral via PDS Order No. 2020-049 which provided for a layout yard phasing plan and landscape planting timeline for the southern boundary, adjacent to a currently undeveloped site. 7. The Development Review Committee has reviewed the proposed site plan for the project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. 8. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 9. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Staff Report for Aerex Industries - Major Adjustment to a Minor Site Plan, dated June 7, 2024. 10.The applicant has applied for and received a Certificate of Capacity as required by Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Major Adjustment to the Minor Site Plan project known as Aerex Industries is hereby approved as shown on the site plan drawings for the project prepared by Engineering Design and Construction, Inc., as revised on April 12, 2024 and date stamped received by the St. Lucie County Planning Division on April 23, 2024,depicted on Exhibit B, maintaining the deferred timeline to complete the southern landscape buffer requirements provided by PDS Order 2020-049, subject to the following conditions: 1. Prior to issuance of a Certificate of Occupancy for the expansion, a utility easement (Sketch and description) for the existing Fort Pierce Utilities Authority (FPUA) facilities (pad mounted transformer, underground primary line and the fiber optic cable) shall be prepared by the applicant or designee. Prior to commencement of development, including, but not limited to clearing,filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a 100% gopher tortoise survey conducted by a state certified gopher tortoise agent will be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol, as these surveys are only valid for 90 days. 3. Prior to commencement of development, including, but not limited to clearing,filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 4. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. 5. Upon any development approval for the adjacent southern properties or within 24 months of this approval, whichever occurs first, the applicant shall install the southern perimeter landscaping as shown on the approved Landscape Plan. All other landscaping as shown on the approved plans shall be installed prior to issuance of the Certificate of Occupancy 6. Each phase of concrete installation, where applicable, shall be permitted and inspected by the St. Lucie County Building Division, and completed in accordance with the St. Lucie County Stormwater Permit. B. The property on which this Major Adjustment to a Minor Site Plan approval is being granted is described as follows: LOTS 2, 3, 16 AND 17 BLOCK 6, AIRPORT INDUSTRIAL PARK UNIT ONE, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 20, PAGE 3, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Address: 3504 Industrial 27th Street, Fort Pierce, FL 34946 Parcel ID#: 1429-502-0002-0005 C. The developer is advised as part of this Site Plan approval that the developer or any successor in interest shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, United States Fish and Wildlife, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Building, and Public Works Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals PDS Order 2024-046 MNSP-2311-000090 Page 3 of 7 or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The adjusted Minor Site Plan, attached as Exhibit B, shall be valid for twenty-four (24) months, unless a development permit is obtained or the authorization is extended in accordance with Section 11.02.06 B. of St. Lucie County Land Development Code. H. The updated Certificate of Capacity, attached as Exhibit C, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. I.
