R N W U1ZoC�N - 00°a" NHEREAS, the St. Lucie County Planning and Development Services Director has reviewed g U p » W c� he request to defer the installation of the southern perimeter landscaping and irrigation in J 0 o o accordance with the provisions for relief set forth in St. Lucie County Ordinance 12-003 and ILI ▪Z W m o -and Development Code Section 7.06.03(A) for property located at 5701 Environment Dr. Fort cn u_o ce 'fierce, FL and has made the following determinations: 1. EDC, Inc. on behalf of Contender Boats Inc., has requested administrative relief to defer the installation of the southern perimeter landscaping and irrigation associated with the approved Site Plan. The project is located at 5701 Environment Dr. in Ft. Pierce, and currently consists of one (1) 19.47-acre parcel (Parcel ID 3301-500-0002-000-2) zoned Industrial Heavy (IH), with one (1) 98,067 sq. ft. office/warehouse and associated site improvements. The parcel abuts Midway Road, however, it is adjacent to the Turnpike overpass. 2. On October 2, 2023, a Major Adjustment to the Minor Site Plan to be known as Contender Boats (FKA Chiquita Citrus Packing / Indian River Packers), was approved to expand the manufacturing facility to add two buildings totaling 139,860 square feet, add a 1,200 square foot containment area, and add resin tanks. 3. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 4. May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to allow, after a full analysis of all potential impacts, certain on-site improvements to be deferred to a future date. 5. This request for Administrative Relief has met the provisions for relief set forth in LDC Section 7.06.03(A). Staff has provided a written analysis that demonstrates the proposed relief is based upon conditions that are unique and peculiar to the site conditions. 6. The Development Review Committee reviewed the request and Planning Staff performed an analysis of the request for deferral of the installation of the southern perimeter landscaping and irrigation associated with the site plan. The analysis is found in the Planning and Development Services Department memorandum entitled "Waivers, Deferrals and Alternatives (WDA) Contender Boats — Request for Administrative Relief — (WDA-2403-000020)"dated June 19, 2024. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 8. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. NOW, THEREFORE, BE IT ORDERED: A. PURSUANT to Ordinance 12-003 and the St. Lucie County Land Development Code, the request from EDC, Inc., on behalf of Contender Boats., for administrative relief to defer the installation of the southern perimeter landscaping and irrigation associated with the approved Site Plan, as generally depicted herein by Exhibits A and B is hereby approved, subject to the following conditions: Environmental Resources Department: 1. (Revised) This WDA and Condition, allow relief from the following conditions of approval of PDS Order 2023-030. As stated on the revised landscaped plan prepared by Conceptual Design Group, Inc., dated April 23rd, 2024, should no building permit be issued prior to October 2, 2025 (the date of expiration of the attached approval order), then the southern buffer landscaping shall be required to be installed within 180 days of said date, by March 31st, 2026, regardless of administrative order extensions that may be granted. B. The property on which this deferment is being granted is described as follows: LEGAL DESCRIPTION: Lot 1, the Packers of Indian River Plat One, according to the Map or Plat thereof as recorded in Plat Book 39, Page 11, Public Records of Saint Lucie County, Florida. Address: 5701 Environment Dr. Fort Pierce, FL 34981 PARCEL ID No.: 3301-500-0002-000-2 C. The approvals and authorizations granted by this Order are provided to the applicant for the purpose of obtaining construction permits or a Zoning Compliance Certificate from St. Lucie County, where other applicable standards and obligations of the Order are met. D. The developer is advised as part of this approval for Contender Boats Inc., owner of the property, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, Florida Department of Environmental Protection, South Florida Water Management District, and St. Lucie County's Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency Page 2 PDS Order No. 2024-034 File No.: WDA-2403-000020 and does not create any liability on the part of the County for issuance of this approval if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth is Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. F. A copy of this Order shall be placed on file with the Planning and Development Services Director and mailed to the developer or agent of record as identified on the written request for administrative relief.
