W • ao O rnM N NHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the w 8 equest for a Minor Adjustment for the Minor Site Plan and reviewed the comments of the U o N Development Review Committee and has made the following determinations: W O =1podNi 1. Amanda Gagnon with MBV Engineering, on behalf of lessee Fort Pierce FBO, LLC, W o-0requested a Minor Adjustment to the Fort Pierce Air Center Minor Site Plan, for ADA w U co z _izroY o o parking modifications and a parking lot addition to support development of the approved zUJ• w m o 18,000 sq. ft. t-hanger structure and three 3,600 sq. ft. hangers and associated site E cn E o cc improvements. The subject 16.48-acres is located on the east side of Curtis King Blvd., the primary entrance to the Treasure Coast International Airport(TCIA), at approximately 2916 Curtis King Blvd. The Future Land Use designation is T/U (Transportation/Utilities), and the zoning district is U (Utilities). 2. Pursuant to Section 3.1.122(7.) of the St. Lucie County Zoning Ordinance, effective July 1, 1984, and Section 3.01.03.(W.)(7.)(a.) of the St. Lucie County Land Development Code effective August 1, 1990, TCIA is considered to be an existing Conditional Use. 3. The Ft. Pierce Air Center has been operating as a Fixed Base Operations Center FBO on leased land since 1987. This FBO is located on the western side of the airport grounds. 4. On June 6, 2023, the Board of County Commissioners granted Resolution 2023-95, approving a Conditional Use Adjustment for the subject project. 5. On October 6, 2023, the Planning & Development Services Director granted PDS Order 2023-070, approving a Major Adjustment to a Minor Site Plan, to implement the Conditional Use Adjustment. 6. The Development Review Committee has reviewed the proposed Minor Adjustment to a Minor Site Plan and found it to meet the standards of review as set forth in Sections 11.02.03.(E.) and 11.02.07. of the St. Lucie County Land Development Code. 7. Planning staff performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services Department memorandum titled Minor Adjustment to a Minor Site Plan — SLC Airport APP Center 2916 Curtis King Blvd., Fort Pierce, FL 34946, File Number: MNSP-2403-000106, dated June 21, 2024 8. The proposed Minor Adjustment to a Minor Site Plan will not have undue adverse effect on adjacent properties, the character of the neighborhood,traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A Pursuant to Sections 11.02.03(E.)and 11.02.7. of the St. Lucie County Land Development Code, the Minor Adjustment to Minor Site Plan is hereby approved as shown on the site plan, attached as Exhibit A, prepared by MBV Engineering, Inc. dated May 9, 2024, subject to the following conditions: Environmental Resources Department: 1. Prior to any ground disturbance or impacts to any vegetation, a vegetation removal permit or exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 2. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, an updated 100% gopher tortoise survey conducted by a state certified gopher tortoise agent may be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol, as these surveys are only valid for 90 days. B. The property on which this Minor Adjustment to a Minor Site Plan approval is being granted is described as follows: BEGINNING AT THE SOUTHWEST CORNER OF SECTION 29, TOWNSHIP 34 SOUTH, RANGE 40 EAST RUN SOUTH 89°31'34"EAST 30.00 FEET TO A POINT LYING ON THE SOUTH LINE OF SAID SECTION; THENCE RUN NORTH 00°22'26" EAST 625.11 FEET PARALLEL TO THE WEST LINE OF SAID SECTION TO A POINT; THENCE RUN SOUTH 87°51'34" EAST 36.09 FEET TO A POINT; SAID POINT BEING THE POINT OF BEGINNING; FROM SAID POINT OF BEGINNING RUN SOUTH 87°51'34" EAST 668.83 FEET; TO A POINT; THENCE RUN NORTH 45°15'26" EAST 515.68 FEET TO A POINT; THENCE RUN NORTH 44°42'34" WEST 1314.92 FEET TO A POINT, SAID POINT BEING THE PC OF A CURVE CONCAVE TO THE WEST, HAVING A DELTA ANGLE OF 30'04'00"AND A RADIUS OF 1294.52 FEET; THENCE RUN IN A SOUTHERLY DIRECTION ALONG THE ARC OF SAID CURVE 678.55 FEET TO A POINT; SAID POINT BEING THE PT OF SAID CURVE; THENCE RUN SOUTH 45°17'26" WEST 100 FEET TO A POINT; THENCE RUN SOUTH 00°22'26" WEST 540.00 FEET TO A POINT: SAID POINT BEING THE POINT OF BEGINNING. ALL LYING IN SECTION 29, TOWNSHIP 34 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA. Parcel ID: 1429-323-0002-0006 Location: Approximately 2916 Curtis King Blvd. On the east side Curtis King Blvd., approximately 0.13 miles north of St. Lucie Blvd. in Fort Pierce. This Adjusted Minor Site Plan shall expire in twenty-four (24) months unless building permits, or a Site Development Permit for the parking area(s), are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Site Plan Adjustment, including any successors in interest,the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Federal Aviation Administration,the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer, authorized agent or affected party wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part A,which plan shall be placed on file with the St. Lucie Planning and Development Services Director and mailed to the developer and agent of record as identified on the site plan applications. G. The Certificate of Capacity issued by the Planning &Development Services Director,with PDS Order 2023-070, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. H. A copy of this Minor Adjustment shall be placed on file with the St. Lucie County Planning and Development Services Director. I.
