HomeMy WebLinkAbout24-039 RESOLUTION NO. 2024-39 File No.: CU-2210-000042 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FOR A CONDITIONAL USE PERMIT TO ALLOW A 125,186 SQ. FT. CLIMATE CONTROLLED INTERIOR ACCESS SELF- STORAGE FACILITY WITH ASSOCIATED SITE IMPROVEMENTS TO BE KNOWN AS U-HAUL OF PORT ST. LUCIE, WITHIN THE CG (COMMERCIAL GENERAL) ZONING DISTRICT FOR A PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Amerco Real Estate Company, and representative, Victoria Feola, Project Engineer, of Bowman Consulting, presented a petition for a Conditional Use Permit to allow for a 125,186 sq. ft. climate controlled interior access self-storage facility with associated site improvements, owned and operated by U-Haul of Port St. Lucie, within the CG (Commercial, General) Zoning District for the property located at 6820 US Hwy 1, Port St. Lucie, as legally described in Paragraph "B" and depicted on the attached map as Exhibit «A„ 2. On January 18, 2024, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition after publishing notice in the St. Lucie News Tribune at least 10 days prior to the hearing, installing a sign on the property and notifying by mail all owners of property within five hundred (500) feet of the subject property, and recommended that the Board of County Commissioners approve the Conditional Use Permit request, with the following conditions in addition to Staff's recommendations: a. The hours of operation for the business will be put in writing prior to site plan approval. b. No semi-truck loading and/or unloading on Sundays. 3. On March 5, 2024, the Board of County Commissioners held a public hearing on the petition and unanimously voted to continue the item to the May 7, 2024, Board of County Commissioners meeting, after publishing notice in the St. Lucie News Tribune at least 10 days prior to the hearing, installing a sign on the property and notifying by mail all owners of property within 500 feet of the subject property, at which all interested persons were given an opportunity to be heard. 4. On May 7, 2024, the Board of County Commissioners continued the public hearing on the petition. The proposed Conditional Use will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. The proposed Conditional Use will be serviced by adequate public facilities and services. 7. A Certificate of Capacity,dated July 2, 2024, and signed by the Planning and Development Services Director, attached herein as Exhibit B, is valid for the term of the Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for U-Haul of Port St. Lucie, a climate controlled interior access self-storage facility as depicted in the Conditional Use Plan prepared by Bowman Consulting dated October 2022, and revised through December 6, 2023, at 6820 US Hwy 1, Port St. Lucie, in the CG (Commercial, General) Zoning District is hereby approved for the property described in Paragraph B below, subject to the conditions outlined below: 1. Prior to Final Site Plan Approval, the Architectural Elevations are amended to align with LDC Sec. 7.10.24. - Community Architectural Standards, demonstrating vertical and horizontal facade articulation, design element compliance, and foundational plantings in all required locations. 2. Prior to Final Site Plan Approval, relocate the three (3) loading zones (dock) to the south or east side of Proposed Building "B", allowing an unobstructed view of the building from US Hwy. 1. Alternatively, more densely planted landscaping and/or a fence or stem wall, to further buffer views of the loading area from northbound travelers, shall be required. 3. The hours of operation for the business are listed below. No semi-truck loading and/or unloading may occur on Sundays. The approvals and authorizations granted by this Resolution are for the purpose of obtaining a Major Site Plan, Building Permit or Zoning Compliance from St. Lucie County, and are not assigned to any other party or institution. Should the petitioners choose or decide to assign this business to another entity or individual, a minor adjustment to the Conditional Use Permit shall be required. D. Pursuant to Section 11.07.05(I) of the St. Lucie County Land Development Code, approvals and authorizations granted by this Resolution shall expire after twelve (12) months from the date of approval, unless a Building Permit or Certificate of Zoning Compliance is obtained for the uses described in Paragraph "A" above, or an extension has been granted in accordance with Section 11.07.05(F). E. The petitioner is advised as part of this Conditional Use Permit approval, the petitioner shall obtain all applicable site plan approval, development permits and construction authorizations from the appropriate state and federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works and Building Resolution No. 2024-39 Page 3 File No. CU-2210-000042 Departments prior to the commencement of any development activities on the property described in Paragraph B. Issuance of this permit by the County does not in any way create any rights on the part of the petitioner to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the petitioner fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. F. The conditions set forth in Paragraph A are an integral non severable part of the Conditional Use Permit approval granted by this Resolution. If any condition set forth in Paragraph A is determined to be invalid or unenforceable for any reason and the Petitioner declines to comply voluntarily with the condition, the Conditional Use Permit approval granted by this resolution becomes null and void. G. The St. Lucie County Planning and Development Services Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. H. A copy of this Resolution shall be mailed to the owner and agent of record as identified on the application. A copy shall be attached to the Conditional Use Permit Site Plan drawings as described in Paragraph A and placed on file with the Planning and Development Services Department. This Resolution shall be recorded in the Public Records.
