LUCIE COUNTY FOR A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO NEW DEVELOPMENTS, FOR A PROJECT KNOWN AS 8990 CARLTON ROAD (AKA HODGE ACRES). WHEREAS, the Board of County Commissioners of St. Lucie County. Florida. based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Tod Mowery, AICP, of Redtail DG. Inc., on behalf of Stephenson Hodge, submitted a waiver request for the paving and fair share contribution requirements for Carlton Road, for a project located east of Carlton Road, approximately 2 miles north of Glades Cut Off Road at 8990 Carlton Road, Port St. Lucie, FL. 2 The applicant desires to subdivide a 20-acre parcel to a five (5) acre flag lot (the petition site) and a 15-acre lot (the remainder tract). via an after-the-fact Minor Site Plan. The proposed site plan has been reviewed and deemed appropriate for continued processing towards the after-the-fact subdivision. 3. Staff has performed a detailed analysis of the project and determined it to not be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Public Works Memorandum titled `Paving Waiver Request— 8990 Carlton Road (AKA Hodge Acres),"dated June 24, 2024. 4. On December 20, 2023, the Board of Adjustment approved BOA Resolution No. 2023-011 to allow the flagstaff depth of a proposed flag lot to exceed five (5) times the required minimum road frontage. 5. On July 2, 2024, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject properly. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County. Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners approved the requested Paving Waiver and elected to waive the fair share contribution based on the minimum traffic impacts generated by the proposed development, subject to the following condition: 1. The developer shall include language on the final plat stating that the owners, heirs and assigns of the lots indicated on the proposed plat known as 8990 Car/ton Road (AKA Hodge Acres) agree to participate and shall be a "yes" vote in any lawfully Page 1 Resolution No. 2024-125 File No. MNSP-2310-000086 established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Carlton Road, where abutting either. B. The property for which this paving waiver is approved is described as follows: LEGAL DESCRIPTION PARCEL 1: THE NORTH 342.29 FEET OF THE SOUTH 3083.68 FEET OF THE WEST ONE-HALF OF SECTION 34, TOWNSHIP 36 SOUTH, RANGE 38 EAST; LESS THE WEST 100 FEET, SAID LAND LYING AND BEING IN ST. LUCIE COUNTY, FLORIDA. (TOTAL AREA = 20.060 ACRES) ADDRESS: 8990 Carlton Road, Port St. Lucie, FL 34987 PARCEL I.D. NO(s).: 3234-231-0005-000-3 (Subject Parcel 5 acre), 3234-231-0004-000- 6 (15 acre the remainder tract). C. A copy of this Order shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the paving waiver application. D. This Resolution shall be recorded in the Public Records.
