AN ORDER GRANTING APPROVAL TO ALLOW PAVILION IN THE
COMMON AREA OF PONY PINES POA AS AN APPROPRIATE USE
WITHIN THE IX, (INDUSTRIAL EXTRACTION) ZONING DISTRICT.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request to allow a pavilion to be built in the common area of Pony Pines POA as an appropriate
use in the IX, Industrial Extraction zoning district and made the following determinations:
1. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida,
adopted the St. Lucie County Land Development Code and has adopted amendmei
the Land Development Code through certain ordinances.
2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Fli
adopted Ordinance 12-003 granting the Planning and Development Services Direct(
authority to make the determination after full analysis of all potential impacts ti 8

4. The proposed amendment will not have an undue adverse effect on adjacent proper' W 3 26 5
character of the neighborhood, traffic conditions, parking, utility facilities, or other m Z:al °
affecting the public health, safety, and general welfare within the IX (Industrial Extr2 M t 11°

zoning district.
NOW, THEREFORE, BE IT ORDERED: BY THE PLANNING AND DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY, FLORIDA:
Based on the foregoing analysis, the construction of the pavilion has been determined to be
consistent with similar permitted uses in the IX (Industrial Extraction) zoning district, and, as such,
is determined to be an appropriate use in this zoning district, subject to the following conditions:
1. Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation
Removal Permit or Exemption shall be issued by the Environmental Resources Department
per LDC 6.00.03.
2. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall
be eradicated from the site.

3. The hours of use shall be limited to Monday — Sunday, not to be used between the hours
of 10:00 pm — 6:00 am, except as select holiday activities allow when permitted by the
POA.
PART A. SEVERABILITY
If this Order or any provision thereof shall be held to be inapplicable to any person, property, or
circumstances, such holding shall not affect its applicability to any other person, property or
circumstances.
PART B. APPLICABILITY OF ORDER
This Order shall only constitute approval of the pavilion as an appropriate use and be applicable
in the IX (Industrial Extraction) zoning district for the property located at 11981 Palomino Dr. (PIN
3309-605-0046-000-8) with the above listed conditions.
PART C. FILING WITH THE CLERK OF COURT
A. This Order shall be recordedco in the Public Records of St. Lucie County.
