LUCIE COUNTY FOR A MAJOR SITE PLAN TO DEVELOP A FIVE (5) STORY SELF-STORAGE . BUILDING WITH OFFICE SPACE TOTALING 100,000 SQUARE FEET, A SINGLE-STORY 16,000 SQ. FT. MINI-WAREHOUSE, AND 17,640 SQ. FT. OF CANOPY-COVERED PARKING FOR RVS AND BOATS FOR PROPERTY LOCATED ON LOTS 7, 8, & 9 OF THE ST. LUCIE BUSINESS PARK SUBDIVISION WITHIN THE PLANNED NON-RESIDENTIAL DEVELOPMENT (PNRD) ZONING DISTRICT, IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to findings in the staff report and traffic analysis review, has made the following determinations: 1. 789 PSL Holdings, LLC presented a petition for a Major Site Plan to allow for the development of a five (5) story self-storage building with office space totaling 100,000 square feet, a single-story 16,000 sq. ft. mini-warehouse, and 17,640 sq. ft. of canopy- covered parking for RVs and boats, for an overall total of 133,640 sq. ft. The property is located south of Business Park Drive on Lots #7,8,9 of the St. Lucie Business Park, as legally described in Paragraph "B" and depicted on the attached map as Exhibit "A". 2. On April 2, 2024, the Board of County Commissioners approved the request to waive the Transportation Impact Report for the proposed A-Z Storage Facility. 3. On August 6, 2024, this Board held a public meeting on this petition. 4. The Development Review Committee has reviewed the site plan petition for the project and found it meets the technical requirements of the St. Lucie County Land • Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 5. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services Department memorandum titled A-Z Storage Facility Major Site Plan (MNSP-2308-000082), dated July 26, 2024. 6. All reasonable steps have been taken to minimize any adverse effect on the immediate vicinity through site design and landscaping screening. 7. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Site Plan is hereby approved as shown on the drawing prepared by Culpepper & Terpening, Inc., dated August 10, 2023, date revised on July 29, 2024, for the property described in Part "B" below, subject to the following conditions: 1) Prior to issuance of a development permit, the applicant and/or property owners shall file a Property Combination Application with the St. Lucie County Property Appraiser Office, and complete the combination of the project's parcels (Parcel ID#s 3426-702- 0008-000-8, 3426-702-0009-000-5, 3426-702-0010-000-5). 2) Within 90 days of development approval, the applicant, property owner, developer, successors, or assigns, shall submit the documents required for a Fee-in-Lieu of sidewalk on Business Park Drive. If the application is not approved by the Board of County Commissioners, the sidewalks will be required to be constructed after approval of the Site Development Permit and prior to Permit certification. 3) Prior to associated building permit issuance, the building/ and or architectural elevations shall depict covered canopies over the entrances and exits of the building. 4) Prior to associated building permit issuance, the wall signs or ground sign shall require review and approval by the Planning Division for compliance with the LDC Section 7.10.24.G Signs and Lighting Standards. 5) Prior to associated building permit issuance, the foundational plantings shall depict palms along the eastern and southern of the building. 6) Prior to associated building permit issuance, a photometric plan is required with review by the Planning & Development Services Department. 7) The photometric programming shall include a dimmable light system to reduce foot candles between 40-60 percent between the hours of 10:00 pm —6:00 am. 8) If central water and wastewater services are made available through Port St. Lucie Utilities (PSLU), a connection to utility services shall be made within 365 days, or less is otherwise provided by Florida Statute. 9) The developers, their successors or assigns, shall be required to have a traffic signal warrant study conducted at the intersection of Business Park Drive and South US-1 prior to the issuance of a development permit. If a signal is warranted by that study, the developers, their successors or assigns, shall design and install the traffic signal in coordination with FDOT. The Site Development Permit application can be found on the County's website under the Public Works Department link. In accordance with the permit and Land Development Regulations, the applicant shall retain the Engineer Of Record for site inspections and final certification. 11) Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., listed species surveys (e.g., gopher tortoise, crested caracara, etc.) shall be provided/updated as required per state and/or federal survey protocol. Should any listed species be found as a result of these updated surveys appropriate permits from state and federal agencies shall be required. 12)Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 13) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. B. The property on which this Major Site Plan is being granted is described as follows: Legal Description: LOTS 7, 8, AND 9 OF THE ST. LUCIE BUSINESS PARK, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 28, PAGE 9, AND 9A, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Location: Lots #7,8,9 of the St. Lucie Business Park subdivision, south of Business Park Drive. Parcel Identification No(s).: 3426-702-0008-000-8, 3426-702-0009-000-5, 3426-702-0010-000-5 C. This Major Site Plan shall expire within twenty-four (24) months of the effective date of this order unless a building permit is issued for the approved development or an extension is granted in accordance with the provisions of Section 11.02.06. of the St. Lucie County Land Development Code. D. The developer is advised as part of this Major Site Plan approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part Resolution No. 2024-117 File No. MNSP-2308-000082 Page 3 "B". Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part "A" are an integral non-severable part of the Site Plan approval granted by this Resolution. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Resolution shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit "C" and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on August 20, 2024. G. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part "A", which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. H. This Order shall become effective upon the date indicated below. An appeal of the Board of County Commissioners' action may be processed within thirty (30) days in accordance with Section 11.11.02.F, of the St. Lucie County Land Development Code. This Resolution shall be recorded in the Public Records of St. Lucie County.
