AN ORDER OF THE PLANNING & DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY GRANTING APPROVAL FOR A
MAJOR PRW (PLANNED RETAIL WORKPLACE) SITE PLAN KNOWN
AS BEDNER FARMS NORTHWEST.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
application for a Major PRW Site Plan for the Bedner Farms Northwest Neighborhood submitted
on behalf of Bedner Farms, Inc., evaluated the comments of the St. Lucie County Development
Review Committee on the application, and has made the following determinations:
1. Bedner Farms, Inc., represented by Jennifer Morton and Alex Ahrenholz, of JMorton
Planning and Landscape Architecture, submitted a petition for a Major Site Plan for the
Bedner Farms Northwest neighborhood including a Landscape Plan, Traffic Impact Report,
Environmental Impact Report, Conceptual Drainage Plan,Architectural Elevations and Floor
Plans, and School Impact Worksheet. The subject site is in the PRW (Planned
Retail/Workplace) Zoning District, and has the TVC (Towns, Villages and Countryside)
Future Land Use designation. The subject +/- 67.03-acre site is located northwest of the
intersection of Koblegard Road and Spanish Lakes Blvd, as depicted on Exhibit A and
described in Part B.
2. On April 2, 2024, the Board approved Resolution 2024-57, granting a change in zoning from
the AG-1 (Agricultural-1) Zoning District to the PRW (Planned Retail/Workplace) Zoning
District, and the associated Preliminary Development Plan, for the project known as Bedner
Farms.
3. On August 30, 2024, the St. Lucie County Planning & Development Services Director
granted Certificate of Capacity No. 3298, certifying concurrency for the approved project
including public facility capacity to maintain the standards for levels of service, subject to
conditions of approval.
4. The St. Lucie County Development Review Committee has reviewed the Major PRW Site
Plan, as depicted on Exhibit B, and found it to meet all technical requirements and to be
consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan,
subject to the conditions set forth in Part A of this Resolution.
5. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
6. The proposed project will be constructed, arranged, and operated so as not to interfere with
the development and use of neighboring property, in accordance with applicable district
regulations.

St. Lucie County, Florida:
A. Pursuant to Section 11.02.05 (B)(7) of the St. Lucie County Land Development Code, the
proposed Major PRW Site Plan, as depicted on Exhibit B and shown on the site drawings
for the project prepared by JMorton Planning and Landscape Architecture, dated August
28, 2024, and received by the St. Lucie County Planning & Development Services
Department on August 29, 2024, is hereby approved for the property described in Part
B below, subject to the following conditions:
1. A revised Landscape Plan shall be submitted that increases the size of the upland
buffer trees associated with Flow Ways B and C from one-inch (1") caliper to two-and-
a-half inches (2.5") DBH (diameter at breast height) in accordance with LDC
7.09.03.E.2.c.. The Landscape Plan shall also be modified to provide for a crown
measurement of four to five feet (4 to 5 ft.) for the silver buttonwood trees, in
accordance with LDC 7.09.03.E.2.d.
2. A Site Development Permit is required prior to any site improvement activities.
3. In addition to compliance with all requirements of the Land Development Code, the
application for the Site Development Permit shall include the following:
a. Demonstration of application to the South Florida Water Management District for
approval of the project's stormwater management system.
b. Demonstration of application to the Fort Pierce Farms Water Control District for
discharge of stormwater into its system.
c. Submission of a Lighting Plan for each phase of development.
d. In addition to the crosswalks indicated on the Site Plan, marked crosswalks shall
be provided on the northernmost road at Koblegard Road and at the eastern end
of the east-west pedestrian pathway to the lake.
e. Provision of a school bus stop.
4. A Roadway Improvement Agreement and bond are required for the required
improvements to Koblegard Road, including the construction of a roundabout at
Koblegard and Spanish Lakes Blvd., construction of Koblegard Road to a point
parallel to the northern property line of the project which continues the two-lane
section, and construction of a 6-ft. sidewalk from Spanish Lakes Blvd. to the north
property line.
5. No water or wastewater lines may be installed within 25 feet of land area to be
dedicated as right-of-way on Koblegard Road without prior approval of a Right-of-Way
Permit.
6. A Subdivision Improvement Agreement and appropriate financial guarantees will be
required to obtain Plat approval prior to installation and acceptance of all required
improvements.
7. Submission of the proposed street names to the Property Acquisition Division of the

County Attorney's Office for review and reservation with the application for approval
of the Subdivision Plat.
8. Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., updated
listed species surveys shall be provided per state and/federal protocol. Should any
listed species be found as a result of these surveys, appropriate permits from state
and federal agencies shall be required.
9. Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., an
Environmental Resource Permit shall be provided to confirm the limits and
classification of the Other Surface Water (OSW) previously verified by the South
Florida Water Management District's ERP No. 56-01620, issued on July 24, 2015.
Should the classification of the other OSW change from the prior ERP, a new
Category III Wetland Waiver application shall be provided in accordance with
Comprehensive Plan Policy 6.1.14.3.
10. Prior to commencement of development, including, but not limited to; clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., an updated
100% gopher tortoise survey conducted by a state certified gopher tortoise agent will
be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol.
11. Within 90 days of the effective date of this Development Order, the applicant, property
owner, developer, successor or assigns shall convey to St. Lucie County, in a manner
and form acceptable to the County Attorney, twenty-five feet (25 ft.) of right-of-way
along Koblegard Road, as determined by the Public Works Department.
12. Prior to the issuance of a Certificate of Occupancy for any dwelling, all Category I
invasive plants shall be eradicated from the site.
13. Prior to the issuance of a building permit for any dwelling, the Certificate of Capacity
for water and wastewater services shall be confirmed.
B. The property on which this Major PRW Site Plan is being granted is described as follows:

C. The approvals and authorizations granted by this Order shall expire twenty-four(24) months
from the effective date of this approval, unless a building permit is issued, or a site plan
extension is granted in accordance with Section 11.02.06. of the St. Lucie County Land
Development Code.
D. The developer, including any successors in interest, is advised as part of this Major PRW
Site Plan approval that the property owner(s), developer, etc. including any successors in
interest, shall obtain all applicable development permits and construction authorizations
from the appropriate State and Federal and local regulatory agencies including, but not
limited to, the United States Army Corps of Engineers, the Florida Department of
Environmental Protection, Florida Department of Transportation, South Florida Water
Management District, Fort Pierce Farms Water Control District, and the St. Lucie County
Environmental Resources, Public Works (including an exception to a Mining Permit), and
Building Departments prior to the commencement of any development activities on the
property described in Part B. Issuance of this Order by the County does not in any way
create any rights on the part of the developer to obtain a permit from a state or federal
agency and does not create any liability on the part of the County for issuance of this permit
if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state
or federal agency or undertake actions that may result in a violation of state or federal law.
E. The conditions set forth in Part A are an integral non-severable part of the site plan approval
granted by this order. If any condition set forth in Part A is determined to be invalid or
unenforceable for any reason and the developer declines to comply voluntarily with that
condition, the site plan approval granted by this order shall become null and void.
F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B of the Order, was
granted by the Planning & Development Services Department Director on August 30, 2024,
and shall remain valid for the term of the site plan approval.
G. This Order shall become effective upon the date of recording. Should the property owner,
developer, or authorized agent or other party with standing wish to appeal the Order or any
condition described in Part A above, all such appeals must be filed in accordance with LDC
Section 11.11.00. Should an appeal to this Order be filed, no permitting reviews or further
administrative action shall take place on the processing of this development project until
the appeal is resolved.
H. A copy of this Order shall be attached to the site plan drawings described in Part A, which
plan shall be placed on file with the St. Lucie County Planning & Development Services
Department Director.
This Order shall be recorded in the Public Records of St. Lucie County.
