PDS Order 2024-054 File Number: MNSP-2307-000079 AN ORDER OF THE PLANNING & DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY GRANTING APPROVAL FOR A MAJOR ADJUSTMENT TO A MINOR SITE PLAN FOR ARRIGO - CHRYSLER DODGE JEEP RAM (CDJR) (FKA ARRIGO JEEP & MASERATI-ALFA ROMEO) FOR A PROPERTY LOCATED AT 5929 S US HIGHWAY 1, FORT PIERCE, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Major Adjustment to a Minor Site Plan submitted by Spring Engineering, Inc. on behalf of Arrigo-CDJR, and evaluated the comments of the St. Lucie County Development Review Committee on the application and has made the following determinations: 1. Spring Engineering, Inc., on behalf of Arrigo Ft Pierce J RE Management, LLC, submitted a Major Adjustment to a Minor Site Plan known as Arrigo — Chrysler Dodge Jeep Ram (CDJR) (FKA Arrigo Jeep&Maserati-Alfa Romeo). The project seeks to add a new parking lot to support the Arrigo-CDJR dealership operations. The subject property is located within the CG (Commercial, General)Zoning District at 5929 S US Highway 1, Fort Pierce, FL, as legally described in Part "B". 2. On August 9, 2022, the Board of County Commissioners approved Ordinance No. 2022- 025, amending the adopted Comprehensive Plan Future Land Use Map for a 18.73-acre parcel of land located from the RM (Residential, Medium — 9du/ ac), RU (Residential, Urban — 5du/ ac), and COM (Commercial) to the MXD (Mixed-Use Development) Tidewater Mixed-Use Activity Area, with a Commercial Specific Use assigned to the current petition property. 3. On January 10, 2023, the Board of County Commissioners approved the Tidewater Plat, which was subsequently recording in Public Records (Plat Book 115, PG 1), which created the subject 2.25-acre tract to be added to the existing Arrigo—Chrysler Dodge Jeep Ram Site Plan. 4. The St. Lucie County Development Review Committee has reviewed the adjusted Site Plan and found it to meet the technical requirements of the St. Lucie County Land Development Code, St. Lucie County Comprehensive Plan, and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, subject to the conditions set forth in Part "A" of this Order. 5. Planning staff performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services memorandum titled Arrigo — CDJR— Major Adjustment to the Minor Site Plan (MNSP-2307-000079), dated August 27, 2024. The proposed Major Adjustment to the Minor Site Plan will not have an undue adverse effect on adjacent properties, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. 7. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW, THEREFORE, BE IT ORDERED by the St. Lucie County Planning and Development Services Director: A. Pursuant to Section 11.02.07 of the St. Lucie County Land Development Code, the Major Adjustment to the Minor Site Plan to be known as Arrigo-CDJR is hereby approved as shown on the site plan drawings, prepared by Spring Engineering, Inc., dated July 7, 2023, and resubmitted to the Planning Division on June 20, 2024, subject to the following conditions: 1) Within 30 days of approval, the applicant and/or property owners shall file a Property Combination Application with the St. Lucie County Property Appraiser Office to combine the project parcels (Parcel ID#s 3410-703-0019-000-2, 3410-311-0000-000- 3). 2) The cross-access driveway gate that connects Tidewater PUD to Arrigo-CDJR shall remain locked except in the event of an emergency. 3) The photometric programming shall include a dimmable light system to reduce foot candles between 40-60 percent between the hours of 10:00 pm — 6:00 am (non- operational hours) to prevent spillover to the abutting residential community. 4) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, gopher tortoise surveys shall be updated as required per state and/or federal survey protocol. Should any listed species be found as a result of these updated surveys, appropriate permits from state and federal agencies shall be required. 5) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 6) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant species shall be eradicated from the site. 7) A Site Development Permit is required prior to performing site improvement activities. In accordance with the permit and Land Development Regulations, the applicant shall retain the Engineer of Record for site inspections and final certification. The property on which this Major Adjustment to Minor Site Plan is being approved is described as follows: LEGAL DESCRIPTION: Expansion Parcel: TIDEWATER (PB 115-1) TRACT COMMERCIAL (2.536 AC - 110,468 SF) Location: 5929 S US Highway 1, Fort Pierce, FL 34982 Parcel ID Number: 3410-703-0019-000-2 Existing Dealership Parcel (for Site Plan Adjustment): THE NORTHEAST 1/4 OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 10, TOWNSHIP 36 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA, EXCEPTING THEREFROM ALL RIGHTS-OF-WAY FOR DRAINAGE CANALS AND PUBLIC ROADS. Location: 5851 S US Highway 1, Fort Pierce, FL 34982 Parcel ID Number: 3410-311-0000-000-3 C. The approvals granted by this administrative order shall expire twenty-four (24) months from the effective date, unless a Building or Site Development Permit is obtained, or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this site plan approval, all applicable development permits and construction authorizations shall be obtained from the appropriate State and Federal and Local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments, and the St. Lucie County Fire District prior to the commencement of any development activities on the property described in Part "B". Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the site plan drawings identified as Exhibit"A", which plan shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. PDS Order No. 2024-054 Page 3 File No: MNSP-2307-000079 F. The conditions set forth in Part"A" are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan granted by this Order shall become null and void. G. The adjusted Site Plan, attached as Exhibit "A", shall be valid for the same period as this Order. H. The Certificate of Capacity, attached as Exhibit "B", shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. I. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "A" above, all such appeals must be filled in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. J.
