FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, ° o
FLORIDA
WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County,
Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited
to the staff report, has made the following determinations:
A. Dennis and Loretta Chiancone petitioned a variance to allow deviations of certain sections of
the following sections of the St. Lucie County Land Development Code, 7.10.16.- Recreational
Vehicle Parks, as follows:
1. 7.10.16.Q.1.a.1.(a): to permit the front entry stairs for an existing RV to encroach 9.2 feet
into the ten (10) foot minimum front yard setback for an overall setback of 0.8 feet;
2. 7.10.16. H.: to permit a stabilized vehicular (parking) pad less than the ten (10) feet by
twenty (20) feet minimum size requirement, for a vehicular parking pad of approximately
10 feet by 17 feet; and
3. 7.10.16.Q.1.a.1.(c): to permit the rear stairs, and associated landing with dimensions
more than four (4) feet by four (4) feet, to encroach 4.2 feet into the five (5) foot
minimum rear yard setback for an overall setback of 0.8 feet.
After publication of a notice of such hearing, installation of a sign on the property, and
notification by mail to all owners of property within 500 feet of the subject property, this Board
held a public hearing on June 26, 2024.
B. After consideration of the testimony presented during the public hearing, including that of the
petitioner, staff comments, exhibits, and the standards of review for granting variances set out in
Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has
made the following determinations:
The granting of the Front Stair and Parking Pad variance will not impair or injure other
property or improvements in the neighborhood in which the subject property is located
nor is it anticipated to directly harm other properties or other improvements in the area.
The lot is not unique in a sense that, by itself, it would justify a variance; but, the
applicants acquired the property in its current configuration without notice or knowledge
of any setback violations; so, the variances are allowed on an after the fact basis; and,
as conditioned below, the relief allowed for the front entry stairs and parking pad is the
minimum variance necessary to allow reasonable use of the property.

The granting of the Rear Stair variance is not expected to impair or injure other property
or improvements in the neighborhood, nor will the variance impair adequate supply of
light & air to adjacent properties or increase the danger of fire. The Rear Stairs variance
is the minimum variance that will make possible the reasonable use of the existing
structure in its location and in light of the configuration of the rear doorway and is not
contrary to the general spirit and intent of Saint Lucie County's Land Development Code
or the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida that the Petition of Dennis and Loretta Chiancone, requesting variance as detailed in
Part A are hereby approved for the property described in Part C below, as shown on the
boundary survey created by Christopher Henn, LS, PSM, dated September 20, 2023, submitted
to the Planning and Development Services Department, attached herein as Exhibit "A", unless
the objections of the Nettles Island Condo Association to the alternative front stair fixture
relocation to the side of the unit are withdrawn, in which case a variance is granted for that
alternative; and, further provided that the front stairs and landing shall be shortened to the
greatest extent that code allows, so as to minimize the encroachment as much as possible.
C. The petition site is described and located as follows:

D. This Order shall become effective upon the date indicated below. An appeal from the Board
of Adjustment's action may be processed within thirty (30) days following the rendition of the
decision of this order in accordance with Section 10.01.07, of the St. Lucie County Land
Development Code.
E. This Order shall be recorded in the public records of St. Lucie County.
