LUCIE COUNTY GRANTING APPROVAL FOR MINOR ADJUSTMENTS TO THE SEAGROVE PLANNED UNIT DEVELOPMENT (PUD) FINAL SITE PLAN, INCLUDING THE PHASE 1, PHASE 2 AND PHASE 3 SITE PLANS. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Minor Adjustments to the Seagrove PUD and the Seagrove PUD Phase 1, 2 and 3 Site Plans, submitted by Urban Design Studio on behalf of Lennar Homes, LLC, evaluated the comments of the St. Lucie County Development Review Committee on the application and has made the following determinations: 1. Lennar Homes, LLC, represented by Tyler Woolsey, AICP, of Urban Design Studio, obtained approval of a Major Adjustment to the Final PUD Site Plan for Seagrove (FKA Coconut Cove PUD) by Resolution 2022-41, dated March 1, 2022. 2. On April 26, 2024, Lennar Homes, LLC, represented by Tyler Woolsey, AICP, of Urban Design Studio, petitioned for Minor Adjustments to the Final Master Site Plan for the Seagrove PUD and the Seagrove PUD Phase 1 Site Plan, and petitioned for approval of the Seagrove PUD Phase 2 and Phase 3 Site Plans. 3. The subject site is within the Seagrove PUD (Planned Unit Development)Zoning District, as well as the CG (Commercial General) Zoning District and RM-5 (Residential, Multi- family-5du/ac), and is generally located east of Old Dixie Highway and west of the Indian River Lagoon, at the Indian River County line, as depicted on Exhibit A and described in Part B. 4. On July 12, 2005, the Board approved Resolution 05-144, granting a change in zoning from the RM-5 (Residential, Multi-family-5du/ac), RS-2 (Residential, Estate-2 du/ac), and R/C (Recreational/Conservation-1du/ac) Zoning Districts to the PUD (Planned Unit Development) Zoning District, and associated Final Site Plan, for the project known as Coconut Cove PUD. 5. On September 9, 2005, the County Planning & Development Services Director granted Certificate of Capacity No. 2179, certifying concurrency for the approved project including public facility capacity to maintain the standards for levels of service for the project. 6. March 1, 2022, the Board of County Commissioners held a duly noticed public hearing and approved Resolution 2022-041 granting a Major Adjustment to the previously approved Coconut Cove (Seagrove) PUD Final Site Plan to reduce the number of residential dwelling units from 950 (110 single-family units, 200 townhouse units, and 640 mid-rise condominium units) to 655 (349 single-family units and 306 townhouse units), modify the architectural plans and building typologies, adjust internal street circulation, increase community amenities, eliminate a boat/RV storage area, and provide other miscellaneous design adjustments. On February 2, 2023, the Planning and Development Services Director through PDS Order 2023-010, granted approval for a Minor Adjustment to the Coconut Cove (AKA Seagrove) PUD Final Site Plan to update the community's name, address minor changes to the proposed stormwater management system, specify allowances for a previously- approved architectural model, correct a scrivener's error in site data and identify future Commercial Outparcels along US Highway 1 for platting purposes. 8. On February 5, 2024, the Planning and Development Services Director through PDS Order 2024-007 granted Minor Adjustment approval to the Final Site Plan for the Seagrove PUD, Overall Site Plan, and to Seagrove (FKA Coconut Cove) PUD Phase 1 Site Plan to include a Model Row Plan depicting the model homes, landscaping and temporary parking lot on lots 44 through 48, make a revision to the approved architectural elevations, and, incorporate revised Site Plan notes to expressly provide that mirrored floor plan and elevations are permitted. 9. On July 30, 2024, the Planning and Development Services Director through PDS Order 2024-003 granted a statutory extension of the development order and associated authorizations. 10. The proposed Minor Adjustments to the Seagrove PUD Final Master Site Plan and Phase 1-3 Site Plans are not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and have satisfied the requirements of Section 11.02.07 of the St. Lucie County Land Development Code. 11. Planning Staff has performed a detailed analysis of the adjusted Site Plans and determined them to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan, and in Substantial Conformity with the previously approved PUD. The analysis is found in the Planning and Development Services memorandum titled Seagrove PUD- Minor Adjustment to PUD Master Final Site Plan and Phase 1 Final Site Plan, approval of the Phase 2 Site Plan and approval of Phase 3 Site Plan (File No.: PDMN-2309-000018), dated September 9, 2024. 12. The proposed Minor Adjustment to the PUD Master Site Plan and PUD Phase 1 Site Plan will not have undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 13. The proposed Seagrove PUD Phase 2 and 3 Site Plans will not have undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 14. The St. Lucie County Development Review Committee has reviewed the Minor Adjustment to the Seagrove PUD Final Site Plan and the associated Seagrove PUD Phase 1 -3 Final Site Plans as depicted on Exhibit B, and found them to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part A of this Resolution. 15. All reasonable steps have been taken to minimize any adverse effect of the proposed Page 2 PDS Order No. 2024-62 File No.: PDMN-2404-000018 project on the immediate vicinity through building design, site design, landscaping, and screening. 16. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED by the Director of Planning & Development Services of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 (B)(7) of the St. Lucie County Land Development Code, the proposed Minor Adjustments, as depicted on Exhibit "B" and shown on the site drawings for the project prepared by Urban Design Studio dated July 29, 2024, and date stamped received by the St. Lucie County Planning &Development Services Department on August 7, 2024, and the Phase 2 and Phase 3 Site Plans, for the property described in Part B below, are in substantial conformity with the Seagrove PUD and are hereby approved, subject to the following conditions: 1. All Conditions of Approval contained in Res. 2022-041 remain in full force and effect, unless otherwise stated in subsequent approval orders. 2. All Conditions of Approval contained in PDS Order 2023-010 remain in full force and effect, unless otherwise stated in subsequent approval orders. 3. All Conditions of Approval set forth in PDS Order 2024-007, , regarding the Seagrove PUD Master Final Site Plan and the Seagrove PUD Phase 1 Final Site Plan remain in full force and effect, unless otherwise stated in subsequent approval orders. 4. Site Development Permits are required prior to performing site improvement activities for Seagrove PUD Phase 2 and Phase 3. 5. During the review and approval of the Site Development Permit for the Seagrove PUD Phase 3, additional curb ramps shall be provided at two intersections shown on Sheet 3 and Sheet 4 of the approved Site Plans. 6. A Subdivision Improvement Agreement and bonding for the required internal infrastructure are required prior to recording of the corresponding Re-plat or Re-plats. B. The property on which this Minor Adjustment to the Seagrove PUD Master and Phase 1 Final Site Plan, and Phase 2 and Phase 3 Final Site Plans are being granted is described as follows: LEGAL DESCRIPTION: Plat of Seagrove PUD, Plat Book 121, page 14, St. Lucie County Official Records Including specifically these Parcel Identification Numbers: 1405-601-0001-000-8; 1405-601-0002-000-5; 1405-601-0019-000-7; 1405-601-0021-000-4; 1405-601-0022-000-1; 1405-601-0023-000-8; 1405-601-0024-000-5; 1405-601-0298-000-6; 1405-601-0299-000-3; et al. Page 3 PDS Order No. 2024-62 File No.: PDMN-2404-000018 Location: primarily east of Old Dixie Highway and abutting the Indian River Lagoon, near the boundary with Indian River County, with the entrance road east of U.S. Hwy. 1, in St. Lucie County, Florida. C. The approvals and authorizations granted by this Order shall expire twenty-four (24) months from the effective date of this approval, unless a building permit is issued, or a site plan extension is granted in accordance with Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this Minor Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works (including an exception to a Mining Permit), and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part A are an integral non-severable part of the site plan approval granted by this order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. F. This Development Order is exempt from the requirements of Land Development Code, Chapter 5, Adequate Public Facilities, pursuant to LDC Section 5.03.01.F. (An alteration or expansion of development that does not create additional impact on public facilities.) Certificate of Capacity 3177 was signed on March 15, 2022. PDS Order 24-003 dated July 30, 2024, extended Certificate of Capacity 3177 until February 5, 2030. G. This Order shall become effective upon the date of recording. Should the property owner, developer, or authorized agent or other party with standing wish to appeal the Order or any condition described in Part A above, all such appeals must be filed in accordance with LDC Section 11.11.00. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. H. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
