A RESOLUTION ACCEPTING THE FIRST AMENDMENT
TO THE FLORIDA DEPARTMENT OF TRANSPORTATION
LOCALLY FUNDED AGREEMENT (No. 231440-5-A8-01/
231440-5-52-01) FOR THE CONSTRUCTION OF CR-
712/WEST MIDWAY ROAD FROM WEST OF JENKINS
ROAD TO SELVITZ ROAD AND AUTHORIZING THE
CHAIR TO EXECUTE THE AMENDMENT AND FURTHER
AUTHORIZING THE COUNTY ATTORNEY TO EXECUTE
THE AMENDMENT BY APPROVING IT AS TO FORM AND
CORRECTNESS
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida,has made
the following determinations:
1. On November 29, 20222, the Department of Transportation and the County entered into a
Locally Funded Agreement (No. 231440-5-A8-01 / 231440-5-52-01) in which the
Department of Transportation agreed to accept advanced funding from the County to
accelerate the construction of CR-712/West Midway Road from West of Jenkins Road to
Selvitz Road.
2. The project is currently under construction.The cost of construction in the Locally Funded
Agreement was estimated at $28,146,072.00, and the low bid for construction was
$24,504,849.00.The First Amendment to the Locally Funded Agreement will reconcile the
difference between the estimated cost of the project and the low bid for construction of CR-
712/West Midway Road from West of Jenkins Road to Selvitz Road and refund the County
in the amount $3,641,223.00.
3. The Board should authorize and approve execution of the First Amendment to Locally
Funded Agreement (No. 231440-5-A8-01 / 231440-5-52-01) with the Department of
Transportation for the above-referenced project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
St. Lucie County, Florida:
1. The Board hereby accepts and approves the First Amendment to the Locally Funded
Agreement with the Department of Transportation (No. 231440-5-A8-01 / 231440-5-52-
01) to reconcile the difference between the estimated cost of the project and the low bid
for construction of CR-712/West Midway Road from West of Jenkins Road to Selvitz
Road and refund the County in the amount $3,641,223.00.
2. The Board hereby authorizes and Chair to execute the above-referenced amendment and
further authorizes the County Attorney to execute the agreement by approving it as to form
and correctness.
