LUCIE COUNTY, FLORIDA, AMENDING LAND DEVELOPMENT CODE SECTION 3.01.03.GG., PRW (PLANNED RETAIL/WORKPLACE) ZONING DISTRICT; REGARDING STANDARDS FOR SIGNS ADJACENT TO " I-95; PROVIDING FOR APPLICABILITY AND SEVERABILITY; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE;PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR CODIFICATION; AND PROVIDING FOR ADOPTION. WHEREAS, pursuant to Article 8 of the Florida Constitution and Section 125.66, Florida Statutes, St. Lucie County possesses the police powers to enact ordinances to protect the health, safety, and welfare of the County's citizens. WHEREAS, the Board of County Commissioners is authorized by Section 125.01(1)(h), Florida Statutes to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida finds this Ordinance is necessary and essential to protect public safety and represents the minimum necessary regulation to achieve that purpose. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence,including but not limited to the staff report, has made the following determinations: 1. On August 1, 1990, the Board of County Commissioners of St. Lucie. County, Florida adopted the St. Lucie County Land Development Code. 2. On August 15, 2024, the Planning and Zoning Commission held a public hearing on the proposed ordinance, after publication of notice in the St. Lucie News Tribune at least 10 days prior to the hearing and recommended that the proposed ordinance be approved. - 3. On September 4, 2024, this Board held its first public hearing on the proposed ordinance, after publication of notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 4. On September 17, 2024, this Board held its second public hearing on the proposed ordinance, after publication of notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 5. NOW, THEREFORE, BE IT ORDAINED by the St. Lucie County Board of County Commissioners that the St. Lucie County Land Development is amended as set forth in the following amendments, as shown in Gtrikcthrough and underline format in Section 2. SECTION 1. RATIFICATION OF RECITALS. The foregoing recitals are hereby ratified and confirmed as true and correct and are hereby made a part of this Ordinance. SECTION 2. This ordinance specifically amends St. Lucie County Land Development Code, as follows: Words in ctrikethrough type are deletions from existing text. Words in underlined type are additions to existing text. Asterisks (***) indicate existing text not shown. LDC Chapter III — ZONING DISTRICTS LDC Section 3.01.03. —Zoning Districts A. through DD. EE. Purpose. * * * * * * * * * * * * * * * 2. Standards and Requirements n. Signs. Permanent and temporary signs within any Planned Retail/Workplace shall comply with the provisions of Chapter IX of this Code as they apply to the Commercial Neighborhood (CN) zoning district, except that ground signs may not exceed a height of ten (10) feet. Ordinance No. 2024-31 Page 2 For uses with trip generation rates exceeding 10,000 daily diverted trips from I-95, a single Ground Sign of up to 100 feet in height above the crown of the primary frontage road and 640 square feet in area may be permitted adjacent to an I-95 interchange. Such signs are subject to the following additional standards: (1) no horizontal or vertical sign face dimension may exceed 30 feet, (2) the sign faces must be oriented perpendicular to I-95 with the sign profile facing the view from local roads, (3) the sign must be separated from residential areas by a minimum of 500 feet, (4) the sign must be setback at least 25 feet from the right-of-way or property boundary, (5) all sign lighting shall be internally illuminated, and (6) landscaping shall be provided around the sign pole and such landscaping shall include trees and shrubs, the mature height of which shall obscure the sign pole base, with trees no less than 12ft. in height and shrubs no less than 3ft. in height at the time of planting. Where necessary for security, a barrier fence, around the sign base, may be required by the Planning & Development Services Director to deter unauthorized access. In all cases, landscaping must be placed outside the barrier fence. SECTION 3. CONFLICTING PROVISIONS Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts thereof, in conflict with the Ordinance are hereby superseded by this Ordinance to the extent of such conflict. SECTION 4. SEVERABILITY AND APPLICABILITY If any portion of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance or any provisions thereof shall be held to be inapplicable for any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstances. SECTION 5. FILING WITH THE DEPARTMENT OF STATE The Clerk is hereby directed forthwith to send a certified copy of the Ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. EFFECTIVE DATE A certified copy of this ordinance shall be filed with the Department of State by the Clerk of the Board of County Commissioners of St. Lucie County within ten days after enactment by the Board, and this ordinance shall take effect upon filing with the Department of State. SECTION 7. CODIFICATION This Ordinance, upon its effective date, shall be codified by incorporating any contained changes into the St. Lucie County Comprehensive Plan. SECTON 8. ADOPTION.
