LUCIE COUNTY PROVIDING FOR A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO NEW DEVELOPMENTS, FOR A PROJECT KNOWN AS THE MACON SUBDIVISION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Darren Guettler, PE, of Velcon Engineering, on behalf of property owners Sandra & Clyde Crouch, Rodney Hall, and Inlet Girls LLC, submitted a waiver request regarding the requirement found in Land Development Code Section 7.05.07, which requires that new development be accessed by paved roads, for a subdivision along Knight Road, on property described in Part B below. re 0 0 2 The applicant desires to subdivide two parcels into eight (8) lots, each at least 5 acres in LU size. A proposed Minor Site Plan and Plat have been reviewed and deemed appropriate • T for continued processing. • h 0 3. Vehicular access for the subdivision would be from Orange Avenue, via Knight Road, to LL O O o N Schumann Road which serves as frontage for the project. On November 12, 2024, the Board held a public hearing on the petition, after publishing w Z w 00 notice at least 10 days prior to the hearing and notifying by mail all owners of property 2 o u_o a' within 500 feet of the subject property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners approved the requested Paving Waiver and elected to waive the fair share contribution based on the minimum traffic impacts generated by the proposed development, subject to the following condition: 1. The developer shall include language on the final plat stating that the owners, heirs and assigns of the lots indicated on the proposed plat known as Macon Subdivision agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Knight and Schumann Roads, where abutting either. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT CANALS AND ROAD RIGHTS-OF-WAY. TOGETHER WITH PARCEL 2: THE WEST 1/2 OF THE NORTHWEST 1/4 OF SECTION 2, TOWNSHIP 35 SOUTH, RANGE 38 EAST, ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE SOUTH 1487.71 FEET; AND FURTHER LESS AND EXCEPT CANALS AND ROAD RIGHT-OF-WAY. PARCEL ID No.: 2202-221-0001-000-2 &2202-223-0001-000-8 C. A copy of this Resolution shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the paving waiver application. D. This Resolution shall be recorded in the Public Records.
