A RESOLUTION APPROVING A VARIANCE TO ALLOW A SINGLE-FAMILY HOME
ON AN APPROXIMATELY 9,375 SQ. FT. LOT THAT DOES NOT MEET THE
MINIMUM 10,000 SQ. FT. LAND AREA REQUIREMENT FOR LOTS SERVED BY A
WELL, FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County,
Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited
to the staff report, has made the following determinations:
1. Vlad Bradescu petitioned for a variance from Section 7.04.01 (Table 7-10) - Lot Size and
Dimensional Requirements of the St. Lucie County Land Development Code for a single-
family lot that does not meet the minimum 10,000 sq. ft. land area requirement for lots
served by a well. The lot is approximately 9,375 sq. ft. and does not have central water
immediately available. The subject property is in the RS-4 (Residential, Single-Family -
4) Zoning District.
2. On October 23, 2024, this Board held a public hearing on the petition, after publishing a
notice of such hearing, installing a sign on the property, and notifying by mail all owners
of property within 500 feet of the subject property.
3. After consideration of the testimony presented during the public hearing, including that of
the petitioner, staff comments, exhibits, and the standards of review for granting
variances set out in Section 10.01.02, St. Lucie County Land Development Code, the
Board of Adjustment has made the following acknowledgements and determinations:
The applicant testified that he had no knowledge of the lot area deficiency prior to
purchasing the property. In fact, he had bought and built on a lot the same size in the
same neighborhood. Since becoming aware of the issue, he considered alternatives to
the variance and contacted the abutting property owner to explore acquisition to restore
the prior Lot of Record.
The variance request arises from unique land conditions that create a hardship for the
current owner due to contiguous ownership with the parcel to the east, resulting in a
nonconforming lot of record, per County records dated July 1, 1984, with ownership
separation dating back to 1990.
The Board of Adjustment notes that the cost of extending County water to the site and
connecting it would meet or exceed the cost of the lot itself.
The Board of Adjustment has the power to authorize variances from the dimensional(Lot
Size and Dimensional Requirements - Table 7-10), floodplain, and airport height
requirements per the LDC Section 12.04.01.

The variance is the minimum necessary to make reasonable use of the property, by
allowing a single-family home to proceed, within the RS-4, Single-family-4 Zoning
District.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida:
A. The petition of Vlad Bradescu, requesting a variance from Section 7.04.01 (Table 7-10)
— Lot Size and Dimensional Requirements of the St. Lucie County Land Development
Code to allow for a single-family home on a 9,375 sq. ft. lot that does not meet the
minimum 10,000 sq. ft. land area requirement for lots served by a well for the property
depicted on the boundary survey created by Know it Now Surveyors, dated February 2,
2024, and included as Exhibit "A" and described in Part "B" below, is hereby approved
subject to the following conditions:
1. The single-family home shall connect to central water services when made available
through the St. Lucie County Utilities Department.
2. The current and future owners and their heirs/assigns agree to participate and shall
be a "yes" vote in any proposed MSTU, MSBU or other special assessment district
created for the purpose of establishing central water services to San Carlos Drive.
B. The petition site is described and located as follows:
Legal: ALL OF LOT 9, BLOCK 167, LAKEWOOD PARK - UNIT 12A, AS PER PLAT
THEREOF, AS RECORDED IN PLAT BOOK 11, PAGES 37 THROUGH 39, OF
THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

C. This Order shall become effective upon the date indicated below. An appeal from the
Board of Adjustment's action may be processed within thirty (30) days following the
rendition of the decision of this order in accordance with Section 10.01.07, of the St.
Lucie County Land Development Code.
D. This Order shall be recorded in the public records of St. Lucie County.
