HomeMy WebLinkAbout24-047 PDS 2024-047 MNSP-2305-0001 09 AN ORDER GRANTING APPROVAL FOR A MINOR SITE PLAN KNOWN AS INDRIO STORAGE FOR A PARCEL OWNED BY INDRIO US1, LLC, LOCATED AT 4875 NORTH US HIGHWAY 1. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Site Plan submitted by McCarty a n d Associates, acting as an agent for the owner, lndrio US1, LLC, and has reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Following Conditional Use Permit approval for two Housing Storage Warehouses, Indrio US1, LLC has proposed a Minor Site Plan to be known as Indrio Storage. The Applicant proposes to develop a household goods storage facility totaling 66,275 sq. ft. and associated improvements. The property is zoned CG (Commercial, General) and is described in Section "B" below. 2. The Development Review Committee has reviewed the site plan and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 5. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan known as Indrio Storage, is hereby approved as shown on the Site Plan, prepared by McCarty and Associates and dated 11/8/2023, attached as Exhibit A; Landscape Plan, prepared by McCarty and Associates and dated 12/11/2023, attached as Exhibit B; Architectural Elevations, prepared by Brent A. Wood and dated 11/3/2023, attached as Exhibit C; and the certificate of capacity, attached MICHELLE R.MILLER,CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY Page 1 OR B00K5246 pAGE2 3507:0 47AMDoc Type: File No.: MNSP 2305-000109 RECORDING: $69.50 PDS 2024-047 as Exhibit D. The approval is subject to the following conditions: 1. Provide complete opacity from US 1 on the north and east side of the dumpsters using landscaping and/or fences and include an opaque swing gate on the front/west side of dumpsters. 2. Prior to Minor Site Plan approval, identify the lndrio Savannahs Preserve to the west on the site plan in accordance with Comprehensive Plan Policy 6.1.11.4. 3. Prior to Minor Site Plan approval, label the stormwater area as 'dry' on the site plan and landscape plan. 4. Prior to Minor Site Plan approval, depict and label the location of the fence cutout (specify at one (1) ft. off bottom) for the proposed gopher tortoise pass located between the subject site and the preserve to the west on the site plan and enhanced landscape buffer document. 5. Prior to Minor Site Plan approval, increase the enhanced landscape buffer tree heights from 10' to 12' and specify a 2.5" DBH minimum within both the landscape plan and the enhanced landscape buffer document. 6. Provide signage typical and locations for the scrub restoration area to prevent the mowing of the proposed understory. B. The approvals granted by this administrative order shall expire along with the companion Conditional Use Permit after February 6, 2025, unless a Building Permit is obtained, or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The conditions set forth in Section A are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. E. The developer is advised as part of this site plan approval that any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, the St. Lucie County Fire District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Section B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. F. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. G. A copy of this Order shall be attached to the site plan drawings, described in Section A and attached as Exhibit A, which plan shall be placed on file with the St. Lucie Planning and Development Services Department along with support documents including but Page 3 File No.: MNSP 2305-000109 PDS 2024-047 not limited to the associated landscape plans, and copies provided to the developer and agent of record as identified on the site plan applications. H. The Certificate of Capacity, attached as Exhibit D, shall be valid for the same period as this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. I. This Order shall be recorded in the Public Records of St. Lucie County.
