LUCIE COUNTY GRANTING A MAJOR SITE PLAN APPROVAL FOR A PROJECT TO BE KNOWN AS R+L CARRIERS TRUCK TERMINAL, WITHIN THE IL (INDUSTRIAL, LIGHT) AND IH (INDUSTRIAL, HEAVY) ZONING DISTRICTS ON A +/-30.08 ACRE PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to findings in the staff report and traffic analysis review, has made the following determinations: 1. Ramar Land Corporation, represented by Kimley Horn, presented a petition for a Major Site Plan to be known as R+L Carriers Truck Terminal to allow for the development of a an approximate 129,500 sq. ft. truck terminal facility, in multiple phases, including a 76,600 sq. ft. truck terminal building, an eight (8) bay maintenance building totaling 18,180 sq. ft., a 2,176-fuel canopy, and a truck wash building in Phase 1 and a 32,500 sq. ft. expansion to the truck terminal building in Phase 2. The property is located west of Glades Cut Off Road and east of 1-95 on the north side of Midway Road, as legally described in Paragraph "B" and depicted on the attached map as Exhibit "A". 2. On June 25, 2024, the Planning & Development Services grated approval PDS Order No. 2024-048 for a Minor Adjustment to a Major Site Plan on behalf of Tropicana Manufacturing Co., to subdivide the two (2) parcel site totaling 310.62 acres into three (3) parcels; Parcel 2 totaling 30.08 acres (subject property), Parcel 3 totaling 90.55 acres, and the remaining Parcel 1 consisting of 189.99 acres. 3. On July 2, 2024, the Board of County Commissioners granted approval of the Tropicana Midway Plat, recorded in Plat Book 125, Page 1. 4. On October 15, 2024, this Board held a public meeting on this petition. 5. The Development Review Committee has reviewed the site plan petition for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 6. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis • is found in the Planning and Development Services Department memorandum titled R+L Carriers Truck Terminal Major Site Plan (MNSP-2406-000122), dated September 30, 2024. All reasonable steps have been taken to minimize any adverse effect on the immediate vicinity through site design and landscaping screening. 8. The proposed Major Site Plan, with conditions, therein, will not have undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public safety, and general welfare 9. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Site Plan is hereby approved as shown on the drawing prepared by Kimley Horn, Inc., dated September 4, 2024, with a comment response date of October 2, 2024, for the property described in Part "B" below, subject to the following conditions: 1) Prior to recording the Major Site Plan Resolution, the Landscape Plan shall be revised and determined compliant with LDC Sections 7.09.04.A/B (entry drive), 7.09.04.C.4. and 7.09.04.C.1. (Completed 1211212024) 2) Prior to issuance of a Certificate of Capacity for this Major Site Plan and recording the associated Resolution, the project's Traffic Impact Report shall be certified by the St. Lucie County Public Works Director & St. Lucie County's Third -Party Traffic Consultant, including any off -site mitigation required by ordinance and permissible by law. (Completed 12/312024) 3) Prior to building permit issuance, a photometric plan consistent with the Land Development Code shall be filed and reviewed for compliance by the Planning & Development Services Department. 4) A Site Development Permit is required prior to performing site improvement activities. The Site Development Permit application can be found on the County's website under the Public Works Department link. In accordance with the permit and Land Development Regulations, the applicant shall retain the Engineer of Record for site inspections and final certification. 5) Prior to issuance of a Site Development or Building Permit, the design plans shall demonstrate compliance with the Florida Department of Transportation (FDOT), and Florida Accessibility, standard specifications for all ADA parking. 6) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., listed species surveys shall be provided/updated as required per state and/or federal survey protocol. Should any listed species be found as a result of these updated surveys appropriate permits from state and federal agencies shall be Resolution No. 2024-213 File No. MNSP-2406-000122 Page 2 required. 7) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., all necessary permitting and documentation pertaining to the crested caracara nest onsite shall be provided. 8) Prior to commencement of development, including but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a vegetation removal permit or exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 9) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Wetland Waiver Application shall be submitted for review and approval by the ERD Director for impacts to the Category III wetland. 10) Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a formal wetland jurisdictional determination or Environmental Resource Permit (ERP) shall be provided from the appropriate state and/or federal agencies, consistent with LDC 11.02.09.A.5 and Chapter 6 of CP Policy 6.1.12.4. 11) Prior to commencement of development, including but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the applicant shall provide details pertaining to mitigation requirements for impacts to the onsite wetlands as well as mitigation requirements for any impacts to Other Surface Waters (OSWs). 12) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., their successor or assigns, shall conduct a pre -construction meeting with construction personnel and Environmental Resources Department staff to verify vegetation and preserve area protection measures have been installed. 13) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. This Major Site Plan shall expire within twenty-four (24) months of the effective date of this order unless a building permit is issued for the approved development or an extension is granted in accordance with the provisions of Section 11.02.06. of the St. Lucie County Land Development Code. C The developer is advised as part of this Major Site Plan approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part "B". Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part "A" are an integral non -severable part of the Site Plan approval granted by this Resolution. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Resolution shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit "C" and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on December 13, 2024. G. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part "A", which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. H. This Order shall become effective upon the date indicated below. An appeal of the Board of County Commissioners' action may be processed within thirty (30) days in accordance with Section 11 11.02.F of the St. Lucie County Land Development Code.
