HomeMy WebLinkAbout25-004 ORDINANCE NO. 25-004 AN ORDINANCE REPEALING ORDINANCE NO. 89-39 WHICH REQUIRED THE FLUORIDATION OF ALL WATER SYSTEMS WITHIN ST. LUCIE COUNTY WITH A DESIGN CAPACITY OF ONE MILLION GALLONS OR MORE; PROVIDING FOR CONFLICTING PROVISIONS; BY PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING FOR ADMINISTRATIVE CORRECTION OF SCRIVENER'S ERRORS; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR ADOPTION AND PROVIDING FOR CODIFICATION WHEREAS,the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On September 12, 1989, the Board of County Commissioners of St. Lucie County, Florida adopted Ordinance No. 89-39, requiring the fluoridation of all water systems within St. Lucie County with a design capacity of one million gallons or more. 2. On November 22, 2024, Florida State Surgeon General Dr. Joseph A. Ladapo announced guidance recommending against community water fluoridation due to the neuropsychiatric risk associated with fluoride exposure. 3. Section 125.01 (k)1., Florida Statutes, authorizes the Board of County Commissioners to provide and regulate water supply programs. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: PART A. REPEAL OF ORDINANCE NO. 89-39 Part 1. Ordinance No. 89-39, adopted on September 12, 1989, is hereby repealed. Part 2. CONFLICTING PROVISIONS Special acts of the Florida legislature applicable only to unincorporated areas of St. Lucie County, County ordinances and County resolutions, or parts thereof, in conflict with this ordinance are hereby superseded by this ordinance to the extent of such conflict. PART C. SEVERABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property, or circumstance, such holding shall not affect its applicability to any other person, property, or circumstance. PART D. APPLICABILITY OF ORDINANCE. This ordinance shall be applicable throughout St. Lucie County's jurisdiction. PART E. ADMINISTRATIVE CORRECTION OF SCRIVENER'S ERRORS. The administrative correction of typographical and/or scrivener's errors in this ordinance which do not affect the intent may be authorized by the County Attorney or designee, without need of public hearing, by filing a corrected or recodified copy of the same with the Clerk of Courts. PART F. FILING WITH THE DEPARTMENT OF STATE. The Clerk is hereby directed forthwith to send a certified copy of this ordinance to the Bureau of Administrative Code and Laws, Department of State, the Capital, Tallahassee, Florida 32304. PART G. EFFECTIVE DATE. This ordinance shall take effect upon filing with the Department of State. PART H. ADOPTION. CODIFICATION. Provisions of this ordinance shall be incorporated in the Code of Ordinance of St. Lucie County, Florida, and the word ordinance may be changed to section, article, or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that parts C through I shall not be codified.
