LUCIE COUNTY FOR A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO A NEW DEVELOPMENT PROPOSED ON TAYLOR DAIRY ROAD. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Lucido & Associates and CDM Smith, on behalf of property owner, St. Lucie County, submitted a waiver request regarding the requirement found in Land Development Code Section 7.05.07, which requires that new development be accessed by paved roads, for a Water Treatment Facility on Taylor Dairy Road to be known as the North County Water Treatment Facility, on property described in Part B below. 2 A concurrent Site Plan application for the County's Taylor Dairy Road Water Treatment Facility is under review by the Development Review Committee, encompassing a +/- 38 ac. site on the east side of Taylor Dairy Road, approximately 1,300 feet south of Indrio Road., within the Utilities (U) Zoning District in unincorporated St. Lucie County, FL. The development is stated to be a small-scale traffic generator. 3. Vehicular access to the development is provided by the Taylor Dairy Road right-of-way, from Indrio Road, via an unpaved accessway. 4. Staff has performed an analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. 5. On January 7, 2025, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners approves the requested Paving Waiver subject to the following conditions.- 1. Within 120 days of approval, the $307,134.29 proportionate fair share contribution shall be earmarked to be used toward milling the portion of Taylor Dairy Road to the entrance of the utility site or to be used toward paving a portion of Taylor Dairy Road in partnership of the Indrio Woods PUD and the potential St. Lucie County Fire Station. 2. The property owner shall include language on the final site plan stating that the Page 1 Resolution No. 2025-11 File No. WDA-2406-000026 owners, heirs and assigns agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Taylor Dairy Road, where abutting. B. The property for which this paving waiver is approved is described as follows: LEGAL DESCRIPTION The Southwest 1/4 of the Southeast 1/4 of Section 13, Township 34 South, Range 39 East, LESS AND EXCEPT all rights of way for drainage canals and public roads; all lying and being in St. Lucie County, Florida. PARCEL ID No.: 1313-430-0000-000-5 C. A copy of this Resolution shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the property owner and agent of record as identified on the paving waiver application. D. This Resolution shall be recorded in the Public Records.
