LUCIE COUNTY FOR A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO A NEW DEVELOPMENT PROPOSED ON PEACOCK ROAD. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Kimley-Horn, on behalf of property owner, St. Lucie County, submitted a waiver request regarding the requirement found in Land Development Code Section 7.05.07, which requires that new development be accessed by paved roads, for a Water Treatment Facility on Peacock Road to be known as the Central County Utility Plant, on property described in Part B below. 2 A concurrent Site Plan application for the County's Central County Water Treatment Facility is under review by the Development Review Committee, encompassing a +/- 35 ac. site on the east side of Peacock Road, approximately 2 miles south of Okeechobee Road, within the Utilities (U) Zoning District in unincorporated St. Lucie County, FL. The development is stated to be a small-scale traffic generator. 3. Vehicular access to the development is provided by the Peacock Road right-of-way, from Okeechobee Road, via an unpaved accessway. 4. Staff has performed an analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. 5. On January 7, 2025, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 7.05.07 of the St. Lucie County Land Development Code, the Board of County Commissioners approves the requested Paving Waiver and elects to waive the fair share contribution based on the minimum traffic impacts generated by the proposed development, subject to the following condition: 1. The property owner shall include language on the site plan stating that the owners, heirs and assigns agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to Peacock Road. B. The property for which this paving waiver is approved is described as follows: Page 1 Resolution No.2025-12 File No. WDA-2412-000035 LEGAL DESCRIPTION The south 1235.00 feet of the west 1235.00 feet of the following parcel: Northeast 1/4 section 13, township 36 south, range 38 east, less the east 35 feet and less the west 65 feet and less the south 42.5 feet, lying and being in St. Lucie County Florida. SAID LAND CONTAINING 35± ACRES, MORE OR LESS PARCEL ID No.: 3213-111-0002-000-8 C. A copy of this Resolution shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the property owner and agent of record as identified on the paving waiver application. D. This Resolution shall be recorded in the Public Records.
