LUCIE COUNTY, FLORIDA. WHEREAS. the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Major Site Plan for the project known as 2470 Harbour Cove Dr, (AKA Coral Cove) and the comments of the Development Review Committee, and has made the following determinations: 1. The applicant, Patricia Sesta. of Haley Ward, Inc., on behalf of the homeowners, presented a petition for a Minor Adjustment to a Major Site Plan known as 2470 Harbour Cove Dr, (AKA Coral Cove) for the extension of a dock addition. boat slip and handrail. The proposed slip would extend the existing dock by 27.1 feet to allow recreational use by the homeowners at 2470 Harbour Cove Drive. The site is by the Harbour Cove Property Owners Association and has a Future Land Use designation of Residential Medium (RM), on +/-0.04-acres. located in the Hutchinson Island Residential District. The application also documents prior dock modifications not appropriately tracked throughout site plan adjustments. 2. On January 17, 2023, the Florida Department of Environmental Protection (FDEP) issued Permit No.: (FDEP, 56-02065593-002-El). Expiration 01/17/2028. 3. On May 11, 2023, the Army Corps of Engineers (ACOE), issued Permit No.: (ACOE, SAJ-2022-03578). Expiration 5/11/2028. 4. On August 25, 2024, the President of Harbour Cove Property Owners Association granted approval to obtain a Minor Adjustment to a Major Site Plan to document the location of the proposed dock extension in relation to the existing community dock at Harbour Cove. 5. The Development Review Committee reviewed the proposed site plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 6. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is in the Planning and Development Services Department memorandum titled 2470 Harbour Cove Drive (AKA Coral Cove) - Minor Adjustment to Major Site Plan (MJSP-2406-000027), dated February 18, 2025. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking. utility facilities. or other matters affecting public health. safety, and general welfare. 8. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design. site design. landscaping, and screening. 9. The proposed project will be constructed, arranged, and operated so as to not interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. The property on which the Minor Adjustment to the Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION CORAL COVE BEACH-SECTION ONE- THAT PART OF TRACT B AKA HARBOUR COVE UNIT 23 MPDAF: (OR 3648-800; 3970-1481) Note: The POA (Property Owners Association) authorized the Minor Adjustment scope applicable to a portion of Tract 'B" as shown in Exhibit "A". PARCEL IDENTIFICATION NUMBERS: 1425-701-0064-090-7 (Private Condominium), 1425-071-0064-000-6 (Harbour Cove Property Owners Association) B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Major Site Plan project known as 2470 Harbour Cove Drive (AKA Coral Cove), as depicted in Exhibit "A". is hereby approved as shown on the site plan for the project prepared by EDC. Inc., dated June 21, 2024 and date stamped received by the St. Lucie County Planning & Development Services Department on October 2. 2024, subject to the following conditions: Planning and Development Services Department— Planning Division 1. Dock slips are accessory to the homeowner's residential units and should not be leased externally. 2. No liveaboards are permitted. Boats should be used for recreational or commercial purposes only, not as permanent residences. PDS Order 2025-016 Page 2 File No.: MJSP-2406-000027 Environmental Resources Department 3. Prior to commencement of development, including but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, the developers, their successor or assigns, shall conduct a pre-construction meeting with construction personnel and Environmental Resources Department staff, to verify protective measures for native flora and fauna, environmentally significant habitats, etc. have been installed. 4. Prior to commencement of development, including but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, provide all outside agency documentation & correspondence. 5. Prior to commencement of development, including but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, and until completion of construction activities, the developers, their successor or assigns, shall comply with the conditions outlined by each jurisdictional agency, including but not limited to the County, the Florida Department of Environmental Protection, the US Army Corps of Engineers, etc. 6. Prior to commencement of development, including but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, the applicant shall contact the U.S. Fish and Wildlife Service for an official determination as to whether the property or project site is located "in" or "out" of the Coastal Barrier Resources System (CBRS). The approvals and authorizations granted by this Order shall be valid for a term of twelve (12) months, unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(6)(2), St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Adjustment to a Major Site Plan approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments, and the St. Lucie County Fire District, prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part B is determined to be invalid or PDS Order 2025-016 Page 3 File No.: MJSP-2406-000027 unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. F. The Planning and Development Services Department determined this request met the requirements for a Minor Adjustment to a Major Site Plan as the request would reduce the total amount of open space for the site plan known as Coral Cove Beach AKA Harbour Cove Beach by less than five percent (5%). Further applications to increase impervious space, therefore reducing open space by more than 5%, cumulatively, will require a Major Adjustment to a Major Site Plan. G. A Certificate of Capacity Exemption, a copy of which is attached hereto as Exhibit B" and made a part hereof the Order, is issued for the project scope. H. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "A" above, all such appeals must be filed in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. I. A recorded copy of this Order shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
