AN ORDER OF THE PLANNING & DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY GRANTING APPROVAL FOR A
MINOR SITE PLAN TO BE KNOWN AS NAUTILUS COVE AT SOUTH
HUTCHINSON ISLAND, LOCATED AT 9603 S OCEAN DRIVE, JENSEN
BEACH FL.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the request for a Minor Site Plan submitted by Logan Wellmeier, Esq. of Dean, Mead, Minton,
and Moore and Abdul Alkadry, PE, of Harris Civil Engineers, evaluated the comments of the St.
Lucie County Development Review Committee on this application, and made the following
determinations:
1. Logan Wellmeier, Esq. of Dean, Mead, Minton, and Moore and Abdul Alkadry, PE, of
Harris Civil Engineers submitted a Minor Site Plan application for a project to be known
as Nautilus Cove at South Hutchinson Island (AKA South Hutchinson Island Ocean
Villas-Nautilus Cove) on behalf of RSS Hutchinson, LLC. The site plan seeks to develop
twelve (12) residential units via six (6) duplex structures, support vehicular use area,
stormwater, landscaping and recreational amenities. The subject +/-19.47-acre parcel is
located within the Hutchinson Island Residential District Zoning District and the
Hutchinson Island Overlay —Zone B.
2. The Development Review Committee has reviewed the proposed Minor Site Plan and
found it to meet the standards of review as set forth in Section 11.02.07 of the St. Lucie
County Land Development Code.
3. Planning staff performed a detailed analysis of the project and found it to be consistent
with the St. Lucie County Land Development Code and Comprehensive Plan. The
analysis can be found in the Planning and Development Services Department
memorandum titled Nautilus Cove at South Hutchinson Island (MNSP-2311-000088.
dated February 17, 2025.
4. The proposed Minor Site Plan will not have an undue adverse effect on adjacent
properties, the character of the neighborhood, traffic conditions, parking, utility facilities,
or other matters affecting the public health, safety, and general welfare.
5. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the environment and immediate vicinity through building design, site design,
landscaping, and screening.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of
St. Lucie County, Florida:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
Minor Site Plan to be known as Nautilus Cove at South Hutchinson Island is hereby
approved as shown on the Site Plan drawings prepared by Harris Civil Engineers date
stamped received on November 1, 2024, by the St. Lucie County Planning and

Development Services Department, for the property more particularly described in Part
"B" below, subject to the following conditions:
1) Within 90 days of final site plan approval or prior to issuance of a Site
Development Permit, whichever occurs first, provide a finalized landscape plan
including the following revisions:
a) Shift or remove the proposed aluminum fence along the northern and
southern property lines where landscaping is required to buffer interior
vehicular use area to ensure the provided hedge material lies on the
outside of the fence, consistent with LDC 7.09.04.B.
b) Increase the height of the coontie and dune sunflower to at least two (2)
ft. in height in accordance with LDC 7.09.04.
2) Within 90 days of developmental approval, the applicant, property owner,
developer, successors, or assigns, shall convey to St. Lucie County, in a manner
or form acceptable to the County Attorney, an Easement Agreement for Access to
St. Lucie County Mosquito Control Impoundment/Dike Road.
3) Prior to commencement of development, including, but not limited to clearing,
filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a
100 percent survey per Florida Fish and Wildlife Conservation Commission (FWC)
protocol for gopher tortoises shall be provided. If any construction activities are
proposed within 25 ft. of any gopher tortoise burrows, a relocation permit shall
also be provided in accordance with FWCC requirements.
4) Prior to commencement of development, including but not limited to; clearing,
filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a
vegetation removal permit or exemption shall be issued by the Environmental
Resources Department per LDC 6.00.03.
5) Prior to commencement of development, including, but not limited to clearing,
filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00,
the developer shall provide an executed Conservation Easement (CE) and
approved Preserve Area Monitoring and Management Plan (PAMMP) to include
all onsite wetlands and their associated buffers, as well as the shoreline buffer
along the Indian River Lagoon, with an attached affidavit and cashier's check
(payable to the Clerk of Court for recording fees) to the County Attorney. The CE
may except the Easement Agreement Area prescribed for Access to St. Lucie
County Mosquito Control correlating with the Impoundment/Dike Road, however
the PAMMP should encompass said area to the extent of addressing banks or
similar stabilized/planted shorelines. The CE and PAMMP filing to St. Lucie
County shall include the corresponding CAD or similar GIS data.
6) Prior to commencement of development a Site Development Permit is required.
7) Prior to issuance of a Certificate of Occupancy (CO), provide a copy of the
Homeowner Association's (HOA) declaration of covenants document, which shall
include the following list of restrictions related to golf carts and their use.
a) Golf carts shall be electric only. The use of motorized golf carts requiring
the input of gas, or any other hazardous substance, shall be strictly
prohibited.

b) Golf carts shall measure no greater than forty-eight (48) inches in width.
c) Golf carts shall not be allowed to access the mosquito impoundment's
utility path located along the western perimeter.
d) A maximum speed promoting safety and the least amount of disturbance
shall be outlined.
8) Prior to issuance of a CO, all Category I listed invasive plants shall be
eradicated from the site.
9) The Building Permit shall demonstrate compliance with the Minor Site Plan
design and building height, including LDC Section 2.00.00 — Definitions.
B. The property on which this Minor Site Plan approval is being granted is described as
follows:

The South 232.46 feet of the North 1320.92 feet of fractional sections 2 and 3,
Township 37 South, Range 41 East; being a tract of land located partly in Government
Lots 1 and 2, of said Section 2, and Partly in Government Lot 1 of said Section 3,
extending from the centerline of the State Road A1A Right-of-way to the Indian River,
together with the South 232.46 feet of the North 1088.46 feet of factional Sections 2
and 3, Township 37 South, Range 41 East; being a tract of land located partly in
Government Lots 1 and 2, of said Section 2, and partly in Government Lot 1 of said
Section 3, extending from the centerline of the State Road A1A Right-of-way to the
Indian River Subject, however to all zoning restrictions of record and to existing rights-
of-way for State Road A I A.

of St. Lucie County, Florida.
A parcel of land lying in Government Lot 1, West of State Road A-1-A and within the
South 232.46 feet of the North 1088.46 feet of fractional Section 2, Township 37 South,
Range 41 East, St. Lucie County, Florida, being more particularly described as follows:
Beginning at a Point (P.O.B.) being the intersection of the Westerly right-of-way line of a
100 foot wide right-of-way for State Road A-I-A with the North line of the South 232.46
feet of the North 1088.46 feet of said fractional Section 2; thence run South 22° 59' 21"
East along said Westerly right-of-way line of State Road A-1-A, 155.00 feet; thence run
South 67° 00' 39" West at right angles to State Road A-1-A, 169.99 feet; thence run
South 01° 23' 31" East, 6.31 feet to the South line of the North 213 feet of the North
232.46 feet of the South 1088.46 feet of said fractional Section 2; thence run South 88°
36' 29" West along the South line of said North 213 feet, 175.00 feet; thence run North
08° 09' 29" West, 118.83 feet; thence run North 01° 23' 31" West, 95.00 feet to the
North line of the South 232.46 feet of the North 1088.46 feet of said fractional Section 2;

C. The approvals granted by this administrative order shall expire after twenty-four (24)

months from the effective date unless a building permit is issued, or an extension is granted
in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land
Development Code.
D. The developer, including any successors in interest, is advised as part of this Minor Site
Plan approval, the developer shall obtain all applicable development permits and
construction authorizations from the appropriate State, Federal, and local regulatory
agencies including, but not limited to, the Federal Communications Commission, Florida
Department of Environmental Protection, St. Lucie County Environmental Resources,
Public Works, and Building Departments prior to the commencement of any development
activities on the property described in Part "B". Issuance of this approval by the County
does not in any way create any rights on the part of the developer to obtain a permit from a
State or Federal agency and does not create any liability on the part or the County for
issuance of this permit if the developer fails to obtain requisite approvals of fulfill the
obligations imposed by a State or Federal agency or undertake actions that may result in a
violation of State or Federal law.
E. A copy of this Order shall be attached to the site plan drawings described in Part "A", which
shall be placed on file with the St. Lucie County Planning and Development Services
Director and mailed to the developer and agent of record as identified on the site plan
applications.
F. The conditions set forth in Part "A" are an integral non-severable part of the site plan
approval granted by this Order. If any condition set forth in Part "A" is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan approval granted by this order shall become null and void.
G. The site plan, attached as Exhibit "A", shall be valid for the same period as this order.
H. The Certificate of Capacity, attached as Exhibit "B", shall be valid for the same period as
this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
I. This Order shall become effective upon the date of approval indicated below. Should the
property owner, developer or authorized agent wish to appeal any condition described in
Part "A" above, all such appeals must be filled in writing with the County Administrator
within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B),
St. Lucie County Land Development Code. Should an appeal to this Order be filed, no
permitting reviews or further administrative action shall take place on the processing of this
development project until the appeal is resolved.
J. This Order shall be recorded in the Public Records of St. Lucie County.
