LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS UPDATING AND AMENDING FEES AND CHARGES FOR BUILDING PERMITS, REVIEWS,AND INSPECTIONS TO COVER THE COSTS OF TECHNICAL AND ADMINISTRATIVE ACTIVITIES AND SERVICES RELATED TO PERMITTING AND ZONING PROVIDED BY ST. LUCIE COUNTY, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Board of County Commissioners of St. Lucie County, Florida has made the following determinations: WHEREAS,Chapter 125,F.S.,provides for the enforcement of the Florida Building Code and enforce local technical amendments to the Florida Building Code; and WHEREAS,Chapter 553, F.S.,provides for the uniform adoption, updating, amendment, interpretation,and enforcement of a single,unified state building code,called the Florida Building Code; and WHEREAS, Section 125.56, F.S., authorizes the Board of County Commissioners to establish a schedule of reasonable inspection fees in order to defer the costs of inspection and enforcement of the provisions of this act, and of the Florida Building Code; and WHEREAS, the government operations and services demand a substantial amount of effort and resources by the County and establishing reasonable,necessary,and commensurate costs of providing those services to those parties deriving direct benefit is in the public interest; and WHEREAS,the Board of County Commissioners of St.Lucie County,Florida has deemed it necessary to further update and amend the schedule of fees to include charging users of specific County services and facilities a fee to lessen the burden on the taxpayers of St. Lucie County; and WHEREAS, the updated schedule of fees was prepared based upon the estimated direct and reasonable indirect costs associated with the provision of services, including the review and processing of applications; and WHEREAS, Section 163.3201, F.S., provides for the adoption and enforcement of regulations on development activities based upon the Comprehensive Plan for St. Lucie County; and WHEREAS, Section 163.3202, F.S., requires the adoption of land development regulations that are consistent with and implement the adopted comprehensive plan; and WHEREAS, on August 1, 1990, the Board enacted the St. Lucie County Land Development Code to further implement the Comprehensive Plan for St.Lucie County which calls for the regulation of land development activities; and WHEREAS, Chapter 125, F.S., authorizes the collection of fees necessary to perform governmental operations and services; and WHEREAS, Section 125.01, F.S., and the St. Lucie County Land Development Code Section 11.12.00 authorize this Board to establish a schedule of fees in order to cover the costs of technical and administrative activities required pursuant to the St. Lucie County Land Development Code; and WHEREAS, the Board of County Commissioners has established a schedule fees for building permit functions and has periodically updated the schedule pursuant to Resolution Numbers 89-022; 94-128; 98-154; 99-020; 01-108; 01-132; 02-040; 02-087; 06-171; 13-196; 20- 2011; and 24-053; and WHEREAS, the Board of County Commissioners last amended the schedule of fees for technical and administrative activities in 2024 pursuant to Resolution No. 24-053 to provide for a 25%reduction in building permit fees associated with private provider services; and WHEREAS,the Board of County Commissioners finds that it is in the best interest of the public to establish fees for services requested and placing the burden of those costs directly upon those parties deriving the benefit(s); and WHEREAS, the Board of County Commissioners finds the revised schedule of fees established by this resolution are intended to offset the costs of providing the requested service and are in the public interest and the charges are fair and reasonable. THEREFORE, BE IT RESOLVED, by the Board of County Commissioners for St. Lucie County Florida: 1. The foregoing recitals are true and correct and are incorporated herein by reference. 2. The Schedule of Fees attached hereto and incorporated herein as Exhibit A is hereby adopted. 3. The Schedule of Fees adopted herein shall be effective July 1,2025 (effective date)and shall supersede prior adopted fee resolutions 4.. County staff is directed to review the Schedule of Fees periodically to determine if fees should be adjusted to offset the technical,operational and material costs incurred by the County in providing services. Any adjustments to the Schedule of Fees shall be adopted by resolution. 5. This Resolution shall take effect on the effective date. New construction projects may include the normal trade permits in one encompassing permit fee according to the following schedule. 1. Where work for which a permit is required is started before obtaining said permit,the fees herein specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements in the execution of the work nor from any other penalties prescribed herein. 2. Unless otherwise stated, a Building Permit Fee is based on multiplying the value of the building or addition by the multiplier set by resolution by the Board of County Commissioners. Such value shall be determined by using the most recent Building Valuation Data compiled by the International Code Council (ICC). Fee is based on multiplying the value of the work authorized by the permit by .0070*. The value is determined by the Building Code Administrator. The multiplier may be evaluated at the beginning of each fiscal year to determine any modifications for approval by the Board of County Commission. Fee includes a certificate of completion or occupancy as applicable. AUTOMATED BUILDING PERMIT FEE: All building permits, certificates or other permits issued or authorized by the Planning & Development Services, Building & Code Regulation Division shall be subject to a five dollar($5) administrative charge for the purpose of providing funding for future updates, improvement, if necessary,replacement of the County's Automated Building Permit Software and Related Computer Programs and Information Management system (BIMS).All funds collected shall be deposited into a separate trust account and may not be used to fund or support any other computer software or hardware acquisitions that are not related to the review, processing or issuance of building permits, certificates or similarly issued permits or authorization.
