A RESOLUTION BY THE ST. LUCIE COUNTY BOARD OF
COUNTY COMMISSIONERS UPDATING, AMENDING AND
ESTABLISHING VARIOUS FEES AND CHARGES TO COVER
THE COSTS OF TECHNICAL AND ADMINISTRATIVE
ACTIVITIES AND RELATED SERVICES PROVIDED BY ST.
LUCIE COUNTY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS,the Board of County Commissioners of St. Lucie County, Florida has made the
following determinations:
WHEREAS, Chapters 125, and 163, F.S., provide for the adoption and enforcement of the
comprehensive plan and codes; regulation of structures in the right-of-way limits of the county road
system; and enforcement to ensure development undertaken is consistent with the plan and codes;
and
WHEREAS, Section 125.01, F.S., authorizes the Board of County Commissioners to
establish a schedule of fees; and perform any other acts not inconsistent with law, which acts are in
the common interest of the people of the county, and exercise all powers and privileges not
specifically prohibited by law; and
WHEREAS,the government operations and services demand a substantial amount of effort
and resources by the County and establishing reasonable, necessary, and commensurate costs of
providing those services to those parties deriving direct benefit is in the public interest; and
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida has deemed
it necessary to further update and amend the schedule of fees to include charging users of specific
County services a fee to lessen the burden on the taxpayers of St. Lucie County; and
WHEREAS,the updated schedule of fees was prepared based upon the estimated direct and
reasonable indirect costs associated with the provision of services, including the review and
processing of applications; and
WHEREAS, Section 163.3201, F.S., provides for the adoption and enforcement of
regulations on development activities based upon the Comprehensive Plan for St. Lucie County; and
WHEREAS, Section 163.3202, F.S., requires the adoption of land development regulations
that are consistent with and implement the adopted comprehensive plan; and
WHEREAS,on August 1, 1990, the Board enacted the St. Lucie County Land Development
Code to further implement the Comprehensive Plan for St.Lucie County which calls for the regulation
of land development activities; and

WHEREAS, Chapter 125, F.S., authorizes the collection of fees necessary to perform
governmental operations and services; and
WHEREAS,Section 125.01,F.S.,and the St.Lucie County Land Development Code Section
11.12.00 authorize this Board to establish a schedule of fees in order to cover the costs of technical
and administrative activities required pursuant to the St. Lucie County Land Development Code; and
WHEREAS, the Board of County Commissioners has established a schedule fees and has
periodically updated the schedule pursuant to Resolution Numbers 91-120; 94-119; 96-235; 97-029;
98-198; 08-060; 10-149; 18-072; 22-191; and 24-067; and
WHEREAS,the Board of County Commissioners last amended the schedule of fees for the
technical and administrative activities for the planning review of development proposals pursuant to
the Land Development Code in 2024 pursuant to Resolution No. 2024-067; and
WHEREAS,the Board of County Commissioners last amended the schedule of fees for the
technical and administrative activities for the public works review of development proposals pursuant
to the Land Development Code in 1998 pursuant to Resolution No. 98-198; and
WHEREAS, the Board of County Commissioners last amended the schedule of fees for the
technical and administrative activities for the environmental review of development proposals
pursuant to the Land Development Code in 2008 pursuant to Resolution No. 08-060; and
WHEREAS, the Board of County Commissioners is creating a schedule of fees for the
technical and administrative activities for the property acquisition review of development proposals
pursuant to the Land Development Code; and
WHEREAS, the Board of County Commissioners is establishing, consistent with Section
119.07, F.S., a schedule of fees for the response to public record requests; and
WHEREAS, the Board of County Commissioners finds that it is in the best interest of the
public to establish fees for services requested and placing the burden of those costs directly upon
those parties deriving the benefit(s); and
WHEREAS, the Board of County Commissioners finds the revised schedule of fees
established by this resolution are intended to offset the costs of providing the requested service and
are in the public interest and the charges are fair and reasonable.
THEREFORE, BE IT RESOLVED, by the Board of County Commissioners for St. Lucie
County Florida:
1. The foregoing recitals are true and correct and are incorporated herein by reference.
2.The Schedule of Fees attached hereto and incorporated herein as Exhibits A,B,C,D and E
are hereby adopted.
3. The Public Records Request fees in Exhibit E and the discounted rates for Land Use
amendments to AG-5, AG-2.5 and Cpub designations and the discounted rates for Zoning
amendments to the AG-5, AG-2.5, AG-1, AR-1 and Cpub districts shall be effective upon adoption
of this resolution.
4. The remaining Schedule of Fees adopted herein shall be effective July 1, 2025 (effective
date)and shall supersede prior adopted fee resolutions.
5. Any questions concerning the applicability of fees shall be determined by the
director/division manager of the appropriate department/division, as applicable.
6. Beginning October 1, 2027, the fees within the Schedule of Fees shall be adjusted by 2%
annually on October 1 st, rounded to the nearest whole dollar, except for the Public Records Request
fees. County staff is directed to review the Schedule of Fees annually to determine if the fees should
be adjusted further to offset the technical, operational and material costs incurred by the County in
providing services. Any adjustments to the Schedule of Fees beyond the 2%annual adjustment shall
be adopted by resolution.
7. This Resolution shall take effect on the effective dates.

Traffic Methodology&Analysis Reimbursable costs to County From Reso. 2024-67: Applications that are required to provide
Review Fee transportation studies to review their development impacts shall be
required to deposit a fee of$3,000 into an escrow account to cover the
cost of experts hired by the Planning and Development Services
Department to review the transportation level of service, roadways,
intersections,parking and other related traffic studies submitted by the
applicant as part of the development review process or a map or text
amendment submitted by a private applicant. Any unused funds
deposited by the applicant will be returned upon the final decision for
the subject application, petition, permit and/or amendment (final
decision may be approval,denial,or withdrawal of the application).

Additional Special Service Charge for Extensive Use
(1)If the nature or volume of the public record(s)requested to be inspected or copied requires extensive use of information technology resources
or extensive clerical or supervisory assistance by personnel of St.Lucie County,or both,an additional special service charge will be charged.
(2)The additional special service charge shall be reasonable and shall be based on the cost incurred for such extensive use of information
technology resources or the labor cost of the personnel providing the service that is actually incurred by St.Lucie County for the clerical and
supervisory assistance required,or both.These charges shall be in accordance with Section 119.07,F.S.
(3)Extensive services are defined by the St.Lucie County Board of County Commissioners as any public record request that requires more than%:
hour to complete all tasks defined in(a)and(b),below:
(a)"Clerical or supervisory assistance"includes,but is not limited to,locating and retrieving records,review of records for any statutorily
exempt information,preparation of records for either inspection or duplication,classification of records based on exempt or confidential
information in the records as defined by Florida Statute,monitoring of the inspection or duplication of the record if necessary to ensure
integrity of the record,and the instruction or supervision of personnel performing the tasks required to reproduce or refile materials.
(b)"Use of information technology resources"includes,but is not limited to,writing,or executing various software commands and/or hardware
setup and/or management of information technology assets.
Estimate of Cost,Payment,and Fulfillment
(1)An estimate ofcosts will be provided to the requestor within seven(7)business days after receiving the request,and the requestor's approval is
required prior to beginning fulfillment of the request.Payment in full must be received prior to production of the records,and fulfillment of the
request.
(2)If the actual costs incurred are less than such payment as estimated,the overpayment will be refunded to the requestor.
(3)The requestor will be required to remit additional monies at the time of release of the documents to pay for any costs in excess of the estimate.
All Public Record Request fees shall be as prescribed by State Statute.
