AN ORDER GRANTING ADMINISTRATIVE RELIEF
FOR A TWELVE (12) MONTH DEFERMENT OF A
PHASED SITE IMPROVEMENT PLAN FOR THE
INSTALLATION OF LANDSCAPING,
STORMWATER, AND PARKING IMPROVEMENTS
FOR PROPERTY LOCATED AT 3180 N. KINGS
HIGHWAY IN FORT PIERCE, FL.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request to defer the installation of landscaping, stormwater, and parking improvements in
accordance with the provisions for relief set forth in St. Lucie County Ordinance 12-003 and Land
Development Code Section 7.06.03(A) for the property located at 3180 N. Kings Highway, Fort
Pierce, and has made the following determinations:
1. The applicant. Engineering Design &Construction, Inc., on behalf of the property owner. is
requesting administrative relief to allow a twelve (12) month deferment for the phased
installation of landscaping, stormwater, and parking improvements. In accordance with the
provisions of Section 7.06.02 — all required off-street parking spaces, access aisles.
vehicular use, and off-street loading areas constructed, expanded, or altered after March 1,
1999, shall be constructed with an all-weather surface, meeting requirements of the St.
Lucie County Public Works Department. The +/-2.47-acre parcel is zoned IL (Industrial.
Light) with a MXD, (Mixed Use Development) future land use designation.
2. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida.
adopted the St. Lucie County Land Development Code and has adopted amendments to
the Land Development Code through certain ordinances.
3. On May 15, 2012, the Board of County Commissioners of St. Lucie County. Florida.
adopted Ordinance 12-003 granting the Planning and Development Services Director the
authority to allow. after a full analysis of all potential impacts, certain on-site improvements
to be deferred to a future date.
4. This request for Administrative Relief has met the provisions for relief set forth in LDC
Section 7.06.03(A). Staff has provided a written analysis that demonstrates the proposed
relief is based upon conditions that are unique and peculiar to the site conditions.
5. The Development Review Committee reviewed the request and Planning Staff performed
an analysis of the request for deferral of the installation of landscaping, stormwater. parking
improvements. The analysis is found in the Planning and Development Services
Department memorandum entitled Rhino Roofs—Request for Administrative Relief(WDA-
2409-000031) dated June 16, 2025.

6. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting public health, safety. and general welfare.
NOW,THEREFORE, BE IT ORDERED: BY THE PLANNING AND DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY, FLORIDA:
A. Pursuant to Ordinance 12-003 and the St. Lucie County Land Development Code, the
request from Engineering Design & Construction, Inc, on behalf of Rhino Roofs, Inc.. for
administrative relief to defer installation of landscaping, stormwater. and parking
improvements, is hereby approved subject to the following conditions:
Planning Division's Recommendation
1. The deferral period will be twelve (12) months, with the possibility of one (1) ninety 90-day
extension, if requested and notable progress has been made after inspection of site
improvements following the time-specific schedule below:
Phase 1 (within 6 months of recording WDA)
• Secure a Site Development Permit within thirty (30) days of approval of PDS Order
2025-043.
• Obtain a Zoning Compliance Certificate to conduct operations in existing
buildings and expand to utilize existing parking along the south side of the
existing office building.
• Prior to occupancy, provide one (1) paved handicapped parking space west of the
existing office building along N. Kings Hwy.
• Apply for a Driveway Permit (Joint Access) and Closure Permit through Florida
Department of Transportation. (FDOT)
Phase 2 (within 6 - 12 months of recording WDA)
• Provide paved employee parking in southwest corner of site, and paved truck
parking in southeast corner of the site.
• Complete stormwater improvements, and all required landscaping requirements
within twelve (12) months of recording WDA.
• Pending approval of the Minor Adjustment to a Minor Site Plan, for the new +/-
2,895 square foot storage building with associated site improvements, construct the
building in accordance with the approved site plan and utilize millings surface for
outdoor storage north of the proposed structure.
2. Prior to any ground disturbance or impacts to any vegetation, a Vegetation Removal Permit
(VRP) or exemption shall be issued by ERD per LDC 6.00.03.
3. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant species
shall be eradicated from the site.

5. This waiver shall allow months (6)for the first phase of improvements and an additional six
(6) months for the second phase. If the applicant fails to fulfill the requirements of each
Phase within the specified timeline, the Planning and Development Services Director or
designee may void PDS Order 2025-043 within 30 days with a written notice if no
extension has been requested or approved. The applicant will be allowed a one-time ninety
90-day extension if requested, and notable progress has been made with on-site
improvements.
6. Within twelve (12) months of the date of approval of PDS Order 2025-043, the applicant
shall complete all site paving, drainage requirements and landscaping improvements,
unless a one-time extension has been approved. After the twelve-month deferment period,
the property shall comply with the minimum code standards of all applicable sections of the
Land Development Code. If the property does not meet all applicable standards, it may be
subject to a Code compliance violation.

Note: Parcel 2, included to provide for cross-access connection to enhance internal circulation,
provide emergency access, and support future interconnectivity with the adjacent parcel to the
north.
C. The approvals and authorizations granted by this Order are granted to the applicant for the
purpose of obtaining construction permits and a Zoning Compliance Certificate from St.
Lucie County.
D. The developer is advised as part of this approval for Rhino Roofs Inc., including any
successors in interest, the developer shall obtain all applicable development permits and
construction authorizations from the appropriate State and Federal and local regulatory
agencies including, but not limited to, the United States Army Corps of Engineers, Florida
Department of Environmental Protection. South Florida Water Management District. and
St. Lucie County's Environmental Resources and Building Departments prior to the
commencement of any development activities on the property described in Part B.
Issuance of this approval by the County does not in any way create any rights on the part
of the developer to obtain a permit from a State or Federal agency and does not create any
liability on the part of the County for issuance of this approval if the developer fails to obtain
requisite approvals or fulfill the obligations imposed by a State or Federal agency or
undertake actions that may result in a violation of State or Federal law.
E. The conditions set forth in Part A are an integral non-severable part of the Administrative
Relief approval as granted by this Order. If any condition set forth in Part A is determined to
be invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the Administrative Relief approval granted by this order shall become
null and void.
F. A copy of this Order shall be placed on file with the Planning and Development Services
Director and mailed to the developer or agent of record as identified on the written request
for administrative relief.
G. This Order shall be recorded in the Public Records of St. Lucie County.
