AN ORDER GRANTING STATUTORY EXTENTION PROVIDED
BY FLORIDA STATUTES SECTION 252.363, TO THE
SCHEDULED EXPIRATION DATE FOR THE MINOR SITE PLAN
KNOWN AS GATOR STATE STORAGE.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a development order administrative extension timely submitted by the owner of Gator
State Storage FP. LLC. and has made the following determinations:
1. On March 28. 2024, Engineering, Design, and Construction, Inc.. submitted on behalf of
Gator State Storage FP LLC, a Minor Adjustment to a Minor Site Plan and Conditional Use
to add an unmanned security access gate and portable (movable) storage pods. The
Adjustment also affirmed the current project name and ownership. The site is located at
6070 S US Highway 1, Fort Pierce, FL 34982, within the CG (Commercial, General) Zoning
District.
2. On March 28, 2025, Rolando Maytin. owner of Gator State Storage, applied for a Site Plan
extension pursuant to Section 252.363 Florida Statutes. The requested Development Order
extension is pursuant to Executive Orders 2024-287 (Hurricane Ian), and 24-264(Hurricane
Milton). The project has a current expiration date of March 28, 2025.
3. On September 23, 2022, Governor DeSantis issued Executive Order Number 22-218
declaring a state of emergency for certain counties in the State of Florida, including St.
Lucie County. as a result of the threat of Tropical Storm Nine/Hurricane Ian. This emergency
declaration was effective on September 23, 2022. and would have expired 60 days later, on
November 22, 2022. The Governor issued Executive Order 22-219 on September 24, 2022,
expanding the state of emergency to cover the entire State of Florida. However, subsequent
executive orders have continued to extend executive orders 22-218 and 22-219, through
Executive Order 24-287. which extended the State of Emergency (SOE) to February 16,
2025. The deadline to file an extension notification was May 17, 2025, for Hurricane Ian.
4. On October 5. 2024, Governor DeSantis issued Executive Order 24-264 for sixty (60) days
due to the threat of Tropical Storm Milton to the State of Florida residents. The eligible
tolling period for this emergency declaration is sixty (60) days plus twenty-four(24)months.
The State of Emergency for Hurricane Milton in St. Lucie County ends on February 2, 2025.
Pursuant to Section 252.363(1)(b), the deadline to file an extension notification was May 3,
2025. for Hurricane Milton.
5. Senate Bill 250, approved by the Governor on June 28, 2023, and effective July 1, 2023,
amends Section 252.363(1)(a) Florida Statutes, increasing the extension of the expiration
dates for such permits or other authorizations from six (6) months to twenty-four (24)
months per state of emergency (plus the duration of the emergency declaration), but limiting

the extended period under overlapping states of emergency to forty-eight (48) months.
6. Florida Statutes Section 252.363 requires that a specific written notice be filed with the
issuing authority within ninety (90) days after the termination of the declaration of
emergency. The applicant applied for the extensions on March 28, 2025. which was within
the timeframe allotted by statute.
7. Planning Staff performed an analysis of the project and determined that the extension is
consistent with the original St. Lucie County development order and granted extensions
depicted on the attached Exhibit A. Further analysis is found in the memorandum titled
Gator State Storage Executive Order Extension, dated June 16, 2025.
NOW, THEREFORE, BE IT ORDERED by the St. Lucie County Planning and Development
Services Director:
A. Pursuant to Florida Statutes Section 252.363. the approval for the project known as Gator
State Storage Minor Site Plan has been found to be eligible for a statutory extension. The
approval granted under PDS Order 2024-006, is extended from its last scheduled expiration
date of March 7, 2025, shall now expire March 28, 2029, for the property described in Part B
of this Order. The property shall comply with all conditions of approval as recorded under
PDS Order 2024-006.
B. The property on which this development order extension is being granted is described as
follows:

being in Section 10, Township 36 South, Range 40 East, as recorded in Plat Book 1,
Page(s) 23. of the Public Records of St. Lucie County, Florida. LESS and Excepting all
Rights-of-Ways for US 1 and drainage canal.

C. The statutory extension approvals for the Minor Site Plan shall expire on March 7, 2029.
unless an extension has been granted in accordance with Section 11.02.06, St. Lucie
County Land Development Code. A Minor Adjustment to the Conditional Use will be
required for a change in business name and/or ownership before a Zoning Compliance
Certificate is issued.
D. The conditions as outlined in PDS Order 2024-006, are an integral non-severable part of the
site plan approval as granted by this administrative extension. If any condition is determined
to be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition. the development order extension approval granted by this
resolution shall become null and void.

E. The Certificate of Capacity granted by the Planning and Development Services Director
shall remain valid for the period of this development order. If this order expires or otherwise
terminates, the Certificate of Capacity shall automatically terminate.
F. A copy of this statutory extension shall be placed on file with the St. Lucie County Planning
and Development Services Department.
G. This order shall be recorded in the Public Records of St. Lucie County.
