LUCIE COUNTY GRANTING APPROVAL OF A MINOR ADJUSTMENT AND A STATUTORY EXTENSION TO THE EXPIRATION DATE TO THE U- HAUL OF PORT ST. LUCIE CONDITIONAL USE PERMIT FOR A PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Adjustment to a Conditional Use, and an associated Executive Order Extension, submitted by Contineo Group, LLC, on behalf of U-Haul Co of Florida, and evaluated the comments of the St. Lucie County Development Review Committee on the application and has made the following determinations: 1. Contineo Group, LLC, on behalf of U-Haul Co of Florida, requested a Minor Adjustment to the U-Haul of Port St. Lucie Conditional Use Permit to increase the development's Building "A" square footage (footprint) from 108,174 sq. ft. to 109,529 sq. ft., for an increase of 1,355 sq. ft. The overall building design and layout will remain the same at 127,191 square feet. The property is located at 6878 S US Highway 1 on the east side of US Highway 1, approximately one-third of a mile south of Kitterman Road, in Port St. Lucie, as legally described in Paragraph "A" and depicted on Exhibit "A". 2. On May 7, 2024, the Board of County Commissioners approved Resolution No. 2024- 039, authorizing a Conditional Use Permit to operate a climate-controlled interior access self-storage facility with associated site improvements on the subject parcel. 3. On October 5, 2024, Governor DeSantis issued Executive Order 24-214, declaring a state of emergency for sixty (60) days due to the threat of Tropical Storm Milton to residents of the State of Florida. This order was subsequently extended through Executive Order 24-264 for an additional sixty (60) days on December 3, 2024. The eligible tolling period for this emergency declaration is 120 days plus twenty-four (24) months. Florida Statute Section 252.363 provides that any local government issued development order or permit may be extended from the period remaining for the duration of the emergency declaration sixty (60) days plus twenty-four (24) months. 4. On February 18, 2025, the Board of County Commissioners approved Resolution No. 2025-048, granting a Major Site Plan to construct two (2) climate-controlled interior access self-storage facilities with associated site improvements totaling 127,191 square feet. 5. The St. Lucie County Development Review Committee has reviewed the adjusted Site Plan and found it to meet the technical requirements of the St. Lucie County Land Development Code, St. Lucie County Comprehensive Plan, and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, subject to the conditions previously set forth in Resolution No. 2025-048 for the project. Planning staff performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services memorandum titled U- Haul of Port St. Lucie - Minor Adjustment to the Conditional Use & Executive Order Extension (CU-2503-000084), June 18, 2025. 7. The proposed Minor Adjustment will not have an undue adverse effect on adjacent properties, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. 8. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW, THEREFORE, BE IT ORDERED: by the St. Lucie County Planning and Development Services Director: Pursuant to Sections 11.07.03 and 11.07.05 of the St. Lucie County Land Development Code, the Minor Adjustment to the Conditional Use is hereby approved as shown on the site plan drawings, prepared by Contineo Group, LLC, revised dated October 10, 2024, and revised on February 7, 2025, affirming the Conditions of Approval in Resolution No. 2025-048 shall apply to the Minor Adjustment to the Conditional Use Permit for U-Haul of Port St. Lucie. A. The property on which this Minor Adjustment to the Conditional Use is being approved is described as follows: Legal Description: COMMENCE AT THE INTERSECTION OF THE EAST RIGHT-OF-WAY LINE OF U.S. HIGHWAY 1 (120 FOOT RIGHT-OF-WAY) WITH THE NORTH LINE OF LOT 9, BLOCK 4, MODEL LAND COMPANY'S SUBDIVISION, AS RECORDED IN PLAT BOOK 1, PAGE 41, PUBLIC RECORDS OF SAINT LUCIE COUNTY, FLORIDA; THENCE SOUTH 00°17'26" EAST, ALONG THE EAST RIGHT-OF-WAY LINE OF U.S. HIGHWAY 1, A DISTANCE OF 467.21 FEET TO A 1/2" REBAR & CAP (LB 7545) MARKING THE POINT OF BEGINNING; THENCE, LEAVING SAID EAST RIGHT-OF- WAY LINE, NORTH 89°45'26" EAST, A DISTANCE OF 551.83 FEET TO A 5/8" IRON ROD (NO IDENTIFICATION) ON THE WEST RIGHT-OF-WAY OF NEW CANAL (80 FOOT RIGHT-OF-WAY); THENCE SOUTH 00°13'48" EAST, ALONG SAID WEST RIGHT-OF-WAY, A DISTANCE OF 192.53 FEET TO A 1/2" REBAR & CAP (LB 7996); THENCE CONTINUE SOUTH 00°13'48" EAST, A DISTANCE OF 275.00 FEET TO A 1/2" REBAR & CAP (LB 7996); THENCE, LEAVING SAID WEST RIGHT-OF-WAY, SOUTH 89°47'11" WEST, A DISTANCE OF 551.34 FEET TO A 1/2" REBAR & CAP (LB 7545) ON THE EAST RIGHT-OF-WAY OF SAID U.S. HIGHWAY 1; THENCE NORTH 00°17'26" WEST, ALONG SAID EAST RIGHT-OF-WAY, A DISTANCE OF 275.02 FEET TO A 1/2" REBAR & CAP (LB 7996); THENCE CONTINUE NORTH 00°17'26" WEST, A DISTANCE OF 192.23 FEET TO THE POINT OF BEGINNING. The approvals and authorizations granted by this order shall expire on November 8, 2027, unless a Building Permit is obtained, Certificate of Zoning Compliance issued, or an extension is granted in accordance with Section 11.02.06 of the St. Lucie County Land Development Code. C. The developer is advised as part of this Conditional Use Adjustment approval, that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. A copy of this Order shall be attached to the site plan drawings identified as Exhibit "A", which plan shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. E. The conditions set forth in the original Resolution No. 2025-048 are an integral non- severable part of the approval granted by this Resolution. If any condition set forth in Resolution No. 2025-048 is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Resolution shall become null and void. F. The Certificate of Capacity, issued with the corresponding Major Site Plan via Resolution 2025-048, shall be valid for the same period as said Resolution. If Resolution 2024-048 expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Resolution No. 2025-048, all such appeals must be filled in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved.
