AN ORDER GRANTING A STATUTORY EXTENTION
PROVIDED BY FLORIDA STATUTES SECTION 252.363, TO
THE SCHEDULED EXPIRATION DATE FOR THE MAJOR
ADJUSTMENT TO MINOR SITE PLAN KNOWN AS
CONTENDER BOATS (FKA CHIQUITA CITRUS PACKING /
INDIAN RIVER CITRUS).
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a development order administrative extension timely submitted by Christen Spake, Esq.
on behalf of on behalf of Contender Boats, Inc, and has made the following determinations:
1. In January 1987, the Board of County Commissioners approved the Chiquita Citrus Packing
Site Plan via Resolution 87-17. The site plan encompassed 26.16 acres (net) and provided
for 86,080 sq. ft. containing a fruit processing warehouse,fruit-colored structure and a 4,000
sq. ft. office. Phase 1 included left and right turn lanes on Midway Road, a stormwater pond
and 125 parking spaces.
2. October 2, 2023, The Planning and Development Services Director granted approval
through PDS Order 2023-030 for a Major Adjustment to Minor Site Plan for Contender Boats
(FKA Chiquita Citrus Packing / Indian River Citrus), to expand the manufacturing facility to
add two buildings totaling 139,860 sq. ft., add a 1,200 sq. ft. containment area, and add
resin tanks. The property is located at 350 Midway Road, in Fort Pierce. FL.
3. The applicant, Christen Spake, Esq., of Gunster Law Firm, applied for a Site Plan extension
pursuant to Section 252.363 Florida Statutes. The requested Development Order extension
is pursuant to Executive Orders 22-219 (Hurricane Ian), and 24-214 (Hurricane Milton).
4. Senate Bill 250, approved by the Governor on June 28, 2023, and effective July 1, 2023,
amends Section 252.363(1)(a) Florida Statutes, increasing the extension of the expiration
dates for such permits or other authorizations to twenty-four (24) months per state of
emergency (plus the duration of the emergency declaration), but limiting the extended
period under overlapping states of emergency to forty-eight (48) months.
5. Florida Statutes Section 252.363 requires that a specific written notice be filed with the
issuing authority within ninety (90) days after the termination of the declaration of
emergency. The applicant applied for the extensions on June 23, 2025.
6. Planning Staff performed an analysis of the project and determined that the extension is
consistent with the original St. Lucie County development order. Further analysis can be

River Citrus) Executive Order Extension Request(EDO-2506-000058), dated July 24,2025.
NOW, THEREFORE, BE IT ORDERED by the St. Lucie County Planning and Development

Services Director:
A. Pursuant to Florida Statutes Section 252.363, the approval for the project known as
Contender Boats (FKA Chiquita Citrus Packing / Indian River Citrus) Major Site Plan has
been found to be eligible for a statutory extension. The approval granted under PDS Order
2023-030, is extended from its last scheduled expiration date of October 2, 2025. shall now
expire October 2, 2029, for the property described in Part B. The project shall comply with
all conditions of approval as recorded.
B. The property on which this development order extension is being granted is described as
follows:

C. The statutory extension approvals for the Major Site Plan shall expire as stated below.
unless an extension has been granted in accordance with Section 11.02.06, St. Lucie
County Land Development Code.
D. The conditions outlined in PDS Order No. 2023-030 are an integral non-severable part of
the site plan approval as granted by this extension. If any condition is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, this development order extension approval granted by this resolution
shall become null and void.
E. The Certificate of Capacity granted by the Planning and Development Services Director
shall remain valid for the period of this development order. If this order expires or otherwise
terminates, the Certificate of Capacity shall automatically terminate.
F. A copy of this statutory extension shall be placed on file with the St. Lucie County Planning
and Development Services Department.
G. This order shall be recorded in the Public Records of St. Lucie County.
