PROPOSED WAREHOUSE WITH FUTURE EXPANSION FOR PROPERTY LOCATED APPROXIMATELY .15 MILES EAST OF KEEN RD., IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Site Plan submitted by Blaine Bergstresser P.E. of KMA Engineering and Surveying, LLC, on behalf of Dave Clapperton of Sherbrooke O.E.M. ltd., reviewed the comments of the St. Lucie County Development Review Committee on this application, and has made the following determinations: 1. On February 26, 2024, Blaine Bergstresser of KMA Engineering and Surveying, LLC submitted a Minor Site Plan application on behalf of Dave Clapperton of Sherbrooke O.E.M. ltd. The project site consists of 3.49 acres located within the IL (Industrial, Light) Zoning District located .15 miles east of Keen Road on the south side of St. Lucie o Boulevard, in the Airport Overlay district. The Minor Site Plan, known as 5593 St. Lucie o Blvd. Proposed Warehouse with Future Expansion, includes a two-phased development consisting of 12,660 sq. ft. prefabricated buildings, 2,589 sq. ft. existing structures cs 0 1- including three (3) Single Family Residences, 37,857 sq. ft. green space, 8,060 sq. ft. dry F g detention, associated site improvements including paved parking, landscaping, and o "N onsite stormwater management. w g� o 2. The St. Lucie County Development Review Committee has reviewed the proposed Minor ;S Site Plan and found it to meet the technical requirements of the St. Lucie County Land 8 a Development Code, Comprehensive Plan, and has satisfied the standards of review set dW�N� forth in Section 11.02.07, Standards for Site Plan Review. z JjNYp w v g o 3. Planning staff performed a detailed analysis of the project and found it to be consistent with Azwcou LL o the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services Department memorandum titled 5593 St. Lucie Blvd. Proposed Warehouse with Future Expansion — Minor Site Plan, MNSP- 2402-000103, dated July 31, 2025. 4. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 5. St. Lucie County Land Development Code (LDC) Section 3.01.03 (T) 2. v. permits a single-family detached dwelling unit where located on an existing lot or parcel of record, as defined in LDC Section 2.00.00 and existing since on or before August 1, 1990. The subject parcels existed on or before August 1, 1990, and are existing lots or parcels of record as defined in LDC Section 2.00.00. 6. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that a Page 1 PDS No. 2025-065 File No.: MNSP-2402-000103 proposed use is in compliance with the provisions of the Land Development Code and the St. Lucie County Comprehensive Plan. 7. On January 23, 2025, the applicant made a Request for Real Property Combination of Parcel No's., 1431-222-000-1; 1431-222-0009-000-2; 1431,222-002-000-6; 1431-222- 0007-000-8. A Unity of Title for the four parcels shall be completed and recorded with the Saint Lucie County Property Appraiser's office prior to issuance of Site Development Permit. 8. On April 9, 2025, Blaine Bergstresser P.E. of KMA Engineering and Surveying, LLC, on behalf of Dave Clapperton of Sherbrooke O.E.M. ltd, submitted an application requesting a use determination to the Planning & Development Services (PDS) Department requesting three (3) existing Single Family Detached Dwelling Units be determined as a permitted use in this zoning district at a site located at 5593 St. Lucie Blvd., Fort Pierce, FL. 9. The determination to allow three (3) Single Family Detached Dwelling Units as a conforming and permitted use within the IL (Industrial, Light) zoning district is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan and the Land Development Code, is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. 10. The proposed determination will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare within the IL (Industrial, Light) zoning district. 11. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 12. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW,THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor Site Plan known as 5593 St. Lucie Blvd. Proposed Warehouse with Future Expansion is hereby approved as shown on the site plan drawings prepared by KMA Engineering and Surveying, LLC, date stamped received on May 8, 2025, by the St. Lucie County Planning and Development Services Department, and a Single Family Detached Dwelling Units (3) has been determined to be consistent with similar permitted uses in the IL (Industrial, Light) zoning district, and, as such, is determined to be a permitted use in this zoning district at the site located at 5399 St. Lucie Boulevard, St. Lucie County, FL for the property more particularly described in Part "B" below, subject to the following conditions: Planning Department: 1) The entire proposed development shall be completed in one phase except for "Future Expansion" as noted on Sheet C-201 last revised on March 10, 2025, to be considered as phase two. Page 2 PDS No. 2025-065 File No.: MNSP-2402-000103 2) Two (2) paved parking spaces are to be provided for each of the retained single-family homes. The two (2) spaces proposed for the northern most home are to be "angled" - to avoid the tendency for someone to ingress via the one (1) way out to St. Lucie Blvd. 3) A Unity of Title for the four parcels with parcel Identification No.'s: 1431-222-000-1; 1431-222-0009-000-2; 1431,222-002-000-6 and 1431-222-0007-000-8 shall be completed and recorded with the Saint Lucie County Property Appraiser's office prior to issuance of a Site Development Permit. Public Works— Engineering Department: 4) A Site Development Permit is required prior to performing site improvement activities. The Site Development Permit application can be found on the County's website under the Public Works Department link. In accordance with the permit and Land Development Regulations, the applicant shall retain the FOR for site inspections and final certification. 5) A 6-foot sidewalk is required along the adjacent Saint Lucie Boulevard Right-of-Way. The Board of County Commissioners may authorize a Fee-in-Lieu of construction of the sidewalk. 6) A Road Improvement Agreement and bonding is required for improvements within St. Lucie Boulevard Right-of-Way along the frontage of the project. Environmental Resources Department: 7) Prior to commencement of development, including but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a wall waiver signed by adjacent residential owner(s) to the west of the property OR a revised landscape plan depicting an eight (8) foot tall opaque masonry wall or wood fence with associated landscaping to buffer residential use from non-residential use shall be provided to the Environmental Resources Department per LDC 7.09.04.E. 8) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., an updated 100% gopher tortoise survey conducted by a state certified gopher tortoise agent may be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol, as these surveys are only valid for 90 days. 9) Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 10)Prior to the issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. B. The approval granted by this administrative order shall expire twenty-four(24) months from the effective date, unless a Building Permit is obtained. or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this Minor Site Plan approval. the developer shall obtain all applicable development permits and construction authorizations from the appropriate State, Federal, and local regulatory agencies including, but not limited to, the Federal Aviation Administration, Federal Communications Commission, Florida Department of Environmental Protection. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part or the County for issuance of this permit if the developer fails to obtain requisite approvals of fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. A copy of this Order shall be attached to the site plan drawing described in Part "A", which shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed to the developer and agent of record as identified on the site plan applications. F. The conditions set forth in Part "A" are an integral non-severable part of the Site Plan approval granted by this Order. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The Site Plan, attached as Exhibit "A", shall be valid for the same period as this order. H. The Certificate of Capacity, attached as Exhibit "B", shall be valid for the same period as this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "A" above, all such appeals must be filled in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. J.
