LUCIE COUNTY, FLORIDA Y � W , u o g WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County, W r_g o g Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited - o a to the staff report, has made the following determinations: W��(9 Y s 1. Mike and Sandra Andreas petitioned a variance from the provisions St. Lucie County W- #o Land Development Code Section 7.10.16.Q.1.a.1.(a) Recreational Vehicle Parks to allow y N 030 V o a, the front entry deck and stairs for an existing mobile home to encroach 5.0 feet into the -.03w ten (10)foot minimum front yard setback for an overall setback of 5.0 feet. 2. After publication of a notice of such hearing, installation of a notice sign on the property, and notification by mail to all owners of property within 500 feet of the subject property, this Board held a public hearing on July 23, 2025. 3. After consideration of the staff report and testimony presented during the public hearing, including that of the petitioner, staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested variance has not met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code, and the Board of adjustment has made the following determinations: a. The Lot is unique in the same sense as nearby Special Situation Lots and granting the variance would not impair other property or improvements in the neighborhood. b. The variance requested, however, cannot be said to be the minimum variance that will make possible the reasonable use of land and structures. The approved design for the mobile home in 2019 met the St. Lucie County Land Development Code's minimum front yard setback requirements, so the owners have reasonable use of the property without a variance. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. Petition of Mike and Sandra Andreas, a Variance for an unpermitted front entry deck and stairs for an existing Mobile Home to encroach 5.0 feet into the ten (10) foot minimum front yard setback within the Hutchinson Island Residential Zoning District (HIRD) as shown on the boundary survey created by Roland E. Rollins, Professional land Surveyor, July 23, 2025, BOA Resolution No. 2025-05 File No.VAR-2402-000059 Page 1 dated April 15, 2025, submitted to the Planning and Development Services Department, attached herein as Exhibit "A", and more specifically described as follows: Legal Description: LOT 541, NETTLES ISLAND PROJECT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 16, PAGES 1, 1 A THROUGH 1 J, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Address: 541 Nettles Blvd. Jensen Beach, Fl 34957 Parcel Identification Number: 4502-501-0727-000-3 B. Based on the evidence presented, including but not limited to, staff comments, exhibits, and the testimony presented, this variance request to allow an unpermitted front entry deck and stairs for an existing RV to encroach 5.0 feet into the ten (10) foot minimum front yard setback within the Hutchinson Island Residential Zoning District (HIRD) is denied. The Special Magistrate requests, however, that SLC staff continue to explore defining more clearly the dimensional requirements for Special Situation Lots as noted in LDC Section 7.10.16 — Recreational Vehicle Parks, and consider whether the subject property qualifies for such treatment. C. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action may be processed within thirty (30) days following the rendition of the decision of this order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. D. This Order shall be recorded in the public records of St. Lucie County. After the staff presentation and the testimony heard by the Special Magistrate, the variance was denied by the Board of Adjustment(Special Magistrate) as contained herein.
