AN ORDER GRANTING APPROVAL TO ALLOW OCEAN
BREEZE HOME HEALTH CARE, LLC TO OPERATE A NURSE
REGISTRY (SIC CODE 7361) "OFFICE USE" ONLY AS A
PERMITTED USE WITHIN THE HUTCHINSON ISLAND
RESIDENTIAL DISTRICT (HIRD) ZONING DISTRICT FOR A
CERTAIN PROPERTY LOCATED AT 9815 SOUTH OCEAN
DRIVE, SUITE, 3B, JENSEN BEACH, IN ST. LUCIE COUNTY,
FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the request to allow Ocean Breeze Home Health Care, LLC to operate a nurse
registry (SIC code 7361) "office use" only as a permitted use within the Hutchinson Island
Residential District (HIRD) zoning district for a certain property located at 9815 South
Ocean Drive, Suite, 3B, Jensen Beach, in St. Lucie County, Florida, and made the
following determinations:
1. The applicant. James Mitchell, on behalf of Ocean Breeze Home Health Care.
LLC, has submitted a request for a Use Determination to allow a Nurse Registry
"office use" at 9815 S Ocean Drive, Suite 3B. Nettles Island hosts a variety of
limited commercial uses. The 965 sq. ft. suite considered is within a +/- 1.53-acre
site is located on Nettles Island, within the HIRD (Hutchinson Island Residential
District) zoning district, and has a Future Land Use (FLU) designation of RU
(Residential Urban).
2. The request for Use Determination to allow a Nurse Registry as permitted use in
the HIRD (Hutchinson Island Residential District) will create a place for Ocean
Breeze Home Health Care, LLC to allow owners to conduct daily operations,
receive mail, and provide storage for records. Ocean Breeze Home Health Care
has employees in the State of Florida that provide healthcare services for the local
population of St. Lucie County.
3. The applicant is pursuing a use determination pursuant to Florida Administrative
Code (FAC) 59A-18.004 which requires evidence of the legal right to use a
property and confirmation of zoning for nurse registry use is required before
relocating or opening a new office.
4. On May 15, 2012. the Board of County Commissioners of St. Lucie County,
Florida, adopted Ordinance 12-003 granting the Planning and Development

Services Director the authority to make the determination after full analysis of all
potential impacts that a proposed use is in compliance with the provisions of the
Land Development Code and the St. Lucie County Comprehensive Plan. The
analysis was provided by staff in the memorandum titled "Ocean Breeze Home
Health Care, LLC - Use Determination (WDA-2507-000042)"dated September 8,
2025, and it is provided as a reference with this order.
5. This determination to allow Ocean Breeze Home Health Care, LLC, to operate a
Nurse Registry as"office use"only at 9815 S Ocean Drive, Suite 3B, as a permitted
use within the HIRD (Hutchinson Island Residential District) zoning district is
consistent with the general purpose, goals, and objectives of the St. Lucie County
Comprehensive Plan and the Land Development Code.
6. The proposed determination will not have an undue adverse effect on adjacent
property, the character of the neighborhood, traffic conditions, parking, utility
facilities, or other matters affecting the public health, safety, and general welfare
within the HIRD (Hutchinson Island Residential District) zoning district.
NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services
Director of St. Lucie County, Florida:
Ocean Breeze Home Health Care, LLC, a Nurse Registry (SIC Code 7361) has been
determined to be consistent with similar permitted uses in the HIRD (Hutchinson Island
Residential District) zoning district, and, as such, is determined to be a permitted use in
this zoning district at a site located at 9815 South Ocean Drive, Suite, 3B, Jensen Beach,
in St. Lucie County, Florida, subject to the following condition:

1. Limit office use to foot traffic of essential staff only, storage of records, dispatching
staff remotely, and no medical visits on-site in both quantity and location to ensure
no adverse effects on the commercial environment and corridor are experienced
PART A. SEVERABILITY
If this Order or any provision thereof shall be held to be inapplicable to any person, property,
or circumstances, such holding shall not affect its applicability to any other person, property
or circumstances.

PART B. APPLICABILITY OF ORDER
The conditions set forth above are an integral non-severable part of this approval granted
by this Order. If any condition is determined to be invalid or unenforceable for any reason
and the applicant declines to comply voluntarily with that condition, the approval granted
by this Order shall become null and void.
PART C. FILING WITH THE CLERK OF COURT
This order shall be recorded in the Public Records of St. Lucie County.
