ORDINANCE NO. 2025-19
AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY AMENDING
ST. LUCIE COUNTY LAND DEVELOPMENT CODE
CHAPTER XIII BUILDING REGULATIONS AND PUBLIC
WORKS CONSTRUCTION MANUAL TO ADD SECTION
13.00.03, MILESTONE INSPECTION GUIDELINES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
FILING WITH THE DEPARTMENT OF STATE; PROVIDING
FOR AN EFFECTIVE DATE; PROVIDING FOR ADOPTION;
AND PROVIDING FOR CODIFICATION.
RECITALS
WHEREAS, Chapter 125 Florida Statutes establishes the right and power of
counties to provide for the health, safety, and general welfare of existing and future
residence by enacting and enforcing regulations necessary for the protection of the public;
and
WHEREAS, as of July 1, 2022, Section 553.899, Florida Statutes imposed a
statewide structural inspection program for aging condominium and cooperative buildings
to ensure that buildings are safe for continued use; and
WHEREAS, as of July 1, 2025, St. Lucie County is required to adopt an ordinance
requiring condominium associations, cooperatives associations, or any other owners
subject to Section 553.899, Florida Statutes to schedule or commence repairs for
substantial structural deterioration within a specified timeframe after the County receives
a phase two inspection report; and
WHEREAS, the adoption of this Ordinance is necessary to amend the St. Lucie
Code to pursuant to statutory requirements and is in the best interest of the health, safety,
and general welfare of existing and future residents of St. Lucie County.
WHEREAS, on August 21, 2025, the Local Planning Agency/Planning and Zoning
Commission held a public hearing on this proposed ordinance after publishing due notice
in the St. Lucie News Tribune and recommended that the proposed ordinance be
forwarded with a recommendation for approval; and
WHEREAS, on September 2, 2025, this Board held the first public hearing on this
proposed ordinance, after publishing due notice in the St. Lucie News Tribune; and
WHEREAS, on September 16, 2025, this Board held its second public hearing on
this proposed ordinance, after publishing due notice in the St. Lucie News Tribune; and

WHEREAS, the Board has determined that the proposed amendments to the St.
Lucie County Land Development Code are consistent with the general purpose, goals,
objectives and standards of the St. Lucie County Comprehensive Plan, are internally
consistent with the remainder of the Land Development Code and are in the best interest
of the health, safety and public welfare of the citizens of St. Lucie County, Florida.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St.
Lucie County, Florida:
1. St. Lucie County Land Development Code Chapter XIII, Section 13, is hereby
amended to add the language underlined below:
13.00.03. — Milestone Inspection Guidelines.
a. Mandatory structural inspections for condominium and cooperative buildings shall
be required and performed as set forth in Section 553.899, Florida Statutes, as
amended from time to time.
b. Condominium owners, cooperative owners, and any other owners subject to
Section 553.899, Florida Statutes must schedule or commence repairs for
substantial structural deterioration within one hundred eighty (180) days after St.
Lucie County receives a phase two inspection report.
2. SEVERABILITY.
If any portion of the forgoing conflicts with any other St. Lucie Code or other
applicable law, the more restrictive shall apply, If any subsection, sentence, clause,
phrase, or portion of this Ordinance is for any reason held or declared to be
unconstitutional, inoperative, or void, by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct, and independent provision and such holding shall
not affect the validity of the remainder of this Ordinance.
3. FILING WITH THE DEPARTMENT OF STATE.
The Clerk shall file a certified copy of this Ordinance with the Department of State.
4. EFFECTIVE DATE.
A certified copy of this ordinance shall be filed with the Department of State by the
Clerk of the Board of County Commissioners of St. Lucie County within ten days after
enactment by the Board, and this ordinance shall take effect upon filing with the
Department of State.
5. ADOPTION.
After motion and second, the vote on this Ordinance was as follows:

Commissioner James Clasby AYE
Commissioner Erin Lowry AYE
Commissioner Cathy Townsend ABSENT
6. CODIFICATION.
Provisions of this Ordinance shall be incorporated in the St. Lucie Land
Development Code, and the word "ordinance" may be changed to "section", "article", or
other appropriate word, and the sections of this Ordinance may be renumbered or
relettered to accomplish such intention.
PASSED AND DULY ADOPTED this 16TH day of September, 2025.
