WHEREAS the St. Lucie County Planning and Development Services Director has reviewed the
request for a Minor Site Plan submitted by Alex Homer P.E. of Hoyt + Berenyi, LLC, on behalf of
Cecil E. Overbay, Jr., owner of Old Dominion Freight Line, Inc., reviewed the comments of the St.
Lucie County Development Review Committee on this application, and has made the following
determinations:
1. On April 15, 2024, Alex Homer, P.E. of Hoyt + Berenyi, LLC submitted a Minor Site Plan
application on behalf of Old Dominion Freight Line, Inc. (ODFL) for a +/- 17.84 acre site
located within the IL (Industrial, Light) Zoning District on the east side of Kings Highway,
approximately 0.62 miles south of Angle Road, and 0.25 miles north of the Interstate 95
overpass. The Minor Site Plan, known as ODFL Fort Pierce, includes a 23,275 sq. ft.
warehouse/office building, employee and truck parking areas, two (2) new driveway
connections, stormwater detention areas, landscaping, parking, security fencing, water
sewer, power service and on-site stormwater management. The Plan includes a 150-
foot-long left turn lane from proposed "Road G", that extends east from Kings Highway,
in alignment with the Jenkins Road Area Plan Special District (JRAPSD). The design
accounts for potential future expansion of +-16,000 sq. ft. of warehouse (from 42 doors
to 62 doors) as well as future parking expansion. If future expansion of the building is
proposed, it will be reviewed as an adjustment to the approved Minor Site Plan.
2. The St. Lucie County Development Review Committee has reviewed the proposed Minor
Site Plan and found it to meet the technical requirements of the St. Lucie County Land
Development Code, Comprehensive Plan, and has satisfied the standards of review set
forth in Section 11.02.07, Standards for Site Plan Review.
3. Planning staff performed a detailed analysis of the project and found it to be consistent with
the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can
be found in the Planning and Development Services Department memorandum titled Old
Dominion Freight Line (ODFL) Fort Pierce - Minor Site Plan, MNSP-2404-000114, dated
October 13, 2025.
4. On September 19, 2023, the Board of County Commissioners held a public hearing, and
voted to approve a petition to amend the Officials Zoning Atlas from the AG-1 (Agricultural-
1) Zoning District to the IL (Industrial, Light) Zoning District. The Resolution was recorded
on October 6, 2023, with St. Lucie County Clerk of Court.

5. On February 20, 2024, the KRE Industrial Plat was approved to reconfigure two (2)
parcels (three (3) parcels in 1990) into two (2) parcels and provide a right-of-way (ROW)
tract for a portion of the future Road "G". The Plat was recorded on October 28, 2024,
with the St. Lucie County Clerk of Court.
6. On September 18, 2024, the Road "G" ROW (segment) tract was conveyed to St. Lucie
County and renamed from Road "G" to Whalou Way.
7. On June 18, 2025, a Road Improvement Agreement for Road "G" (Whalou Way)
improvements were entered into by and between SL Fort Pierce Investor LLC. (The
Developer) and St. Lucie County.
8. On June 19, 2025, a Site Development Permit for construction of Road "G" (Whalou Way)
was issued, with said improvements to be conveyed to St. Lucie County upon completion.
These improvements provide critical site access for the proposed Site Plan.
9. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
10. On August 14, 2025, The County's Environmental Resources Department certified a
Category III Administrative Waiver WTLW-2506-000049 per Comprehensive Plan Policy
6.1.14.4 for the project.
11. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St.
Lucie County, Florida:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor
Site Plan known as Old Dominion Freight Line — Fort Pierce is hereby approved as shown
on the site plan drawings prepared by Hoyt + Berenyi and last revised on July 28, 2025
date stamped received on September 22, 2025, by the St. Lucie County Planning and
Development Services Department, for the site located on the east side of Kings Highway,
approximately 0.62 miles south of Angle Road, and 0.25 miles north of the Interstate 95
overpasses, St. Lucie County, FL for the property more particularly described in Part "B"
below, subject to the following conditions:
Planning & Development Services Department:
1) The proposed development shall adhere to the"Stormwater Pollution Prevention Plans",
(SWPPP) sequence of construction as noted on Sheets C.3.1, C.3.2 and C.3.3 last
revised on July 28, 2025.
2) If future expansion of the building is proposed, it will be reviewed as an adjustment to
the approved Minor Site Plan per Section 11.02.03 of the St. Lucie County Land
Development Code.

3) A new Site Development Permit is required prior to performing site activities relating to
building expansion as shown on the Civil Site Plan, Sheet C.4.0.
Public Works Department— Engineering:
4) A Site Development Permit is required prior to performing site improvement activities.
The Site Development Permit application can be found on the County's website under
the Public Works Department link. In accordance with the permit and Land
Development Regulations, the applicant shall retain the FOR for site inspections and
final certification.
5) Prior to issuance of a Certificate of Occupancy, the identified portion of Road G/Whalou
Way, necessary for site access, is required to be completed.
Environmental Resources Department:
6) Prior to commencement of development, including, but not limited to, clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation
Removal Permit or Exemption shall be issued by the Environmental Resources
Department per LDC 6.00.03.
7) Prior to commencement of development, including, but not limited to, clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., listed species
surveys (e.g., gopher tortoise, crested caracara, etc.) shall be provided/updated as
required per state and/or federal survey protocol. Should any listed species be found as
a result of these updated surveys, appropriate permits from state and federal agencies
should be required.
8) Prior to commencement of development, including, but not limited to, clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the
Environmental Resource Permit (ERP) shall be provided from the appropriate state
and/or federal agencies, consistent with LDC 11.02.09.A.5. and Chapter 6 of the CP
Policy 6.1.12.4.
9) Prior to commencement of development, including, but not limited to, clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the applicant
shall provide any required fee-in-lieu of tree mitigation fees as detailed in the provided
tree mitigation plan.
10) Prior to commencement of development, including, but not limited to clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the developer
shall provide an executed Conservation Easement and approved Preserve Area
Monitoring and Management Plan (PAMMP) as applicable with an attached affidavit
and cashier's check (payable to the Clerk of the Court for recording fees) to the County
Attorney. The applicant shall also provide a GIS shapefile or CAD file of the conservation
easement boundaries to St. Lucie County.
11)Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall
be eradicated from the site.

B. The property on which this Minor Site Plan approval is being granted is described as
follows:

TOWNSHIP 35 SOUTH, RANG 39 EAST, ST LUCIE COUNTY, FLORIDA. 17.84
ACRES.
C. The approval granted by this administrative order shall expire twenty-four(24) months from
the effective date, unless a Building Permit is obtained, or an extension is granted in
accordance with the provisions of Section 11.02.06 of the St. Lucie County Land
Development Code.
D. The developer, including any successors in interest, is advised as part of this Minor Site
Plan approval, the developer shall obtain all applicable development permits and
construction authorizations from the appropriate State, Federal, and local regulatory
agencies including, but not limited to, the Federal Aviation Administration, Federal
Communications Commission, Florida Department of Environmental Protection, St. Lucie
County Environmental Resources, Public Works, and Building Departments prior to the
commencement of any development activities on the property described in Part "B".
Issuance of this approval by the County does not in any way create any rights on the part
of the developer to obtain a permit from a State or Federal agency and does not create any
liability on the part or the County for issuance of this permit if the developer fails to obtain
requisite approvals of fulfill the obligations imposed by a State or Federal agency or
undertake actions that may result in a violation of State or Federal law.
E. A copy of this Order shall be attached to the site plan drawing described in Part "A", which
shall be placed on file with the St. Lucie County Planning and Development Services
Director and mailed to the developer and agent of record as identified on the site plan
applications.
F. The conditions set forth in Part "A" are an integral non-severable part of the Site Plan
approval granted by this Order. If any condition set forth in Part "A" is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan approval granted by this order shall become null and void.
G. The Site Plan, attached as Exhibit "A", shall be valid for the same period as this order.
H. The Certificate of Capacity, attached as Exhibit "B", shall be valid for the same period as
this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
This Order shall become effective upon the date of approval indicated below. Should the
property owner, developer or authorized agent wish to appeal any condition described in
Part "A" above, all such appeals must be filled in writing with the County Administrator

within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B),
St. Lucie County Land Development Code. Should an appeal to this Order be filed, no
permitting reviews or further administrative action shall take place on the processing of this
development project until the appeal is resolved.
J. This Order shall be recorded in/the Public Records of St. Lucie County.
