LUCIE COUNTY, FLORIDA, REGARDING ROAD IMPACT D N z FEES INCLUDING ROADWAY CAPACITY PROJECTS, STAND- m N ALONE SIDEWALK AND BICYCLE FACILITIES AND TRANSIT m CAPITAL; AMENDING ARTICLE VIII OF CHAPTER 24 OF THE ST. p9 o LUCIE COUNTY CODE OF ORDINANCES REGARDING ROADS IMPACT FEES, INCLUDING SECTION 24-256 INTENTS, PURPOSES, a m AND FINDINGS, SECTION 24-257 IMPOSITION OF ROADS IMPACT FEE, SECTION 24-258 COMPUTATION OF THE AMOUNT OF a ROADS IMPACT FEE, SECTION 24-261 USE OF FUNDS AND ROAD Z BENEFIT ZONES, SECTION 24-262 REFUND OF FEES PAID, DIRECTING THE PROVISION OF NOTICE OF IMPACT FEE RATES; PROVIDING FOR SEVERABILITY, PROVIDING FOR CODIFICATION, PROVIDING FOR LIBERAL CONSTRUCTION, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. The St. Lucie County Comprehensive Plan establishes that land development shall not be permitted unless adequate capital facilities exist or are assured; and. 2. The St. Lucie County Comprehensive Plan establishes that a development shall, bear a proportionate share of the cost of the provision of the new or expanded capital facilities required by such development; and, 3. Policy 9.1.2.3 of the St. Lucie County Comprehensive Plan recognizes the obligation of future development in the community to be responsible for paying its capital facility/improvement impacts; and, 4. St. Lucie County first adopted Road Impact Fees in 1985 and implemented fees in 1986 as an important source of revenue to use in funding the infrastructure necessitated by new growth. Since then, the County has continued to periodically update its Road Impact Fee Study, last updated and adopted on April 19, 2022. 5. The St. Lucie County Code of Ordinances encompass the adopted Impact Fees and provisions for collection and utilization for public infrastructure and facilities to support the community. This integral revenue source supports infrastructure essential to serve growth but does not function as land development regulations. as defined in Chapter 163. Part 11, Florida Statutes. in that they do not regulate or control the development of land 1 in the County, but merely impose a fee to fund capital facilities needed to accommodate any new development. 6. The Florida Legislature, through the enactment of Section 163.31801 Florida Statutes, has provided the opportunity for local governments to enact impact fees; and, 7. As specified in Section 163.31801, F.S., each local government that adopts and collects an impact fee must ensure that the calculation of the impact fee is based on a study using the most recent and localized data available within 4 years of the current impact fee update and the new study must be adopted within 12 months of the initiation of the new impact fee study if the local government increases the impact fee. The local government must provide notice at least 90 days before the effective date of imposing a new or increased impact fee. 8. Impact fees must be proportional and reasonably connected to, or have a rational nexus with, the need for additional capital facilities and the increased impact generated by the new development. 9. St. Lucie County ranks 19th out of 67 Florida counties in population, with a population of approximately 385,000, The County is continuing to experience population growth, with a projected county-wide increase of 145,000 persons by 2050, or an average annual growth rate of 1.2 percent as estimated by the Bureau of Business& Economic Research (BEBR), ranking 7th among Florida counties. 10. In 2024, St. Lucie County ranked 13th for residential permitting, indicating high levels of new development. This continuing growth requires additional public capital facilities. 11. On July 17, 2025, the St. Lucie County Local Planning Agency/St. Lucie County Planning and Zoning Commission held a public hearing on the proposed ordinance after publishing notice in the St. Lucie News at least ten (10) days prior to the hearing and voted 4 to 1 to recommend that the proposed ordinance and rate revisions be adopted with a January 1, 2026 updated rate commencement date. 12. On August 19, 2025, this Board held its first public hearing on the proposed ordinance after publishing a notice of such hearing in the St. Lucie News on August 7, 2025, and voted to continue the item to the September 16, 2025, regularly scheduled Board meeting; and, 13. On September 16, 2025, this Board continued its first public hearing on the proposed ordinance and voted to hold a Special Informal Board Meeting on November 18, 2025, to 2 discuss the proposed Multi-modal Impact Fee rates and schedule the second public hearing on the proposed ordinance for the December 2, 2025, regularly scheduled Board meeting; and, 14. On December 2, 2025, this Board held its second public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune on November 21, 2025. 15. The Technical Memorandum prepared by Nilgun Kamp, AICP, with Benesch (f.k.a Tindale Oliver) dated September 2025 was revised to recognize the Institute of Transportation Engineers (ITE) 12'h Edition, released in August of 2025. This Technical Memorandum has been reviewed and adopted herein by reference. 16. The proposed amendments to the Roads Impact Fee Ordinance are consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and are in the best interest of the health, safety, and public welfare of the citizens of St. Lucie County, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA: SECTION 1. AMENDMENT OF SECTION 24-256 OF THE ST. LUCIE COUNTY CODE. Section 24-256 of the St. Lucie County Code, entitled Intents, Purposes, and Findings, is hereby amended as follows: Sec. 24-256. Intents, purposes, and findings. (a) This article is intended to implement and be consistent with the goals, objectives and policies of the county comprehensive plan. (b) The purpose of this article is to ensure that new development bears a proportionate share of the cost of capital expenditures necessary to provide roads and transportation facilities in the county as contemplated by the county comprehensive plan. For this article, including intent, purpose and findings, "Roads Impact Fee Ordinance" is synonymous with the "Roads / Multi-modal Impact Fee Ordinance" and Road Impact Fees are acknowledged as transitioning to "Multi-Modal" Impact Fees to address transportation capacity more broadly. (c) The state legislature, through the enactment of F.S. §§ 163.31801, has provided for local governments to enact impact fees, including Road or Multi-modal impact fees, as an important source of revenue for a local government to use in funding the infrastructure necessitated by new growth fafogr-am- (d) The county is charged with the responsibility and control over all an array of and-other roads, bridges, tunnels and related multi-modal facilities within the county road 3 and transportation system, in both unincorporated and incorporated areas, and thus is charged with increasing the capacity of these facilities as provided in F.S. §§ 125.01(1)(m) and 336.02. (e) The Florida Transportation Code establishes the specific responsibilities of the Florida Department of Transportation, the counties and the cities over the respective road systems within the state. The authority over the county road system is specifically vested with and preempted to the county. (f) All new construction within the county in both unincorporated and incorporated areas impacts the need for future improvements and additions to the county road and transportation system. Accordingly, the provision by the county of roadway-transportation capacity benefits all residents of the county, including residents of municipalities, and is in the best interest of the public's health, safety and welfare. The Circuit Court of the Nineteenth Judicial Circuit in and for St. Lucie County has previously considered and determined that the county may impose and collect road impact fees within the boundaries of the incorporated areas. (g) Development necessitated by the growth contemplated in the comprehensive plan and the roads multi-modal impact fee study will require infrastructure improvements and additions to the roads and transportation system to accommodate the new development generated by such growth and maintain the standards of service provided by the transportation system. (h) There is a rational nexus between future growth, as measured by new construction, and the need to expand the Roads and Transportation System through the acquisition and construction of new Buildings, apparatus, equipment, land, transportation improvements, and other Infrastructure and related mobility facilities in order to maintain the standards of service currently provided by the Roads and Transportation System. The Roads Multi-modal Impact Fees adopted herein for each Impact Fee Land Use Category are proportional to impact expected to be generated by new construction. (i) The Board has determined that ad valorem tax revenue and other revenues will not be sufficient to provide the infrastructure improvements to the Roads and Transportation system that are necessary to accommodate new construction within the county. (j) The County, through funding to the Roads and Transportation System, has a responsibility to provide transportation and related mobility facilities for the movement of vehicular, bicycle. and pedestrian traffic within both the unincorporated and incorporated areas of the County. The Roads and Transportation System benefits all new construction occurring within the County, and, therefore, the Roads Multi-Modal Impact Fees shall be imposed throughout the County, including within municipalities. (k) Future growth should contribute its fair share to the cost of the infrastructure improvements to the reads transportation system including related mobility facilities for the movement of motorists, bicyclists, and pedestrians that are required to accommodate the impact generated by such growth. (I) The county has broad economic development powers pursuant to F.S. § 125.045. Pursuant to these powers, the county has chosen to establish the potential to provide a discount to road impact fees to remain competitive economically with surrounding communities. SECTION 2. AMENDMENT OF SECTION 24-257 OF THE ST. LUCIE COUNTY CODE. Section 24-257 of the St. Lucie County Code, entitled Imposition of roads impact fee is hereby amended as follows: 4 Sec. 24-257. Imposition of roads Imulti-modal) impact fee. (a) Any person who seeks to develop land within the county by making improvements to land which will generate additional traffic and which requires the issuance of a building permit for any land development designed or intended to permit a use of land which will contain more dwelling units, buildings or square footage than the existing use of land, or to otherwise change the use of the land in a manner that increases the impact upon the roads and transportation system or applies for an electrical permit for recreational vehicle parks or mobile home parks shall be required to pay a roads multi-modal impact fee in the manner and amount set forth in this article. Nothing in this article shall be deemed to eliminate the requirements of Section 11.02.07 of the County Land Development Code. (b) The obligations herein for the payment of the reads multi-modal impact fee shall apply to all new construction that applies for a building permit on or after the applicable implementation date set forth in section 24-258. No building permit or electrical permit for a recreation vehicle park or mobile home park for any activity requiring payment of an impact fee pursuant to section 24-258 shall be issued unless and until the roads multi-modal impact fee hereby required has been paid. SECTION 3. AMENDMENT OF SECTION 24-258 OF THE ST. LUCIE COUNTY CODE. Section 24-258 of the St. Lucie County Code, entitled Computation of the Amount of Roads Impact Fee, is hereby amended as follows: Sec. 24-258. SECTION 4. AMENDMENT OF SECTION 24-261 OF THE ST. LUCIE COUNTY CODE. Section 24-261 of the St. Lucie County Code, entitled Use of funds and road benefit districts is hereby amended as follows: Sec. 24-261. '� Zone: 2 r - <. :: Z op e 3 ., -.:::i:,:::,&:i.::, : gm 4, (b) Except for allowable administrative expenses, all funds collected from roads multi-modal impact fees shall be used solely for the purpose of infrastructure improvements or enhancements to the roads system and related mobility facilities for the movement of vehicular, bicycle, and pedestrian traffic as identified in the county's comprehensive plan or by the FDOT. Reads Multi-modal impact fees shall not be used for maintenance or operation purposes. Such improvements shall be of the type as are made necessary by the new development. (c) Funds shall be encumbered and expended in the order in which they are collected. All roads multi-modal impact fee funds shall be used exclusively for 1) identified roads transportation infrastructure projects within the roads multi-modal benefit zone from which the funds were collected; or 2) reads transportation infrastructure projects in adjacent roads multi-modal benefit zones which are of direct benefit to the roads must;-modal benefit district from which the funds were collected. Each road impact fee collected within the prior establish districts and not yet expended or encumbered shall be reallocated to the respective road benefit district established herein from which they were collected. (d) Each July the county administrator shall present to the board of county commissioners a proposed capital improvement program for roods transportation infrastructure on the roads transportation system of the county, assigning funds, including any accrued interest, from the several special revenue funds to specific roads trarsporta tic,_ infrastructure projects and related expenses. Monies, including any accrued interest, not assigned in any fiscal year shall be retained in the same special revenue funds until the next fiscal year except as provided by the refund provisions of this article. SECTION 5. AMENDMENT OF SECTION 24-262 OF THE ST. LUCIE COUNTY CODE. Section 24-262 of the St. Lucie County Code, entitled Refund of fees paid is hereby amended as follows: 34 Sec. 24-262. Refund of fees paid. (No Changes in subsections (a)) (b) Any funds not expended or encumbered by the end of the calendar quarter immediately following ten years from the date the &ad-s multi-modal impact fee was paid shall, upon application of the then-current owner of the property feepayer, be returned to him with interest based on the Local government surplus funds trust fund (Florida PRIME). Refunds shall be made only in accordance with the following procedure: (1) The then-current owner shall petition the County for the refund within ninety (90) days following the end of the calendar quarter immediately following the tenth anniversary of the date of payment of the Impact Fee. (2) The petition for refund shall be submitted to the County Administrator and shall contain: a. A notarized sworn statement that the petitioner is the present owner of the property on behalf of which the Impact Fee was paid; b. A copy of the dated receipt issued for payment of the Impact Fee or such other record as would evidence payment; and c. A certified copy of the latest recorded deed or a copy of the most recent ad valorem tax bill. (3) Within 90 days from the date of receipt of a petition for refund, the county administrator will advise the petitioner and the board of the status of the impact fee requested for refund, and if such impact fee has not been expended or encumbered within the applicable time period, then it shall be returned to the petitioner. For the purposes of this section, fees collected shall be deemed to be spent or encumbered on the basis of the first fee in shall be the first fee out. (4) In the event that a legal challenge is filed in connection with the payment of any impact fee, the ten-year period referenced in this section shall not begin to run until completion of the associated litigation and appeals. (c) Refunds of fees for reasons other than those described in sections 24-262(a) and 24- 262(b), shall, upon county administrative approval of an application of the then-current owner of the property describinq the reason for a refund of fees, be entitled to a refund of the impact fee paid as a condition for its issuance, plus interest based on the local government surplus funds trust fund (Florida PRIME), except that the county or collecting government entity, if not the county. shall retain its administrative expenses from the collection of impact fees, plus 4% of the refund request to cover the cost of refund review and processing. Refunds shall be made only in accordance with the following procedure: (1) The then-current owner shall petition the county for the refund within 180 days following the date of payment of the impact fee, for one of the following reasons: a. After-the-fact application of an impact fee exemption or allocation of impact fee credits, whereby a building or an electrical permit for a mobile home park or recreational vehicle park was issued and impact fees paid prior to the application of an impact fee exemption or allocation of impact fee credits; or b. An error caused by the developer or the county or collecting government entity, if not the county. 35 (2) The petition for refund shall be submitted to the county administrator and shall contain: a. A notarized sworn statement that the petitioner is the present owner of the property on behalf of which the impact fee was paid: b. A copy of the dated receipt issued for payment of the impact fee or such other record as would evidence payment: c. A certified copy of the latest recorded deed or a copy of the most recent ad valorem tax bill; and d. A statement detailing the reason and justification of the refund request accompanied by supporting documentation. (3) Within 90 days from the date of receipt of a petition for refund, the county administrator will advise the petitioner and the board of the status of the impact fee requested for refund, and if such impact fee has not been expended or encumbered within the applicable time period, then it shall be returned to the petitioner. For the purposes of this section, fees collected shall be deemed to be spent or encumbered on the basis of the first fee in shall be the first fee out. If the refund is found to be the fault of an error caused by the county or collecting government entity, if not the county. no fee shall be assessed for the review and processing of the refund. SECTION 6. NOTICE OF IMPACT FEES. (a) No later than June 30, 2026,the County Administrator is hereby directed to publish a notice once in a newspaper of general circulation within the County which notice shall include: (A) a brief and general description of the Impact Fees; (B) a description of the geographic area in which the Impact Fees will be collected; (C)the Impact Fee rates to be imposed for each Impact Fee Land Use Category; and (D) the date of implementation of the Impact Fee rates set forth in the notice, which date shall not be earlier than ninety(90)days after the date of publication of the notice. In the event this notice is not published by June 30, 2026,then the initial October 1, 2026 implementation dates for the Impact Fees shall be adjusted to ensure that the increased Impact Fee rates are not implemented earlier than ninety (90) days after the date of publication of the notice, and the implementation dates for the phased-in Impact Fee rates in 2027 shall be similarly adjusted to occur one-year after the initial implementation date for such Impact Fees. (b) The obligations herein for the payment of the Impact Fee shall apply to all new construction that applies for a Building Permit on or after the applicable implementation date. SECTION 7. MISCELLANEOUS. 36 (a) If any clause, section or provision of this Ordinance shall be declared unconstitutional or invalid for any reason or cause, the remaining portion of said chapter shall be in full force and effect and be valid as if such invalid portion thereof had not been incorporated herein. (b) It is the intention of the Board, and it is hereby ordained that the relevant provisions of this Ordinance shall become and be made a part of the St. Lucie County Code; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. (c) The terms and provisions of this Ordinance shall be liberally construed to affect the purpose for which it is adopted. (d) A certified copy of this Ordinance shall be filed with the Department of State within 10 days after its enactment by the Board and shall take effect as provided by law; provided the revisions to the Impact Fee rates shall become effective as provided in Section A hereof.
