LUCIE COUNTY GRANTING APPROVAL OF A MINOR ADJUSTMENT TO A PRW (PLANNED RETAIL/WORKPLACE) SITE PLAN KNOWN AS BEDNER FARMS EAST, PHASE 1. m O-n a 3 28 rrr WHEREAS the St. Lucie County Planning and Development Services Director has reviewed the 21 F application for the second Minor Adjustment to the Bedner Farms East, Phase 1 Site Plan, "o evaluated the comments of the St. Lucie County Development Review Committee on the -71,71c 3 application, and made the following determinations: o m 3,rn -Q N m 1. On April 2, 2024, the Board of County Commissioners approved Resolution 2024-57, , o changing the zoning from the AG-1 (Agricultural-1) Zoning District to the PRW (Planned co 7-. Retail/Workplace) Zoning District, and approving the associated Preliminary Development m Plan, for the project known as Bedner Farms. The subject site is +/-45.15-acres and has 0 the TVC (Towns, Villages and Countryside) Future Land Use designation. It is located o c northeast of the intersection of Koblegard Road and Indrio Road, as depicted on Exhibit A o .74 and described in Part B. 0 2. On September 30, 2024, the St. Lucie County Planning & Development Services Director approved the Site Plan for Bedner Farms East, Phase 1, by PDS Order 2024-74. 3. On September 30, 2024, the St. Lucie County Planning & Development Services Director granted Certificate of Capacity No. 3300, certifying concurrency for the approved project, including public facility capacity to maintain the standards for levels of service, subject to conditions of approval. 4. On January 27, 2025, the St. Lucie County Planning & Development Services Director approved the first Minor Adjustment to the Site Plan for Bedner Farms East, Phase 1, by PDS Order 2025-07, modifying the minimum detached single-family lot width from 30 feet to 35 feet. 5. On or about August 6, 2025, Friends 2, LLC, the property owner, represented by Jennifer Morton and Alex Ahrenholz, of JMorton Planning and Landscape Architecture, submitted a petition for a Minor Adjustment to a the Bedner Farms East, Phase 1 Site Plan providing the details for the proposed Amenity Center and a revised Landscape Plan. 6. On or about November 5, 2025, the property owner submitted a revised petition for a Minor Adjustment to the Site Plan providing the details for the Amenity Center, a revised Landscape Plan, the location of a school bus stop in the Amenity Center parking lot and re- locating the lift station to the south side of the entrance road. 7. The St. Lucie County Development Review Committee has reviewed the Minor Adjustment to the Site Plan, as depicted on Exhibit B, and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part A of this Resolution. 8. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 9. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED by the Director of Planning & Development Services of St. Lucie County, Florida: A. Pursuant to Section 11.02.05.(E) of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the PRW Site Plan, as depicted on Exhibit B and shown on the site drawings for the project prepared by JMorton Planning and Landscape Architecture, dated November 4, 2025 and received by the St. Lucie County Planning & Development Services Department on November 5, 2025, is hereby approved for the property described in Part B below, subject to the following conditions: 1. A Site Development Permit is required prior to any site improvement activities. 2. Prior to issuance of the Site Development Permit (SDP), a revised landscape plan shall be submitted that reflects the changed lots lines and driveway locations approved by the Minor Adjustment approved by PDS Order 2024-74. 3. In addition to compliance with all requirements of the Land Development Code, the application for the Site Development Permit shall include the following: a. Demonstration of application to the South Florida Water Management District for approval of the project's stormwater management system. b. Demonstration of application to the Fort Pierce Farms Water Control District for discharge of stormwater into its system. c. Submission of a Lighting Plan. d. In addition to the crosswalks indicated on the Site Plan, a marked crosswalk shall be provided on the south side of the northern guest parking area. e. Provision of a school bus stop. Provision of the school bus stop may require re- design of a roadway or intersection and approval of an adjustment to the Site Plan. (COMPLETE: The location of the school bus stop was identified on this Minor Adjustment to the Site Plan and approved by the St. Lucie County School District.) f. A 6-foot sidewalk is required along the Koblegard/Spanish Lakes Blvd Right-of- Way. g. An ADA-compliant connection between the sidewalk on the northernmost east- west street and Koblegard Road shall be provided. 4. Prior to commencement of development, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., the following shall be completed: a. updated listed species surveys, including crested caracara and gopher Page 2 of 7 PDS Order No. 2025-107 File No.: PDMN-2507-000027 tortoise surveys, shall be provided per state and/federal protocol. Should any listed species be found as a result of these surveys, appropriate permits from state and federal agencies shall be required. b. the proposed fee-in-lieu for the outstanding tree mitigation, in the amount of $198,400, shall be provided to the St. Lucie County Tree Mitigation Fund. c. a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 5. Prior to issuance of the Site Development Permit (SDP), the applicant, property owner, developer, successor or assigns shall convey to St. Lucie County, in a manner and form acceptable to the County Attorney, twenty-five feet (25 ft.) of right-of-way along Koblegard Road, as determined by the Public Works Department. 6. A Roadway Improvement Agreement and bond are required for the required improvements to Koblegard Road, including the construction of a roundabout at Koblegard and Spanish Lakes Blvd., construction of Koblegard Road to a point parallel to the northern property line of the project which continues the two-lane section, and construction of a 6-ft. sidewalk from Spanish Lakes Blvd. to the north property line. 7. No water or wastewater lines may be installed within the 25 feet of land area to be dedicated as right-of-way on Koblegard Road without prior approval of a Right-of-Way Permit. 8. A Subdivision Improvement Agreement and appropriate financial guarantees will be required to obtain Plat approval prior to installation and acceptance of all required improvements. 9. Submission of the proposed street names to the Property Acquisition Division of the County Attorney's Office for review and reservation with the application for approval of the Subdivision Plat. 10. Prior to the issuance of a building permit for any dwelling, the Certificate of Capacity for water and wastewater services shall be confirmed. 11. Prior to the issuance of a Certificate of Occupancy for any dwelling, all Category I invasive plants shall be eradicated from the site. B. The approvals and authorizations granted by this Order shall expire twenty-four(24) months from the effective date of this approval. unless a building permit is issued. or a site plan extension is granted in accordance with Section 11.02.06. of the St. Lucie County Land Development Code. D. The developer, including any successors in interest. is advised as part of this Minor PRW Site Plan Adjustment approval that the property owner(s), developer, etc. including any successors in interest. shall obtain all applicable development permits and construction Page 4 of 7 PDS Order No. 2025-107 File No.: PDMN-2507-000027 authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, Fort Pierce Farms Water Control District, and the St. Lucie County Environmental Resources, Public Works (including an exception to a Mining Permit), and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this Order by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part A are an integral non-severable part of the site plan approval granted by this order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. F. This Order shall become effective upon the date of recording. Should the property owner, developer, or authorized agent or other party with standing wish to appeal the Order or any condition described in Part A above, all such appeals must be filed in accordance with LDC Section 11.11.00. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. G. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
