HomeMy WebLinkAbout25-113 PDS ORDER 2025-113 FILE NO.: WDA-2510-000043 AN ORDER GRANTING A USE DETERMINATION TO PROVIDE ELIGIBLITY FOR 100 YEARS, LLC TO STORE AND DISTRIBUTE LIQUOR PRODUCTS (SIC CODE 4225) WITHIN THE CG (COMMERCIAL GENERAL) ZONING DISTRICT AS A PERMITTED USE FOR A PROPERTY LOCATED AT 6970 HERITAGE DRIVE, PORT ST. LUCIE, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request to allow 100 Years, LLC to store liquor products within the a suite located at 6970 Heritage Drive, in Port St. Lucie, which has a zoning designation of CG (Commercial General), and made the following determinations: 1. The owner, Lynn Hayden, on behalf of 100 Years, LLC, has submitted a request for a Use Determination to allow for the storage and distribution of liquor. The +/- 0.84-acre site is located on Heritage Drive, off of US Highway 1, within the CG (Commercial General) zoning district, and has a Future Land Use (FLU) designation of COM (Commercial). 2. The request for Use Determination to allow for storage and wholesale distribution of liquor as permitted use in the CG (Commercial General) Zoning District will allow 100 Years, LLC to locally house their inventory for distribution, without adverse effects on surrounding business or properties. 3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that a proposed use is in compliance with the provisions of the Land Development Code and the St. Lucie County Comprehensive Plan. The analysis was provided by staff in the memorandum titled "100 Years, LLC - Use Determination (WDA-2510-000043) PDS Order No. 2025-113" dated December 31, 2025, and it is provided as a reference with this order. 4. This determination to allow 100 Years, LLC, to store and wholesale distribution of their liquor inventory as a permitted use within the CG (Commercial General) zoning district is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan and the Land Development Code. 5. The proposed determination will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare within the CG (Commercial General) zoning district. MICHELLE R.MILLER,CLERK OF THE CIRCUIT COURT File No.:WDA-2510-000043 SAINT LUCIE COUNTY PDS Order 2025-113 FILE# 5572234 01/15/2026 08.31:42 AM Page 1 OR BOOK 5419 PAGE 1306-1309 Doc Type:ORD RECORDING: $35.50 NOW, THEREFORE, BE IT ORDERED by the Director of Planning & Development Services of St. Lucie County, Florida: The request of 100 Years, LLC, a Wholesale Liquor Company (SIC Code 4225), has been determined to be consistent with similar permitted uses in the CG (Commercial General) zoning district, and, as such, is determined to be a permitted use in this zoning district at a site located at 6970 Heritage Drive, Port St. Lucie, FL, (Parcel ID 3415-702-0010-000- 1) with the following conditions: 1 . Product deliveries to this site may not occur more than twice per month; 2. Delivery vehicles shall not block access to any adjacent property or impede traffic flow and shall not exceed 55ft. in length unless an adequate truck movement and turn analysis is filed with and accepted by the County Engineer; and 3. Should there be a validated complaint about a blocked roadway or neighboring property driveway as a result of deliveries for this business, this Use Determination may be revoked by the Planning & Development Services Director. PART A. SEVERABILITY If this Order or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. PART B. APPLICABILITY OF ORDER This Order shall only constitute approval of interior product storage and small-scale wholesale distribution of consumer liquor products within the CG (Commercial General) zoning district for as site located at 6970 Heritage Drive, Port St. Lucie, FL. The conditions set forth above are an integral non-severable part of this approval granted by this Order. If any condition is determined to be invalid or unenforceable for any reason and the applicant declines to comply voluntarily with that condition, the approval granted by this Order shall become null and void. PART C. TERM The approval and authorization granted by this Order shall expire twelve (12) months from the effective date of this approval, unless a Zoning Compliance Certificate is obtained for the use scope details herein. PART D. REQUIREMENT TO OBTAIN OTHER AUTHORIZATIONS The developer, including any successors in interest, is advised as part of this approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the File No.: WDA-2510-000043 PDS Order 2025-113 Page 2 appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, Fort Pierce Farms Water Control District, and the St. Lucie County Environmental Resources, Public Works (including an exception to a Mining Permit), and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this Order by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. PART E. CONDITIONS OF APPROVAL The conditions set forth herein are an integral non-severable part of the approval granted by this order. If any condition set forth is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. PART F. EFFECTIVE DATE This Order shall become effective upon the date of recording. Should the property owner, developer, or authorized agent or other party with standing wish to appeal the Order or any condition described above, all such appeals must be filed in accordance with LDC Section 11 .11.00. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this project until the appeal is resolved. PART G.
