LUCIE COUNTY GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO THE ESTANCIA PLANNED UNIT DEVELOPMENT (PUD) FOR A PROPERTY LOCATED ON THE WEST SIDE OF 25TH STREET, APPROXIMATELY 0.25 MILES NORTH OF EDWARDS ROAD AND 0.25 MILES SOUTH OF CORTEZ BOULEVARD, IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Adjustment to the Estancia Planned Unit Development (PUD) Site Plan submitted by KMA Engineering and Surveying, LLC., on behalf of Estancia Development LLC, evaluated the comments of the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. KMA Engineering and Surveying, LLC., submitted on behalf of Estancia Development LLC. a Minor Adjustment to the Estancia PUD Site Plan. The subject project is located on the west side of 25'r Street, approximately 0.25 miles north of Edwards Road and 0.25 miles south of Cortez Boulevard, within the PUD (Planned Unit Development) Zoning District. The Adjustment includes the following adjustments: Building Type A & B Townhomes • Increase the width of individual driveways from 10 feet and 14 feet to 16 feet to accommodate two (2) vehicles. • Add rear concrete patios to the multi-family buildings: Triplex (Building A) — 13.5 ft. by 4.1 ft.; Duplex (Building B) — 12.8 ft. by 4.0 ft. • Add an attached covered canopy measuring 3 ft. by 13 ft. at the rear of the property to cover the patio area. Note: This is a rental community: tenants will not be permitted to submit building permits to extend the covered canopy area. Clubhouse • Incorporate the final designs for the pool and playground area. 2. On November 20. 2007, the Board of County Commissioners granted Resolution 07-129, approving the Planned Unit Development Final Site Plan for the project known as Estancia PUD. The project consists of 12 single-family homes and 66 multi-family dwelling units on 10.38 acres. located on the west side of 25' Street, approximately one-quarter mile north of Edwards Road and one-quarter mile south of Cortez Boulevard in the PUD (Planned Unit Development) Zoning District. The Planning and Development Services Director granted extensions through PDS Order numbers 09-027, 10-030, 14-010, 16-004, 16-026, 17-001, 17-049 (PDS Order 17-049 was amended by PDS Order 18-005 due to a scrivener's error), 2020-015, 2020-083, 2022-052. Through these orders, the site plan was extended from its original expiration date of November 20, 2009, to April 30, 2024. 4. On December 7, 2023, the Planning and Development Services Director approved PDS Order 2023-083 for a Minor Adjustment to Estancia PUD to narrow the South 25th Street driveway to 36 feet, update the Environmental Impact Report, the Tree Mitigation Plan and the Landscape Plan to address the previous conditions of approval, relocate the proposed lift station near 25th Street, shift both bus stop locations, modify the building architectural style from Spanish to modern/traditional style, shift the location of Building A, and increase the project's overall parking spaces by eleven (11). 5. On October 18, 2024, the Planning and Development Services Director approved PDS Order 2024-071 for a Minor Adjustment to the Estancia PUD to update the following adjustments: Building Type A & B Townhomes • Remove the regular parking spaces in front of the townhomes to provide for individual driveways and garages. • Shift the locations of the building's placement from one to two and a half feet to allow driveways to meet the minimum 22-foot driveway length from the front-facing garage to the edge of the sidewalk. • Redesign the front-facing design to include garages for Building Types A & B. Estancia Way • Narrow the drive aisle from 26 feet to 20 feet. Relocate the pedestrian sidewalk to access the preserve hiking trail • Relocate the pedestrian sidewalk from Buildings (A) 11 and 12 to between Buildings (A) 10 and 11. Sidewalks • Minor modifications to the sidewalk configurations. Parking • Reduce the number of parking spaces from 174 to 169 spaces. 6. The St. Lucie County Development Review Committee has reviewed the proposed Minor Adjustment and found it to meet the technical requirements of the St. Lucie County Land Development Code, Comprehensive Plan, and has satisfied the standards of review set forth in Sections 11.02.05 and 11.02.07, Standards for Site Plan Review, subject to the conditions set forth in Part A of this Order. 7. Planning staff has performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services memorandum titled Minor Adjustment to Estancia Planned Unit Development (MNSP-2507-000172), dated January 6, 2026. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. 9. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 10. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 11. The subject property is located inside the Urban Service Boundary. Water and wastewater service will be supplied by Fort Pierce Utilities Authority (FPUA). NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Sections 11.02.05.E. and 11.02.07 of the St. Lucie County Land Development Code, the Minor Adjustment to the Estancia PUD is hereby approved as shown on the site plan drawings, prepared by KMA Engineering and Surveying, LLC., dated October 21, 2022, with a revision date of September 10, 2025, with the retention of the Conditions of Approval in Resolution 07-129, PDS Order 2023-083, and PDS Order 2024-071 conditions outlined below: 1. No tenants will be permitted to submit individual building permits to extend the covered canopy area for the rental community for the Triplex (Building A), Duplex (Building B), and Single-Family (Building C). 2. Prior to issuance of a Certificate of Occupancy, the remaining outstanding tree mitigation amount of seventy-two (72) inches diameter at breast height (DBH) shall be satisfied via an acceptable tree mitigation method as outlined within LDC 6.00.05.D. 3. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plants shall be eradicated from the site. B. PARCEL ID NUMBER: 2420-414-0001-000/4 C. The Estancia Planned Unit Development Final Site Plan and prior adjustment held an April 30, 2024, expiration date. On December 14, 2023, the Site Development Permit was issued for the project, with construction commencing soon thereafter. The project shall remain active, with the current Adjustment valid for twenty-four (24) months from the effective date unless the development permit expires. D. The developer, including any successors in interest, is advised as part of this Minor Adjustment, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state, federal, and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, the St. Lucie County Environmental Resources, Public Works, and Building Departments, and the St. Lucie County Fire District, prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a Page 4 PDS No. 2026-02 File No.: MNSP-2507-000172 permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filled in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings, which shall be placed on file with the St. Lucie County Planning and Development Services Department and copies provided to the developer and agent of record as identified on the site plan application. G. The conditions set forth in Part A are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. The active Certificate of Capacity, attached as Exhibit B, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. This Order shall be recorded in the Publicblic Records of St. Lucie County.
