LUCIE COUNTY GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO THE PLANNED UNIT DEVELOPMENT (PUD) FOR THE PROJECT KNOWN AS SILVER OAKS PUD, FOR A PROPERTY LOCATED IN ST. LUCIE COUNTY, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Adjustment to the Silver Oaks PUD submitted by Lucido & Associates, on behalf of KRE-KL Silver Oaks Owner LLC, evaluated the comments of the St. Lucie County Development Review Committee on the application and has made the following determinations: 1. On behalf of KRE-KL Silver Oaks Owner LLC, Lucido & Associates, is requesting a Minor Adjustment to the approved Silver Oaks Planned Unit Development (PUD) to modify the amenity center layout and design, and reduce the minimum townhome airconditioned (A/C) space from 1,975 sq. ft. to 1,700 sq. ft. without altering the townhomes' building footprint. Silver Oaks PUD is located on the Southeast corner of Tilton Road and Silver Oak Drive. The Future Land Use designation is RU (Residential, Urban), and the Zoning District is PUD (Planned Unit Development). 2. On March 1, 2005, the Board of County Commissioners granted Final Planned Unit Development (PUD) Site plan approval through Resolution No. 05-021 for the project known as Silver Oaks PUD. 3. February 6, 2007, the Board of County Commissioners granted a 12-month extension to the Silver Oaks PUD through the adoption of Resolution 07-018. 4. February 19, 2008, the Board of County Commissioners granted a 12-month extension through the adoption of Resolution 08-012. 5. April 29, 2009, the Board of County Commissioners and the developer entered into a Development Agreement that extended the expiration date by three additional years, to June 27, 2012. 6. November 1, 2012, the Board of County Commissioners and the developer entered into a Development Agreement that extended the expiration date by five additional years, to November 1, 2017. 7. December 12, 2013, the Board of County Commissioners approved an amendment to the Development Agreement that extended the expiration date by five years. On April 5, 2017, the Planning and Development Services Director approved PDS Order No. 17-014 for an Executive Order Extension. 9. On December 4, 2018, the Planning and Development Services Director approved PDS Order No. 18-063 for an Executive Order Extension with a new expiration date of February 11, 2023. 10. On August 1, 2022, the Planning and Development Services Director granted PDS Order No. 2022-022 approving a Minor Adjustment to the approved Silver Oaks PUD to provide for an increase in the stormwater storage area within the single-family portion of the project. The increase in stormwater storage area is required due to a previous dedication made in favor of St. Lucie County by the previous landowner, which resulted in deficient stormwater storage area for the remainder of the tract. The previously approved plan has been modified to accommodate the necessary increase in stormwater storage area, including a reduction in the single-family lot depth for Lots 65- 71 from 135' to 120', and a fifteen (15) foot shift in the internal roadway. The proposed Minor Adjustment also seeks to provide for two (2) additional improved amenity areas within the single-family and eastern townhome portions of the project, the addition of street trees and landscaping within the amenity parking areas, and amends language to allow the developer to construct three (3) or four (4) bedroom townhomes with 1,975 sq. ft. of airconditioned (A/C) space down from 2,195 sq. ft. 11. On January 21, 2025, the Board of County Commissioners approved the Final Plat for Silver Oaks PUD (PB 132/ PG 1-15). 12. On April 3, 2025, the Planning and Development Services Director granted approval through PDS Order 2025-032 Minor Adjustment to the approved Silver Oaks Planned Unit Development (PUD) to add a model home lot and adjacent parking area to the site. 13. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled Silver Oaks PUD — Minor Adjustment to the Planned Unit Development(MJSP-2509-000034), dated January 14, 2026. 14. The proposed Minor Adjustment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting public health, safety, and general welfare. 15. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 16. The proposed project will be constructed, arranged, and operated so as to not interfere with the development and use of neighboring property, in accordance with applicable district regulations. Page 2 PDS Order 2026-04 File No: MJSP-2509-000034 NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.05.E of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Silver Oaks PUD, is hereby approved as shown on the site plan for the project prepared by Lucido & Associates, revision dated October 9, 2025, and date stamped received by the St. Lucie County Planning & Development Services Department on October 13, 2025. All previous conditions of approval applicable to the subject property, as contained in Resolution 05-021 and subsequent PDS Orders, remaining in addition to the following: 1. Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 2. Prior to commencement of development, including, but not limited to; clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a 100% gopher tortoise survey conducted by a state certified gopher tortoise agent will be required per Florida Fish and Wildlife Conservation Commission (FWC) protocol. These surveys are only valid for 90 days. 3. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive species shall be eradicated from the site. 4. Individual building permits will be required with the St. Lucie County Permitting Department for the proposed clubhouse, pool, mail kiosk, ADA accessible route, fencing, and bike rack. 5. A Site Development Permit Modification is required for any increase in impervious area. B. The property on which the Minor Adjustment to the previously approved Planned Unit Development (PUD) is being granted is described as follows: LEGAL DESCRIPTION SILVER OAKS (PB 132-1) TRACT R-2 (0.596 AC - 25,942 SF) Amenity Center & Lots 83- 316 (Townhome Lots) PARCEL ID: 3423-800-0026-000-2 (Amenity Center Tract), et al. C. The minor adjustment to the Planned Unit Development granted by this administrative order shall expire twelve (12) months from the effective date, unless a Building Permit is obtained, or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. The Certificate of Capacity granted with the project's original approval, via Resolution 05- 021, shall remain valid for the period of this Development Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. E. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth is Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan adjustment granted by this order shall become null and void. F. A copy of this Order shall be placed on file with the St. Lucie County Planning & Development Services Department Director. G.
