A RESOLUTION APPROVING A VARIANCE TO ALLOW A SHED TO
ENCROACH 7.31 FT. INTO THE 15 FT. MINIMUM REAR YARD SETBACK
FOR AN OVERALL SETBACK OF 7.69 FT., AND TO ENCROACH 1.36 FT.
INTO THE 7.5 FT. MINIMUM SIDE YARD SETBACK FOR AN OVERALL
SETBACK OF 6.14 FT., FOR PROPERTY LOCATED AT 5503 PALED
PINES CIRCLE IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Special Magistrate, serving as the Board of Adjustment of St. Lucie County,
Florida ("Board of Adjustment"), based on the testimony and evidence, including, but not limited
to the staff report, has made the following determinations:
A. The Petition of Michelle Jerger requests a variance from Section 7.04.01 (Table 7-10) - Lot
Size and Dimensional Requirements of the St. Lucie County Land Development Code for an
existing (unpermitted) 200 sq. ft. detached structure to encroach 7.31 ft. into the fifteen (15)
foot minimum rear yard (setback)for a 7.69 feet rear setback, and to encroach 1.36 ft. into the
seven and a half (7.5) foot minimum side yard (setback) for a 6.14 feet side setback for the
property located at 5503 Paleo Pines Circle, in the RS-4, Residential, Single Family-4 Zoning
District
B. After publication of a notice of such hearing, installation of a sign on the property, and
notification by mail to all owners of property within 500 feet of the subject property, this Board
held a public hearing on January 28, 2026.
C. After consideration of the testimony presented during the public hearing, including that of the
petitioner, a neighbor, staff comments, exhibits, and the standards of review for granting
variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of
Adjustment has made the following determinations:
The granting of the side and rear setback variance request will not impair or injure other
property or improvements in the neighborhood in which the subject property is located nor
is it anticipated to directly harm other properties or other improvements in the area.
The setback variance request arises from conditions that are unique and peculiar to the
land and physical surroundings involved. The parcel's rear property line is bordered with
a wall and a thick line of vegetation, and it abuts the Turnpike Feeder Road right-of-way
providing additional geographic and vegetative separation from the residential properties
to the northwest. Additionally, the shed has been installed and constructed in such a way
that, should relief not be granted, the structure would have to be demolished in order to
abide by the setback requirements.
It was noted that the administrative variance for the side setback would likely have been
approved, and the rear setback would have been compliant, had the structure size been
reduced by approximately 60 sq. ft.

It was further noted that the applicant was unaware of the permit and setback requirements
and had no history of any significant prior violation.
The side and rear setback variance request is the minimum variance that will make
possible the reasonable use of the structure in its location and configuration and is not
contrary to the general spirit and intent of Saint Lucie County's Land Development Code
or the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida,
the Petition of Michelle Jerger, requesting variance from the setback requirements as detailed in
Part A is hereby approved for the property described in Part C below, as shown on the boundary
survey created by Luis M. Santaliz dated January 5, 2025, submitted to the Planning and
Development Services Department, attached herein as Exhibit"A"; provided, however, no lighting
shall be installed on the east side of the shed and the applicant is not relieved from any other
permitting or other requirements applicable to the structure

E. This Resolution shall become effective upon the date indicated below. An appeal from the
Board of Adjustment's action may be processed within thirty (30) days following the rendition
of the decision of this resolution in accordance with Section 10.01.07, of the St. Lucie County
Land Development Code.
F. This Resolution shall be recorded in the public records of St. Lucie County.
