LUCIE COUNTY, FLORIDA AUTHORIZING A TRANSFER AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR VARIOUS ROADWAYS AS FOLLOWS: ST. LUCIE COUNTY TO FLORIDA DEPARTMENT OF TRANSPORTATION (TRANSFER ON TO THE STATE HIGHWAY SYSTEM) C.R. 614 (INDRIO ROAD) FROM S.R. 713 (KINGS HIGHWAY) TO U.S. 1 / S.R. 5 (FEDERAL HIGHWAY) CR-712 (MIDWAY ROAD) FROM 1-95 / S.R. 9 TO U.S. 1 / S.R. 5 (FEDERAL HIGHWAY) FLORIDA DEPARTMENT OF TRANSPORTATION TO ST. LUCIE COUNTY (TRANSFER OFF THE STATE HIGHWAY SYSTEM) SR-607 (EMERSON AVENUE) FROM S.R. 614 (INDRIO ROAD) TO INDIAN RIVER COUNTY LINE SR-615 (N. 25TH STREET) FROM C.R. 611B (EDWARDS ROAD) TO U.S. 1 / S.R. 5 (FEDERAL HIGHWAY) AND AUTHORIZING THE CHAIR TO EXECUTE SAID AGREEMENT; PROVIDING FOR LEGISLATIVE FINDINGS AND INTENT PROVIDING FOR A SAVINGS PROVISION; PROVIDING FOR IMPLEMENTING ACTIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the DEPARTMENT refers to the transfer of jurisdictional authority for roadway corridors taken off the State Highway System as OFF and roadway corridors taken onto the State Highway System as ON; WHEREAS, the roadways may have multiple names simultaneously, as assigned by each agency with jurisdictional authority, with "U.S." referring to roadway corridors under FEDERAL jurisdiction, "S.R." referring to roadway corridors under STATE jurisdiction and "C.R." referring to roadway corridors under COUNTY jurisdiction. Roadways without these acronyms are typically LOCAL roadways; WHEREAS, the DEPARTMENT and the COUNTY mutually agree to the transfer of C.R. 712 (Midway Road) and C.R. 614 (Indrio Road) ON to the State Highway System; WHEREAS, the DEPARTMENT and the COUNTY mutual agree to the transfer of S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street) OFF the State Highway System; WHEREAS, based on the obligations set forth herein and a consideration of the criteria set forth in Section 335.0415, Florida Statutes, the Department and County are amenable to the requested transfer; and Now, therefore, be it adopted and resolved by the County Commission of St. Lucie STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION COUNTY RESOLUTION County, Florida as follows: Section 1. Legislative findings and intent. (a) The Board of County Commissioners of St. Lucie County hereby adopts and incorporates into this Resolution the recitals (whereas clauses) to this Resolution. (b) Although not a land development regulation, this Resolution is consistent with the goals, objectives and policies of the Comprehensive Plan of St. Lucie County. (c) St. Lucie County has complied with all requirements and procedures of Florida law in processing and advertising this Resolution. Section 2. Jurisdiction of County Roads transfer ON and OFF the State System; (a) St. Lucie County requests that jurisdiction of State Road C.R. 614 (Indrio Road) from S.R. 713 (Kings Highway) to U.S. 1 /S.R. 5 (Federal Highway) Roadway ID 94-004-500 from Beginning Mile Point (BMP) 0.000 to Ending Mile Point (EMP) 2.620 ON to the State System; and (b) C.R. 712 (Midway Road)from 1-95/S.R. 9 to U.S. 1 /S.R. 5 (Federal Highway) Roadway ID 94-530-000 from BMP 4.378 to EMP 9.940 ON to the State System; and (c) S.R. 607 (Emerson Avenue) from S.R. 614 (Indrio Road) to Indian River County Line Roadway ID 94-009-000 from BMP 0.000 to EMP 2.525 OFF the State System; and (d) S.R. 615 (N. 25th Street) from C.R. 611B (Edwards Road) to U.S. 1 / S.R. 5 (Federal Highway) Roadway ID 94-005-000 from BMP 0.000 to EMP 6.168 OFF the State System; (e) The Board of County Commissioners of St. Lucie County authorizes the execution of the Transfer Agreement attached hereto as Exhibit A and recognizes and accepts the terms and conditions found therein. (f) The Board of County Commissioners of St. Lucie County authorizes the Chair to execute the Transfer Agreement. Section 3. Future Implementing Actions. (a) The County Manager, or designee, is assigned the responsibility to take any and all necessary administrative actions that may be desirable or necessary to implement the provisions of this Resolution. (b) The County attorney is instructed to assist the Chair in the implementation of this Resolution. Section 4. Conflicts. STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION COUNTY RESOLUTION All resolutions or parts of resolutions in conflict with the provisions of this Resolution are hereby repealed and rescinded. Section 5. Severability. If any section, sentence, phrase, word, or portion of this Resolution is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of the Resolution not otherwise determined to be invalid, unlawful, or unconstitutional. Section 6. Effective Date. This Resolution shall take immediate effect upon enactment. The DEPARTMENT and the COUNTY are sometimes referred to in this Agreement as a "Party" and collectively as the "Parties." WITNESSETH WHEREAS, Section 335.0415, Florida Statutes, authorizes the Parties to enter this Agreement; WHEREAS, Section 316.006, Florida Statutes, grants original jurisdictional authority to control traffic on roadways as specified for the STATE, COUNTIES, and MUNICIPALITIES. Additionally, Section 316.006 outlines conditions under which these agencies may exercise jurisdiction over private roads, limited access roads, or roads owned or controlled by a special district that is located within their jurisdictional boundaries; WHEREAS, transfer of right-of-way ownership occurs separate from transfer of jurisdictional authority, and Section 337.29, Florida Statutes, states that the title to all roads transferred in accordance with Section 335.0415 shall be in the governmental entity to which such roads have been transferred, and right-of-way ownership may be necessary for the installation and maintenance of traffic control devices and roadway improvements deemed necessary for the adequate control of traffic on roadways; WHEREAS, the DEPARTMENT refers to the transfer of jurisdictional authority for roadway corridors taken off the State Highway System as OFF and roadway corridors taken onto the State Highway System as ON; WHEREAS, the roadways may have multiple names simultaneously, as assigned by each agency with jurisdictional authority, with "U.S." referring to roadway corridors under FEDERAL Road Jurisdiction Transfer(RJT)Agreement—Page I 1 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT jurisdiction, "S.R." referring to roadway corridors under STATE jurisdiction and "C.R." referring to roadway corridors under COUNTY jurisdiction. Roadways without these acronyms are typically LOCAL roadways; WHEREAS, the DEPARTMENT and the COUNTY mutually agree to the transfer of C.R. 712 (Midway Road) and C.R. 614 (Indrio Road) ON to the State Highway System as depicted on the Location Map attached hereto as Exhibit A-1 and the Road Data Form attached hereto as Exhibit B-1; WHEREAS, the DEPARTMENT and the COUNTY mutual agree to the transfer of S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street) OFF the State Highway System as depicted on the Location Map attached hereto as Exhibit A-1 and the Road Data Form attached hereto as Exhibit B-1; WHEREAS, 23 U.S.C. 116 requires that a maintenance agreement be entered into between the DEPARTMENT and the COUNTY if the right-of-way to be transferred to the COUNTY contains a project constructed using federal funds. If applicable, this requirement is satisfied by execution of this Agreement, and WHEREAS, the COUNTY by Resolution No. 2026-8 dated 1/27 , 20 26 , attached hereto as Exhibit C-1 and by this reference made a part hereof, desires to enter into this agreement and authorizes its officers to do so. NOW THEREFORE, in consideration of the mutual covenants and promises herein contained, and for other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the COUNTY and the DEPARTMENT agree as set forth below. This Agreement sets forth the terms and conditions under which the COUNTY and the DEPARTMENT will abide. The commencement of new jurisdictional and maintenance responsibilities is the date of this agreement's execution by the Department Secretary, unless otherwise specified in this Agreement. I. For roadway transfers ON to the State Highway System from the COUNTY: A. The COUNTY gives up all rights to the roadway corridors, including the right-of-way as generally depicted on the Right-of-Way Aerial Map, Exhibit A-4, except as may be specified in this Agreement. B. Roadway transfers from the COUNTY to the DEPARTMENT include, and are associated with the following: 1. C.R. 614 (Indrio Road) from S.R. 713 (Kings Highway) to U.S. 1 / S.R. 5 (Federal Highway) Roadway ID 94-004-500 from BMP1 0.000 to EMP2 2.620 2. C.R. 712 (Midway Road) from 1-95 / S.R. 9 to U.S. 1 / S.R. 5 (Federal Highway) 1 Beginning Mile Point 2 Ending Mile Point Road Jurisdiction Transfer(RJT)Agreement—Page I 2 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT Roadway ID 94-530-000 from BMP 4.378 to EMP 9.940 C. Roadway transfers ON to the State Highway System take effect immediately upon execution of this Agreement. D. The DEPARTMENT has currently programmed two (2) roadway improvement projects in its Work Program along the subject roadway segment of C.R. 712 (Midway Road), as described below and depicted on Exhibit A-3: 1. FM No. 231440.4 — Add Lanes and Reconstruct (Widen from 2 to 4 Lanes) from Glades Cut Off Road (BMP 5.899) to just west of Jenkins Road (EMP 6.541) a. Project FM 231440.4 is projected to let together with Florida's Turnpike Enterprise project FTE FM No. 451858.1, which includes the southern ramps interchange at C.R. 712 (Midway Road) and S.R. 91 (Turnpike Mainline). 2. FM No. 231440.5—Add Lanes and Reconstruct (Widen from 2 to 4 Lanes) from just west of Jenkins Road (BMP 6.535) to Selvitz Road (EMP 7.320) 3. The DEPARTMENT does not currently have roadway improvement projects in its Work Program along the subject roadway segment of C.R. 614 (lndrio Road). E. The DEPARTMENT accepts all responsibility for the roadway corridor, including the right-of-way, and will operate and maintain the roadway, including stormwater detention areas listed below and the bridges/structures listed below and as depicted on Exhibit A-1. Jurisdictional responsibility is confined to the limits of the right-of-way acquired as part of the Map Transfer and conveyances for this Agreement. Due to the logistical and operational limitations of the DEPARTMENT, certain responsibilities will be delegated to local entities as follows: 1. Responsibilities of the DEPARTMENT: In addition to the roadbed, this Agreement includes all curbs, guardrails, barrier walls, sidewalks, bicycle paths, culverts/pipes, drainage/control structures, pavement markings, streetlights (including those on bridge structures), traffic control devices (including traffic signal equipment), traffic monitoring sites (including data collection for traffic counts, as described below), and mowing (when standard landscaping is present), within the right-of-way at the time of transfer. a. The COUNTY may supplement maintenance responsibilities of the DEPARTMENT as needed to maintain roadway functionality. 2. Temporary maintenance provisions for C.R. 712 (Midway Road): a. The DEPARTMENT will take responsibility for maintenance of roadway segments along C.R. 712 (Midway Road) from U.S. 1 /S.R. 5 (Federal Highway) to Jenkins Road (MP: 6.535-9.940) upon effective date of transfer. The COUNTY will take temporary responsibility for maintenance of C.R. 712 (Midway Road) from Jenkins Road to 1-95 / S.R. 9 (MP 4.378-6.535) until the date of the DEPARTMENT's Construction Notice to Proceed (NTP) for project FM No. 231440-4. The DEPARTMENT will take responsibility for C.R. 712 (Midway Road) from Jenkins Road to 1-95 / S.R. 9 (MP 4.378-6.535) upon the date of the DEPARTMENT's Construction Notice to Proceed (NTP) for project FM No. Road Jurisdiction Transfer(RJT)Agreement—Page 13 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT 231440-4. Until such time that the DEPARTMENT assumes maintenance responsibilities for all segments, the COUNTY shall continue to maintain C.R. 712 (Midway Road). b. During construction, certain responsibilities for maintenance and operation of segments of C.R. 712 (Midway Road)will be temporarily delegated to the project managers for Work Program projects for the duration of roadway construction, subject to the provisions of the authorized MMOA for each Work Program Project. 3. The DEPARTMENT accepts all responsibility for and will operate and maintain the existing stormwater detention areas listed below, and as depicted on Exhibit G-1, that serve the subject roadway segments of C.R. 712 (Midway Road): a. Parcel ID #3403-502-0202-000-3, and #3403-502-0201-000-6, collectively located south of C.R. 712 (Midway Road) between Christensen Road and Winthrop Drive. b. Parcel ID #3405-411-0003-000-5, located at the southwest corner of C.R. 712 (Midway Road) and S 25th Street / NW St. James Drive. c. Parcel ID #3403-502-0094-020-8 (Pond #1), located along the north side of C.R. 712 (Midway Road) just east of 25th Street (NW St. James Drive). d. Parcel ID #3403-502-0095-010-2 (Pond #2), located along the south side of C.R. 712 (Midway Road) just east of 25th Street (NW St. James Drive). e. Parcel ID #3404-501-0660-010-4 (Pond #3&4), located north of C.R. 712 (Midway Road), just west of Sunrise Boulevard. f. Parcel ID #3403-312-0001-000-1 (Pond #5), located south of C.R. 712 (Midway Road) along Melville Road. 4. The DEPARTMENT accepts all responsibility for and will operate and maintain the future stormwater detention areas listed below, and as depicted on Exhibit G-2, that serve the subject roadway segments of C.R. 712 (Midway Road), upon construction completion: a. Parcel ID #3420-735-0075-000-2, #3420-735-0076-000-9, #3420-735-0077- 000-6 (Pond A), located on the south side of C.R. 712 (Midway Road) just east of Glades Cut Off Road. b. Parcel ID #3406-601-0002-000-4 (Pond 1), located along the north side of C.R. 712 (Midway Road)just east of Glades Cut Off Road. c. Additional stormwater detention areas associated with roadway construction projects FM No. 231440.4 and 231440.5. 5. The DEPARTMENT delegates the following responsibilities to the COUNTY: Provision of electricity and water for the irrigation system, mowing (when custom landscaping is present), and the maintenance of existing landscape, outfall routes, irrigation lines, and amenities within the right-of-way. Amenities include, but are not limited to, monument signs, benches, trash cans, flag poles, bus stops, transit shelters, and other assets installed by the COUNTY or the DEPARTMENT, including those associated with current or future road construction projects, and assets Road Jurisdiction Transfer(RJT)Agreement—Page 14 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT installed through permit. The COUNTY agrees to accept these responsibilities, and draft and amend, as necessary and appropriate, existing and new agreements between separate parties to carry out such responsibilities and maintain roadway function. 6. The DEPARTMENT may delegate responsibilities to local MUNICIPALITIES or other parties as necessary and appropriate to maintain roadway function. 7. The following items will remain under the operation and maintenance responsibility of their current provider: a. Existing amenities installed by a public agency (other than the COUNTY or the DEPARTMENT) or private entity for public use, including those associated with current or future road construction projects, and assets installed through permit. b. Existing installed utilities (including but not limited to: fiber-optic cables, gas lines, water lines, sewage lines, and electrical lines). c. Existing stormwater detention areas that serve the roadway and/or private property that are located wholly or partially outside the right-of-way. F. The DEPARTMENT will maintain and operate existing traffic monitoring sites located along the transfer segments of C.R. 614 (Indrio Road) and C.R. 712 (Midway Road), including data collection for traffic counts, as described in Section III.B below and as depicted on Exhibit A-2. G. The DEPARTMENT accepts all responsibility for and will operate and maintain the following bridges/structures and the associated abutments, sub-structure, approach slabs, and other structural elements along C.R. 712 (Midway Road): 1. The bridge over the North Fork of the St. Lucie River, having bridge ID 944021. H. By Resolution No. 2026-8 dated 1/27 , 20 26 , attached hereto as Exhibit C-2 and by this reference made a part hereof, the COUNTY expresses its intention to transfer the maintenance obligations and duties for at-grade railroad crossing #272254, located within the transfer limits of C.R. 712 (Midway Road) and as generally depicted on Exhibit G-5, to the DEPARTMENT. This transfer will occur once the DEPARTMENT enters into a separate Railroad Crossing Agreement with Florida East Coast (FEC) Railway, L.L.C. The DEPARTMENT may agree to assume all maintenance responsibilities for the railroad crossing, including relevant traffic control devices, in accordance with the terms of the new Railroad Crossing Agreement. Until such time as the new agreement is negotiated and signed, the COUNTY will continue to maintain the railroad crossing in accordance with the existing Railroad Crossing Agreement. I. The DEPARTMENT agrees to perform all activities necessary to keep the roadways fully and properly functioning at all times. Activities include overseeing maintenance duties assigned to others and enforcing maintenance agreements as necessary. The DEPARTMENT and the COUNTY will amend, revise, or create new agreements as necessary to ensure ongoing maintenance and preserve roadway functionality. 1. It is agreed that all obligations of the COUNTY, under any maintenance, utility, or other such agreement relating to any specific road to be transferred, shall be Road Jurisdiction Transfer(RJT)Agreement—Page 15 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT)AGREEMENT transferred at the same time and in the same manner as jurisdictional responsibility. If the agreements were made between the parties to this transfer, and the transferring party will no longer be involved after the transfer takes place, or an applicable agreement does not exist, new agreements or amended agreements shall be made in accordance with the provisions described in Section III.C. below. The COUNTY acknowledges that copies of any existing permits, agreements, and easements have been turned over to the receiving entity for their records prior to the execution of this Agreement. J. Transfer of the roadway corridor rights-of-way from the COUNTY to the DEPARTMENT shall be by right-of-way map transfer ("Map Transfer") or title deed. The method of conveyance for C.R. 614 (Indrio Road) and C.R. 712 (Midway Road) shall be determined based on the specific requirements of the transaction and in accordance with legal standards for property transfers. The COUNTY shall deliver the Map Transfer or title deed to the DEPARTMENT within ninety (90) days following the Execution Date of this Agreement. The Execution Date is the date which the Department Secretary signs this Agreement. The DEPARTMENT shall record the Map Transfer or title deed, at no cost to the COUNTY, in the public land records of St. Lucie County within sixty (60) days of its receipt and will ensure the property appraiser records are updated to accurately reflect this transfer. The DEPARTMENT shall provide the COUNTY with a copy of the recorded conveyance document within fifteen (15) days of receipt of the same from the recording office. Once the Map Transfer or title deed is recorded, undefined conveyances, including but not limited to easements, will be pursued within a reasonable timeframe. 1 . The right-of-way transfer for this Agreement shall be in accordance with the property conveyances included in the Interlocal Agreement between the COUNTY and the City of Port St. Lucie, attached hereto as Exhibit F. 2. The right-of-way transfer for this Agreement shall be consistent with the future right- of-way needs for projects FM No. 231440.4 and 231440.5, as generally depicted on Exhibit G-3, and Florida's Turnpike Enterprise project FTE FM No. 451858.1, as generally depicted on Exhibit G-4, for the purpose of constructing a new roadway intersection between C.R. 712 (Midway Road) and S.R. 91 (Turnpike Mainline), including the associated southern ramps and drainage structures. 3. The DEPARTMENT agrees to supplement the COUNTY's conveyance efforts as needed to complete the transfers within a reasonable timeframe. K. Any work by others requiring a permit for C.R. 614 (Indrio Road) and C.R. 712 (Midway Road) shall be permitted by both the COUNTY and the DEPARTMENT until such time that the respective transfer of each roadway corridor ON to the State Highway System has been recorded in the public land records of St. Lucie County. The COUNTY shall notify all permittee applicants that a dual permit by the DEPARTMENT is required prior to any work being executed. II. For roadway transfers OFF the State Highway System to the COUNTY: A. The DEPARTMENT gives up all rights to the roadway corridors, including the right-of- way as generally depicted on the Right-of-Way Aerial Map, Exhibit A-4, except as may Road Jurisdiction Transfer(RJT)Agreement—Page 16 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT be specified in this Agreement. B. Roadway transfers from the DEPARTMENT to the COUNTY include, and are associated with the following: 1. S.R. 607 (Emerson Avenue) from S.R. 614 (lndrio Road) to Indian River County Line Roadway ID 94-009-000 from BMP 0.000 to EMP 2.525 2. S.R. 615 (N. 25th Street) from C.R. 611 B (Edwards Road) to U.S. 1 / S.R. 5 (Federal Highway) Roadway ID 94-005-000 from BMP 0.000 to EMP 6.168 C. Roadway transfers OFF the State Highway System take effect immediately upon execution of this Agreement, excluding roadways with planned Work Program projects as outlined in this Agreement. Roadways with planned Work Program projects will automatically transfer OFF the State Highway System in their entirety upon the satisfactory completion of all DEPARTMENT Work Program projects for that roadway, listed below. Satisfactory completion shall be defined as the mutual written agreement of the COUNTY and the DEPARTMENT by letter of construction completion that the projects have been built in accordance with the design plans and specifications, which are incorporated herein by reference (collectively, the "Plans and Specifications"). D. The DEPARTMENT has currently programmed two (2) roadway improvement projects in its Work Program along the subject roadway segments of S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street), as described below and depicted on Exhibit A-3: 1. FM No. 446170.1 — S.R. 615 (N. 25th Street): Resurfacing from north of C.R. 611B (Edwards Road) (BMP 0.000) to north of Virginia Avenue (EMP 1.024). 2. FM No. 447651.1 —S.R. 607 (Emerson Avenue)from north of S.R. 614 (Indrio Road) (BMP 0.287) to south of 25th Street S.W. (EMP 2.525). 3. S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street) will each transfer separately to the COUNTY after satisfactory completion of their respective projects, and upon execution of this Agreement by the Department Secretary. E. The COUNTY accepts all responsibility for the roadway corridor, including the right-of- way, and will operate and maintain the roadway, including stormwater detention areas and the bridges/structures listed below and as depicted on Exhibit A-1. Jurisdictional responsibility is confined to the limits of the right-of-way acquired as part of the Map Transfer and conveyances for this Agreement. Due to the logistical and operational limitations of the COUNTY, certain responsibilities will be delegated to local entities as follows: 1. Responsibilities of the COUNTY: In addition to the roadbed, this Agreement includes all curbs, guardrails, barrier walls, sidewalks, bicycle paths, culverts/pipes, drainage/control structures, pavement markings, streetlights (including those on bridge structures), traffic control devices (including traffic signal equipment), traffic monitoring sites (including data collection for traffic counts, as described below), within the right-of-way at the time of transfer. Road Jurisdiction Transfer(RJT)Agreement—Page 17 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT 2. The COUNTY accepts responsibility for the provision of electricity and water for the irrigation system, mowing, and the maintenance of existing landscape, outfall routes, irrigation lines, and amenities within the right-of-way. Amenities include, but are not limited to, monument signs, benches, trash cans, flag poles, bus stops, transit shelters, and other assets installed by the COUNTY or the DEPARTMENT, including those associated with current or future road construction projects, and assets installed through permit. The COUNTY agrees to accept these responsibilities, and the COUNTY can draft and amend, as necessary and appropriate, existing and new agreements between separate parties to carry out such responsibilities and maintain roadway function. 3. The COUNTY may delegate responsibilities to local MUNICIPALITIES or other parties as necessary and appropriate to maintain roadway function. 4. The following items will remain under the operation and maintenance responsibilities of their current provider: a. Existing amenities installed by a public agency (other than the COUNTY or the DEPARTMENT) or private entity for public use, including those associated with current or future road construction projects, and assets installed through permit. b. Existing installed utilities (including but not limited to: fiber-optic cables, gas lines, water lines, sewage lines, and electrical lines). c. Existing stormwater detention areas that serve private property which are located wholly or partially outside the right-of-way. F. The COUNTY will maintain and operate existing traffic monitoring sites located along the transfer segments of S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street), including traffic data collection of traffic counts, as described in Section III.B, below and as depicted on Exhibit A-2. G. The COUNTY accepts all responsibility for and will operate and maintain the following bridges/structures and the associated abutments, sub-structure, approach slabs, and other structural elements along S.R. 615 (N. 25th Street): 1. The southbound bridge over Belcher Canal, having Bridge ID 940146. 2. The northbound bridge over Belcher Canal, having bridge ID 940147. 3. The southbound bridge over Canal No. 1, having bridge ID 940148. 4. The northbound bridge over Canal No. 1, having bridge ID 940149. 5. The box culvert along Moore's Creek. H. The COUNTY agrees to perform all activities necessary to keep the roadways fully and properly functioning at all times. Activities include overseeing maintenance duties assigned to others and enforcing maintenance agreements as necessary. The COUNTY and the DEPARTMENT will amend, revise, or create new agreements as necessary to ensure ongoing maintenance and preserve roadway functionality. 1. It is agreed that all obligations of the DEPARTMENT, under any maintenance, utility, railroad, or other such agreement relating to any specific road to be transferred, shall Road Jurisdiction Transfer(RJT)Agreement—Page 18 STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ROAD JURISDICTON TRANSFER (RJT) AGREEMENT be transferred at the same time and in the same manner as jurisdictional responsibility. If the agreements were made between the parties to this transfer, and the transferring party will no longer be involved after the transfer takes place, or an applicable agreement does not exist, new agreements or amended agreements shall be made in accordance with the provisions described in Section III.C. below. The DEPARTMENT acknowledges that copies of any existing permits, agreements and easements have been turned over to the receiving entity for their records prior to the execution of this Agreement. I. If there is evidence of historical or archaeological resources that could be adversely impacted after a transfer, the COUNTY agrees to maintain the resources in accordance with the Cultural Resource Management Coordinator (CRMC) recommendations, cultural assessment attached, hereto as Exhibit D. If no evidence of historical or archaeological resources is discovered, the COUNTY agrees not to adversely affect any such resources if discovered after the transfer. J. Transfer of the roadway corridor rights-of-way from the DEPARTMENT to the COUNTY shall be by Map Transfer or title deed. The method of conveyance for S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street) shall be determined based on the specific requirements of the transaction and in accordance with legal standards for property transfers. For immediate transfers, The DEPARTMENT shall deliver the Map Transfer or title deed to the COUNTY within ninety (90) days following the Execution Date of this Agreement. For future transfers, the DEPARTMENT shall deliver the Map Transfer or title deed to the COUNTY within ninety (90) days following satisfactory completion of all DEPARTMENT Work Program projects for that roadway. The COUNTY shall record the Map Transfer or title deed, at no cost to the DEPARTMENT, in the public land records of St. Lucie County within sixty (60) days of its receipt and will ensure the property appraiser records are updated to accurately reflect this transfer. The COUNTY shall provide the DEPARTMENT with a copy of the recorded conveyance document within fifteen (15) days of receipt of the same from the recording office. Once the Map Transfer or title deed is recorded, undefined conveyances, including but not limited to easements, will be pursued within a reasonable timeframe. 1. The DEPARTMENT agrees to supplement the COUNTY's conveyance efforts as needed to complete the transfers within a reasonable timeframe. K. Any work by others requiring a permit for S.R. 607 (Emerson Avenue) and S.R. 615 (N. 25th Street) shall be permitted by both the COUNTY and the DEPARTMENT until such time that the respective transfer of each roadway corridor OFF the State Highway System has been recorded in the public land records of St. Lucie County. The DEPARTMENT shall notify all permittee applicants that a dual permit by the COUNTY is required prior to any work being executed. In general: A. Section 335.02, Florida Statutes, requires the DEPARTMENT to hold a public hearing when redesignating a transportation facility from the State Highway System. A public hearing was conducted in conjunction with the St. Lucie County Board of County Commissioners meeting on January 27 , 2026. Documentation attached hereto as Exhibit E. B. The COUNTY shall continue to collect traffic data via the existing Traffic Monitoring Sites as depicted on Exhibit A-2. Such data will be collected annually during peak season (typically between January through Mid-April) and will be submitted via e-mail to the District Traffic Data Coordinator within thirty (30) calendar days after the data are collected. C. Maintenance Agreements 1. For immediate transfers: the DEPARTMENT and the COUNTY are amending the existing Traffic Signal Maintenance and Compensation Agreement and the existing State Highway Lighting, Maintenance, and Compensation Agreement prior to the transfer to assign responsibility for the maintenance of existing traffic control devices and existing streetlights within the right-of-way. The amended tables are attached hereto as Exhibit H-1 and H-2, respectively. 2. For future transfers subject to satisfactory completion of active or planned DEPARTMENT Work Program projects: The DEPARTMENT and the COUNTY will amend the Traffic Signal Maintenance and Compensation Agreement and the State Highway Lighting, Maintenance, and Compensation Agreement prior to the transfers to assign responsibility for the maintenance of existing traffic control devices and existing streetlights within the right-of-way, including any fixtures added through roadway construction. 3. The DEPARTMENT and the COUNTY will draft or amend, as necessary and when appropriate, any additional agreements not specified herein within a reasonable timeframe following the effective date of transfer for each roadway corridor, including both immediate and future transfers. D. The terms of this Agreement are summarized in Exhibit B-2. In case of a discrepancy between this Agreement and Exhibit B-2, this Agreement shall prevail. E. All words used herein in the singular form shall extend to and include the plural. All words used in the plural form shall extend to and include the singular. All words used in any gender shall extend to and include all genders. F. This Agreement embodies the whole agreement of the parties. There are no promises, terms, conditions, or obligations other than those contained herein, and this Agreement shall supersede all previous communications, representations, or agreements, either verbal or written, between the parties hereto.
