A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY,
FLORIDA, CLOSING, VACATING AND ABANDONING ANY INTEREST OF ST. LUCIE COUNTY
AND THE GENERAL PUBLIC IN A PORTION OF A 12' PUBLIC DRAINAGE EASEMENT AS
DESCRIBED IN PLAT BOOK 10, PAGE 70 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY,
FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the
following determinations:
1. That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section
11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County
may adopt resolutions vacating plats in whole or in part, which are under the jurisdiction
of the Board of County Commissioners of St. Lucie County, Florida.
2. Pursuant to Plat Book 10, Page 70, known as Jay Gardens — Ft. Pierce, St. Lucie County and
the general public have a dedicated interest in the following described land:
A PORTION OF LOTS 9 AND 10, BLOCK 6, ACCORDING TO THE PLAT OF JAY
GARDENS, AS RECORDED IN PLAT BOOK 10, PAGE 70, PUBLIC RECORDS OF ST.
LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE NORTH 6.00 FEET OF SAID LOT 9, TOGETHER WITH THE SOUTH 6.00 FEET OF
SAID LOT 10.
LESS AND EXCEPTING THEREFROM, THE WEST 6.00 FEET OF SAID LOTS 9 AND 10.
3. A Notice of Intent to Abandon was advertised on September 16 and September 23, 2025,
and no objections were received.
4. On November 4, 2025, the Board of County Commissioners approved Permission to
MICHELLE R. MILLER. CLERK OF THE CIRCUIT COURT

Advertise a Public Hearing.
5. On November 17, 2025, property owners within 500 feet were notified and one objection
was received from Kevin Snyder, residing at 8755 Moco Lane, Fort Pierce, FL 34945.
6. On November 18, 2025, a Notice of Public Hearing was advertised in the St. Lucie News
Tribune.
7. County staff has reviewed the petition and have filed no objections to the proposed
abandonment, subject to the recordation of an alternate permanent drainage easement.
8. Two parcels abut the public drainage easement and are owned by 182 Laidback Way LLC
and Jay Gardens LLC. The County received a signed affidavit of consent from 182 Laidback
Way LLC. Jay Gardens LLC did not provide a signed affidavit of consent or objection.
9. It is in the best interest of the public to vacate and abandon a portion of a 12' drainage
easement more particularly described as follows:
A PORTION OF LOTS 9 AND 10, BLOCK 6, ACCORDING TO THE PLAT OF JAY
GARDENS, AS RECORDED IN PLAT BOOK 10, PAGE 70, PUBLIC RECORDS OF ST.
LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE NORTH 6.00 FEET OF SAID LOT 9, TOGETHER WITH THE SOUTH 6.00 FEET OF
SAID LOT 10.
LESS AND EXCEPTING THEREFROM, THE WEST 6.00 FEET OF SAID LOTS 9 AND 10.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A PORTION OF LOTS 9 AND 10, BLOCK 6, ACCORDING TO THE PLAT OF JAY
GARDENS, AS RECORDED IN PLAT BOOK 10, PAGE 70, PUBLIC RECORDS OF ST.
LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE NORTH 6.00 FEET OF SAID LOT 9, TOGETHER WITH THE SOUTH 6.00 FEET OF
SAID LOT 10.
LESS AND EXCEPTING THEREFROM, THE WEST 6.00 FEET OF SAID LOTS 9 AND 10.
is hereby closed, vacated and abandoned.
