HomeMy WebLinkAbout26-012 PDS ORDER 2026-012 FILE NO.: WDA-2411-000033 AN ORDER GRANTING A USE DETERMINATION TO ALLOW PERMISSION TO SUCCEED EDUCATION CENTER, DBA PERMISSION 2 ACHIEVE ACADEMY TO OPERATE WITHIN THE CO (COMMERCIAL OFFICE) ZONING DISTRICT FOR A PROPERTY LOCATED AT 2959 MIDWAY ROAD, FORT PIERCE, FLORIDA. WHEREAS, pursuant to Section 3.01.02.B of the St. Lucie County Land Development Code, the Planning and Development Services Director is authorized to issue written interpretations and use determinations where a proposed use is not specifically listed or where ambiguity exists regarding classification within a zoning district. The Planning and Development Services Director has reviewed the request to allow Permission to Succeed Education Center to operate their academic support facility at 2959 Midway Road within the CO (Commercial Office) zoning district located in St. Lucie County, Florida, and made the following determinations: 1. The owner, Felicia Rattray, on behalf of Permission to Succeed Education Center, has submitted a request for a Use Determination to allow for the operation of their academic support center. The +/-4.29-acre site is located on Midway Road, within the CO (Commercial Office) zoning district, and has a Future Land Use (FLU) designation of RU (Residential Urban). 2. The request for Use Determination to allow for appointment-based tutoring and enrichment center serving no more than ten (10) students at one time within an existing building as permitted use in the CO (Commercial Office) Zoning District will create a place for Permission to Succeed Education Center to serve students within central St. Lucie County. 3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that a proposed use is in compliance with the provisions of the Land Development Code and the St. Lucie County Comprehensive Plan. The analysis was provided by staff in the memorandum titled "Permission to Succeed Education Center- Use Determination (WDA-2411-000033) PDS Order No. 2026- 012"dated February 17, 2026, and it is provided as a reference with this order. 4. This determination to allow Permission to Succeed Education Center, tutor and otherwise support students as a permitted use within the CO (Commercial Office) zoning district is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan and the Land Development Code. The proposed determination will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare within the CO (Commercial Office) zoning district. NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: Permission to Succeed Education Center, an academic support center (SIC Code 8299) has been determined to be consistent with similar permitted uses in the CO (Commercial Office) zoning district, and, as such, is determined to be a permitted use in this zoning district at a site located at 2959 Midway Road, Fort Pierce, FL. This approval is specifically limited to appointment-based tutoring and enrichment services serving no more than ten (10) students at any one time. Any material change in the nature, intensity, or scale of operations, including but not limited to expansion of student capacity, addition of daycare services, or transition to a traditional school model, shall require further review and may require additional approvals. This determination does not waive compliance with Building Code requirements, fire safety regulations, business tax receipt requirements, health department regulations, or any other applicable federal, state, or local regulations. PART A. SEVERABILITY If this Order or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. PART B. APPLICABILITY OF ORDER This Order shall constitute approval for the operation of Permission to Succeed Education Center, an academic tutoring and enrichment facility (SIC Code 8299), within the CO (Commercial Office) zoning district at 2959 Midway Road, Fort Pierce, Florida, subject to the limitations and findings contained herein. This approval is site-specific and use-specific and shall not be construed as approval of any expansion, intensification, or change in operational characteristics without further zoning review. The conditions and operational limitations set forth in this Order are integral and non- severable components of this approval.
