A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF ST. LUCIE COUNTY, FLORIDA RATIFYING THE PUBLIC SAFETY
DIRECTOR'S DECLARATION OF STATE OF LOCAL EMERGENCY
AND THE COUNTY ADMINISTRATOR'S ORDER BANNING OPEN
AIR BURNING IN ST. LUCIE COUNTY
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the
following determinations:
1. Pursuant to Section 252.38, Florida Statutes, political subdivisions of the state have the
power during a state of local emergency to provide for the health and safety of persons and property.
2. The Board of County Commissioners of St. Lucie County has adopted Resolution No. 00-
277 authorizing the St. Lucie County Administrator and the St. Lucie County Public Safety Director to
exercise certain emergency powers and authority during a local emergency.
3. On February 6, 2026,the St. Lucie County Public Safety Director declared a State of Local
Emergency at the request of the Fire Chief of St. Lucie County Fire District due to drought conditions in St.
Lucie County("St. Lucie County Declaration of Emergency"); and
4. On February 6, 2026,the St. Lucie County Administrator issued an Order banning open air
burning in St. Lucie County; and
NOW, THEREFORE, be it resolved by the Board of County Commissioners of St. Lucie County,
Florida:
1. The Public Safety Director's State of Local Emergency effective February 6, 2026, at 3:30
p.m. as noted above is hereby ratified.
2. The County Administrator's Order banning open air burning in St. Lucie County effective
February 6, 2026, at 4:25 p.m. is hereby ratified.
3. This resolution shall take effect upon adoption.
After motion and second, the vote on this resolution was as follows:
